A Public Hearing of the NANTUCKET WNING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, MAY 10, 2002, IN THE CONFERENCE ROOM,
TOWN ANNEX BillLDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application ofthe following:

Applicants are seeking relief by VARIANCE under Nantucket Zoning By-Law
Section 139-16A (Intensity Regulations). Applicants are seeking to validate the siting of
a pre-existing, nonconforming single-family dwelling as well as validate a lot as
separately marketable and buildable, which was held in common ownership with adjacent
land until July 27, 1976. An "approval not required" plan dated July 15, 1976 was
recorded on July 27, 1976. The plan divided an existing lot containing about 4,719 square
feet, into two (2) lots: Locus (Lot 1), containing about 3,355 square feet, and Lot 2,
containing about 1,364 square feet (transferred to an abutter), in a district that requires a
minimum lot size of 5,000 square feet. The Locus was conveyed out of common
ownership to a predecessor-in-title on September 15, 1978 and then to the Applicants on
April 1, 1993. In addition to the above, the Locus is nonconforming as to frontage, with
the Locus having about 35.73 feet of frontage along Fair Street, in a district that requires
a minimum frontage of 50 feet; and, as to setback with the structure being sited as close
as about 0.2 feet from the northerly side yard lot line in a district that requires a minimum
side yard setback of five (5) feet. One (1) parking space is provided on site and would
continue to be provided. No expansion ofthe structure is planned under this Application,
which has a ground cover ratio of about 22% in a district that would allow a maximum
ground cover of 30% for this Lot.
The Premises is located at 39 FAIR STREET, Assessor's Map 52.3.2, Parcel 212,
Plan Book 19, Page 76, Lot 1. The property is zoned Residential-Old-Historic.

Applicants seek relief by Variance under Nantucket Zoning By-law Section 139-16A (Intensity
Regulations-minimum lot size). Applications are seeking a waiver of the minimum lot size
requirement in order to validate as separately marketable and buildable a lot which was held in
common ownership with adjacent land until July 27, 1976.
An "approval not required" plan dated July 15, 1976, was recorded at the Nantucket Registry
of Deeds on July 27, 1976, in Plan Book 19, Page 76 (copy attached). This plan divided an
existing lot containing 4,719 sq.ft. into two lots: Locus (Lot 1), containing 3,355 sq.ft., and Lot
2, containing 1,364 sq.ft. Lot 2 was created and transferred to an abuttor apparently in order
to cure an encroachment by the dwelling then existing on Lot 2 (see Plan Book 19, Page 76).
At the time, Lot 1 (Locus) was owned by Margaret S. Mooney and Susan C. Stetson, and Lot 2
was conveyed to Jane C. Mooney. Locus was conveyed to Samuel Bailey, Jr., and Janet G.
Bailey by Deed dated September 15, 1978, and then to Swede Plaut and Tracy Plaut
(Applicants) by Deed dated April 1, 1993.

DECISION:
At a Public Hearing of the Nantucket Zoning Board of Appeals, on Friday, May
10, 2002, at 1 :00 P.M., in the Conference Room in the Town Annex Building, 37
Washington Street, Nantucket, Massachusetts, the Board made the following Decision on
the Application ofS~DE PLAUT AND TRACY PLAUT, with a mailing address 39
Fair Street, Nantucket, MA 02554, Board of Appeals File No. 037-02:
1. Applicants are seeking relief by V ARlANCE under Nantucket Zoning By-Law
Section 139-16A (Intensity Regulations). Applicants are seeking to validate the siting of
a pre-existing, nonconforming single-family dwelling as well as validate a lot as
separately marketable and buildable, which was held in common ownership with adjacent
land until July 27, 1976. An "approval not required" plan dated July 15, 1976 was
recorded on July 27, 1976. The plan divided an existing lot containing about 4,719 square
feet, into two (2) lots: Locus (Lot 1), containing about 3,355 square feet, and Lot 2,
containing about 1,364 square feet (transferred to an abutter), in a district that requires a
minimum lot size of 5,000 square feet. The Locus was conveyed out of common
ownership to a predecessor-in-title on September 15, 1978 and then to the Applicants on
April 1, 1993. In addition to the above, the Locus is nonconforming as to frontage, with
the Locus having about 35.73 feet of frontage along Fair Street, in a district that requires
a minimum frontage of 50 feet; and, as to setback with the structure being sited as close
as about 0.2 feet from the northerly side yard lot line in a district that requires a minimum
side yard setback of five (5) feet. One (1) parking space is provided on site and would
continue to be provided. No expansion of the structure is planned under this Application,
which has a ground cover ratio of about 22% in a district that would allow a maximum
ground cover of 30% for this Lot.
The Premises is located at 39 FAIR STREET, Assessor's Map 52.3.2, Parcel 212,
Plan Book 19, Page 76, Lot 1. The property is zoned Residential-Old-Historic.
2. Our Decision is based upon the Application and accompanying materials, and
representations and testimony received at our public hearing. The Planning Board made
no recommendation. There were no letters on file and no opposition expressed at the
hearing.
3. Applicants represented, through counsel, that they have owned the Locus since
April 1, 1993. An "approval not required" plant dated July 15, 1976, was recorded at the
Nantucket Registry of Deeds on July 27, 1976, in Plan Book 19, Page 76. This plan
divided an existing lot containing about 4,719 square feet into two lots. The Locus (Lot
I) contained about 3,355 square feet oflot area. Lot 2, contained about 1,364 square feet
and was transferred to an abutter apparently in order to cure an encroachment by the
dwelling then existing on Lot 2. At the time, Lot 1 (Locus) was owned by Margaret S.
Mooney and Susan C. Stetson, and Lot 2 was conveyed to Samuel Bailey, Jr., and Janet
G. Bailey by Deed dated September 15, 1978, and then to the Applicants. The Lots were
held in common ownership until at least July 27, 1976, and thus there is a merger issue.
Said merger arguably taints the title and Applicants represent that there is an extreme
financial hardship, as the situation cannot be rectified, and there is no possibility of re-
merging Lots 1 and 2. There is no alteration or expansion of the structure proposed under
this Application. Parking will continue to be provided on site.
4. Therefore, given this property's history, the Board fmds that to not validate the
status of the Locus, as a separately marketable and buildable lot as now configured would
create a substantial hardship for the Applicants, who acquired the property more than 9
years ago in its current configuration, and have acted in good faith throughout. The
Board further fmds that the situation and the facts presented do not generally affect the
zoning district but rather are uniquely related to the size and shape of the Locus, and the
size of the Locus is in keeping with the character ofthe neighborhood, which consists
largely of similar sized lots. The Board also fmds, based upon the information presented
at the hearing, that the relief requested, can be granted without detriment to the public
good or derogation from the By-Law.
5. Accordingly, the Board of Appeals voted UNANIMOUSLY to GRANT the
requested V ARlANCE relief under Section 139-16A to validate the Locus, as currently
configured, as a separately marketable and buildable lot.
6. The recording of this Variance Decision in the Nantucket land records by the
Applicants shall constitute an exercise of this permit relative to the validation of the
Locus as separately marketable and buildable and as currently configured, provided said
recording is done within the statutorily required time of one year from the date of filing
with the Town Clerk, in the absence of any appeal of the subject Decision. No further
additional action is required to prevent its expiration.
