At a Public Hearing of the Nantucket Board of Appeals held at 1 :00 p.m., Friday,
May 10, 2002, in the Conference Room of the Town of Nantucket Annex Building, 37
Washington Street, Nantucket, Massachusetts, on the Application of PETER J.
BARRETT AND CLARA H. BARRETT, 300 Boylston Street, Suite 714, Boston, MA
02116-3923 (Board of Appeals File No. 040-02) the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
Law Section 139-9B(2)(0) (take-out food); Section 139-20 (loading zone); and Section
139-18 (Parking Requirement). Applicants propose to convert an existing one-story
structure into use as a take-out food establishment, with one station. The new use would
require six (6) parking spaces, and Applicants would provide four (4) conforming spaces
on site. Applicants are thus seeking relief from the provision of two (2) parking spaces
and a loading zone. The Locus would meet open space and all other dimensional
requirements.
The Premises is located at 30B WASHINGTON STREET, Assessor's Map
42.3.2, Parcel 23.3, Land Court Plan 9434-F, Lot 6. The property is zoned Residential-
Commercial.
2. This Decision is based upon the Application and materials submitted with it,
along with the testimony and evidence presented at the hearing. The Planning Board did
not make a recommendation. There was no opposition to this Application, and there
were six (6) letters from abutters supporting this Application.
3. Applicants, through counsel, represented that Applicants are proposing to sell
such food items as sandwiches, cold drinks and cookies for take-out consumption only.
There would be no interior or exterior seating. There would be no cooking or grilling on
the Premises. There would be a toaster, and a microwave oven for heating purposes. The
existing use on the Premises is an Antique Shop, and counsel represented that the
property has been used, without a three-year interruption, commercially since a time prior
to the 1972 enactment of the Zoning By-Law. Further, counsel represented that all
deliveries would be made to an off-site location and then transferred to the Locus by
personal vehicle, thus requiring no on-site deliveries oftrucks that would cause a possible
traffic hazard. Based upon the proposed usage, a total of six (6) spaces would be
required; five (5) for take-out and one (1) for up to three (3) employees a peak shift. Four
(4) conforming parking spaces would be provided on site, which would include one (1)
handicapped space. There would be no expansion of the footprint of the existing building.
The parking lot would be shelled, and there would be improvements made to the site that
would include brick walkways . The existing ground cover is 6.7% in a zoning district,
which would allow a maximum of50% for this about 7,954 square foot lot.
4. Therefore, based upon the foregoing, the Board finds that the proposed use of a
take-out food establishment with the waiving of the loading zone requirement, and
waiver of two (2) parking spaces is in harmony with the general purpose and intent of the
Zoning By-Law, and is not substantially more detrimental to the neighborhood than the
existing commercial use. Further, the Board fmds that the provision of the two (2)
additional parking spaces and a loading area would be physically impossible to provide
on the Premises, and the provision on-site, would possibly create a traffic and safety
hazard. The Board also notes that the property is situated within the commercial
downtown area of the Island and the use would be in keeping with other uses in the
immediate area.
5. Accordingly, by a UNANIMOUS vote, the Board hereby GRANTS the SPECIAL
PERMIT relief under Nantucket Zoning By-Law Section 139-9B(2)(0) to allow the take-
out food establishment; under Section 139-20 to waive the loading zone requirement; and
under Section 139-18 to waive two (2) of the required parking spaces. The grant of relief
is hereby conditioned upon the following:
a. The hours open to the public shall be no earlier than 8 AM and no later
than 7 PM on any given day;
b. All~e~!~~ be made to an off-site location, with no food service
delivery trucks to be allowed at the site;
c. The parking plan shall be as shown upon the "Site Plan to Accompany
ZBA Application", done by Richard K. Earle, of Nantucket Surveyors, Inc., dated April
4,2002, revised April 17, 2002, April 23, 2002 and May 9,2002, marked as Exhibit A, a
reduced copy of which is attached hereto, and which shows four (4) conforming on-site
parking spaces; and
d. A bike rack will be provided on site, outside of the parking area;
e. Trash related to the take-out food establishment shall be contained and
picked up on a daily basis when in operation;
f. There shall be no indoor or outdoor seating and no consumption of food
items on the Premises; and
g. There shall be no fryolator or grilling on the Premises as part of the
commercial operation.
6. The Board further approves, by a unanimous vote, the site plan, as described
above, under Nantucket Zoning By-Law Section 139-23.

food establishment. The establishment will have one take-out counter. Applicant is
required to have six parking spaces (5 for take-out and 1 for up to three employees),
Applicant is providing five (5) spaces as shown on the attached site plan and is
requesting the waiver of one (1) space with a single entrance/exit or, in the alternative,
Applicant seeks a waiver of two (2) spaces with a separate entrance/exit. Applicant is
also requesting the waiver of the off-street loading requirements. There will be no
seating provided.
