At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, June 14, 2002, at 1:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following Decision on the Application of SIASCONSET CASINO ASSOCIATION, of PO Box 315, Siasconset, MA 02564, File No. 048-02: 2. The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law ~139-33.A (4) and (5) (alteration or extension of a pre-existing, nonconforming structure/use). The Applicant proposes to alter and expand the pre-existing, nonconforming tennis club (which includes an assembly space), by constructing an about 244 square- foot addition to the easterly side of the main structure and an about 41 square-foot addition onto the westerly side of the structure for the purposes of creating additional storage space within the structure. Both additions will conform to ground cover and setback requirements. The Locus currently provides no parking on site and none is planned. Therefore, additional relief by SPECIAL PERMIT under Nantucket Zoning By-law ~139-18 (Parking Regulations), waiving any additional spaces that may be required with the addition of ground cover, and under ~139-20 (Loading Zone Requirements) is also sought to the extent necessary. The Locus is nonconforming as to use; parking; and setbacks, with several of the tennis courts being sited closer to lot lines than the required minimum of five feet. The Locus is situated at 10 NEW STREET, SIASCONSET, Assessor's Map 73.4.2, Parcel 16. The property is situated in a Siasconset-Old-Historic zoning district. 3. Our Decision is based upon the Application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that there was no matter of planning concern. There were no letters in support or in opposition presented at the public hearing or on file. 4. Applicant represented that the proposal before the Board of Appeals under this Application was to expand the interior storage and kitchen areas by constructing two separate one-story additions that would be conforming as to ground cover and setbacks. The Locus is conforming, except where a few of the tennis courts are sited within setback areas and there is no parking on site, nor has any been historically provided since the time of the 1972 enactment of the Zoning By-law. The fact that the use is pre-existing and nonconforming, and there would arguably be an expansion of that use with the construction of these additions, is the reason that this Application is before this Board. In addi tion, when there is an increase in the footprint of such a use or structure on a lot where no parking is provided, parking must be calculated as if newly constructed. Therefore, Applicant is also seeking relief from all spaces required under the Zoning By-law, including a loading zone. There is no additional parking requirement triggered by the construction of the additions themselves. Applicant further represented that there would be no increase in services or licensed occupancy of the structure as a result of this project. 5. Based upon the foregoing, by a UNANIMOUS vote, the Board of Appeals made the findings that the tennis club and structure upon the Locus is validly pre-existing and nonconforming in its present configuration; that the proposed alterations would not be substantially more detrimental to the neighborhood than the existing nonconformities, and that the proposed changes would not create any new nonconformity nor increase the intensity of use on the Locus. 6. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested SPECIAL PERMIT relief under ~139-33.A (4) and (5), and to the extent necessary ~139-18 and ~139-20, waiving all parking and loading zone requirements, to allow the alteration of the existing structure upon the Locus as proposed; subject to the following conditions: (a) The alterations shall be done in substantial conformance with the plot plan, done by Robert Emack, dated April 2, 2002, marked as Exhibit A, a reduced copy of which is attached hereto; (b) There shall be no increase in occupancy above the licensed 500, without further relief from this Board; and (c) The additions shall be done in substantial conformance with the Certificate of Appropriateness No. 39,510, as may be amended. 7.
