DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on
Friday, August 9, 2002, at 1:00 P.M., in the Conference Room in the Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the
following Decision on Application (053-02) of ROBERT AND LINDA BERGER,
of 16 Coppervail Court, Princeton, NJ 08540, in connection with property known
as 5 Wall Street, Nantucket, Massachusetts.
2. Applicants are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-16C(2) or in the alternative, relief by
V ARIANCE under Section 139-16A (Intensity Regulations - setbacks). The
Applicants are asking the Board to validate a first and second-story deck on a
single-family dwelling that is sited as close as about 8.4 feet from the
northwesterly rear yard lot line in a district that requires a minimum setback of
ten feet for lots of record. As the deck is angled away from said lot line, only one
corner of the deck lies within the setback area, or about nine square feet The
Locus is nonconforming as to lot size with the Lot containing about 24,267 square
feet in a district that requires a minimum lot size of 80,000 square feet In all
other respects, the Locus is conforming to the dimensional requirements of the
Zoning By-law. The Premises is located at 5 WALL STREET, Assessor's Map 82,
Parcel 81, Land Court Plan 14341-D, Lot 14. The property is zoned Limited-Use-
General-2.
3. Our Decision is based upon the Application and accompanying
materials, photographs, architectural drawings and representations and
testimony received at our public hearing. The Planning Board recommendation
was that the Application did not present any issues of planning concern. There
was one letter on file in support from an abutter, and there was no opposition
presented before or during the public hearing.
4. Applicants represented that the Premises consist of an about 24,267
square-foot lot in an 80,000 square foot zoning district and is bordered by
conservation land, which would limit the ability to expand the Lot in any
direction to cure the setback intrusion. The single-family dwelling was
constructed in 1984 and is conforming in all respects to the dimensional
requirements of the Nantucket Zoning By-law. A conforming addition was
constructed in 1996 and a Certificate of Occupancy was issued for this work. On
the "as-built" done in 1997 it showed that the existing structure was conforming,
including the then existing first and second floor decks, which were indicated to
be sited at about 10.97 feet at the northwesterly corner and at about 17.78 feet at
the southwesterly corner from the northwesterly side yard lot line. The required
side and rear yard setback for lots of record in this district was/ is ten feet The
current owners purchased the property in 1997. On December 14, 1999, Historic
District Approval ("HDC") was obtained to renovate the rear of the structure
and construct a first floor deck and replace and connect the second floor decks.
The HDC required that the second floor deck be integrated by a small
surrounding roof structure rather than as it was previously constructed without
same. The work was completed in accordance with the HOC plans. However,
when a new as-built site plan was done by a different licensed surveyor in
February, 2002, it was found that there was an error made at the time of the 1997
survey and that the new first floor deck and second floor deck roof overhang
were encroaching. Applicants further represented that at the time of the design
and construction of the new decks, it was thought that there was sufficient
distance, based upon the 1997 survey and original design of the decks, to
preclude any setback intrusions. The February, 2002 survey shows the original
decks sited at a minimum of a foot closer to the northwesterly side yard lot line
than the previous survey, and that compounded with the requirement of the roof
overhang by the HDC, combined to cause the unintentional setback intrusion.
Applicants represented that it would be very difficult and costly to remove the
about nine square feet of integrated deck and roof structure and that action
would render the structure not in compliance with the HDC Certificate of
Appropriateness No. 35,285.
5. Therefore, based upon the foregoing, the Board finds that the
intrusion is de minim us and has little impact upon the neighborhood. The error
appears to have been made in good faith, in reliance on an erroneous 1997 survey
and in an attempt to conform to an HDC approval. The Board also notes that
there is no remedy outside of removing the offending portion of the deck and
that would seem to have possible negative consequences. The Board further
finds that owing to circumstances relating to the shape and topography of the
structure, and especially affecting the Locus but not affecting generally the
zoning district in which it is situated, a literal enforcement of the provisions of
the Zoning By-law would involve substantial hardship to the Applicants, and
that desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the Zoning By-law. The Board also makes the finding that as there

was no survey done for the new decks at their foundation levels, Special Permit
relief is not available and Variance relief is appropriate under the Zoning By-law.
6. Accordingly, by a vote of four in favor (Sevrens, O'Mara, Wiley,
Loftin) and one vote opposed (Murphy), the Board of Appeals GRANTS the
requested relief by V ARIANCE under Nantucket Zoning By-law Section 139-16A
to validate the decks as presently constructed and sited, based upon the
following conditions:
(a) The decks are sited as shown in substantial conformity with
the "Plot Plan", done by Robert A. Emacl<, dated February 11, 2002,
marked as Exhibit A, a reduced copy of which is attached hereto; and
(b) There shall be no further increase in ground cover without
further relief from this Board. The Board notes that, under the current
Zoning By-law, a shed may be constructed on the Locus that would have a
maximum ground cover that would not exceed 120 square feet, and which
would not count as ground cover under the Zoning By-law, but which
would comply with setback requirements, without further relief from this

Request for a Variance
Description of Circumstances:
The applicant is seeking relief from the Nantucket Zoning Board of
Appeals to receive a variance for an unintentional incursion into the rear -
property line setback of their property at 5 Wall Street in Cisco. The
construction was permitted by Nantucket Building Permit #955-00 and
HOC approval #35,285, and involves an incursion to a maximum of 1.6'
at an angle and a total of 9 square feet into the setback, of a two story
deck construction. Location of setback incursion are delineated on
registered survey plan of Robert Emack dated February 11, 2002. It is the
belief of the applicant that any attempt to correct the incursion would
prevent substantive difficulty in complying with the guidelines and
approvals provided by the Historic District Commission.
