NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M., FRIDAY, OCTOBER 18, 2002, IN THE CONFERENCE ROOM, TOWN ANNEX
BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the Application of the
following:

Applicant is APPEALING, under Nantucket Zoning By-law Section 139-31A, a
Decision of the Zoning Enforcement Officer ("ZEO") that stated in a letter dated
September 30, 2002, that under the Zoning By-law the Applicants must choose one street
as its frontage if a property is abutted by two streets as the Locus is. The Premises has
frontage along Berkeley Avenue and Monomoy Road, and as the property line along
Monomoy Road is continuous since the taking, the front yard setback would have to be
maintained along its entirety, without regard to the taking by the Town, eliminating
Boston Avenue on the easterly side from which to count as side yard lot line. In the
alternative, Applicant is seeking relief by V ARIANCE under Nantucket Zoning By-law
Section 139-16A to allow a reduction in the setback distance along what was formerly
known as Boston Avenue to ten feet, which was the minimum side yard setback distance
allowed from Boston Avenue prior to the taking by the Town of Nantucket in September,
2001, ofa portion of Applicant's property on the comer between Boston Avenue and
Monomoy Road, renaming it Monomoy Road. Said taking allegedly rendered the Locus
without a side yard lot line on the easterly side. The Locus is otherwise conforming in all
respects to the Zoning By-law.
The Premises is located at 38 and 40 MONOMOY ROAD, Assessor's Map 54,
Parcels 165 and 75, Land Court Plan 14974-E, Lot 6, and Plan Book 20, Page 6. The
property is zoned Liminted-Use-General-l. t

ADDENDUM
Applicant wishes to eventually construct an addition onto the easterly side of the existing
single-family dwelling. When the house was constructed in 1984, the front yard setback
was measured from Monomoy Road on the south. The street to the east was Boston
Av~nue and was considered a side yard. In the year 2001, the Town of Nantucket made a
road taking and rounded the comer where Monomoy Road intersected with Boston
Avenue. As a result, the Zoning Enforcement Officer has determined that Applicant's
, . prpperty abuts Monomoy Road for a distance of about 320 feet, all the way around the
new curve. Based upon this, Applicant's lot is saddled with a front yard setback
requirement on two sides which is a hardship and has negatively impacted Applicant's
expectations for the property when it was purchased, through no fault of his own.
Therefore, Applicant is APPEALING, under Nantucket Zoning By-law Section 139-31A,

Dear Mr. Glidden:
You have asked for my opinion regarding what constitutes the front yard setback at 38
Monomoy Rd. (Map# 54; Parcel# 165).
The Zoning Code defines the front-yard as, "[t]he yard extending from the street line of a
lot inwardly the required front-yard setback distance. For lots abutting two or more
streets or ways... the required front-yard setback shall be maintained from one street or
way." The side setback is maintained from each other lot lines. "Street line" is defined
as the "line separating a street from a lot as duly determined by matters of record."
The property abuts two streets- Berkeley A venue and Monomoy Road. The front-yard
setback will have to be maintained from one of these two streets. Since the property line
along Monomoy Road is continuous, as currently constructed, the front yard setback
would have to be maintained along its entirety. The site plan we reviewed in my office
seemed to indicate that your client has enough property to maintain the front-yard setback
