DECISION:
1. At a Public Hearing of the Nantucket Zoning Board of
Appeals, held on Friday, April 5, 2002, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
Decision on the Application of TRACY W. ROOT and M. SUSAN ROOT,
c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box
2669, Nantucket, Massachusetts 02584, File No. 030-02:
2. The Applicants are seeking relief by SPECIAL PERMIT
under Nantucket Zoning By-Law ~139-33.A (5) (al teration or
extension of a pre-existing, dimensionally nonconforming dwelling
without increasing the nonconformities in setback distances).
The Applicants propose to alter and expand an existing one-story
secondary single-family dwelling, without changing the ground
cover. The structure is situated as close as about 3.30 feet
from the westerly side yard lot line and as close as about 4.55
feet from the southerly rear yard lot line, in a district in
which the minimum side and rear yard setback is five feet. The
existing height of the structure would be increased within these
setback areas to add a second floor without coming any closer to
these lot lines than the existing structure. The two required
on-si te parking spaces would continue to be provided, and the
structures upon the subject property (the "Locus") are now, and
would continue to be, conforming as to ground cover ratio. In
addition to the above-referenced nonconformities of the secondary
dwelling, the Locus is nonconforming as to lot area, containing
about 3,645 square feet in a district in which minimum lot size
is 5,000 square feet; as to frontage, with the Locus receiving
access solely by a recorded easement and having no frontage on
any street or way; and with the principal dwelling, which is not
proposed to be altered in any respect under this Application,
being sited wi thin the required setback areas. (See Board of
Appeals File No. 063-95, which approved alterations to the
principal dwelling.)
The Locus is situated at 24 KING STREET, SIASCONSET,
Assessor's Map 73.4.2, Parcels 70 and 70.1, is shown upon plan
recorded with Nantucket Deeds in Plan Book 24, Page 71, as Lots 1
1
and 3, and is situated in a SIASCONSET RESIDENTIAL-1 zoning
district.
3. Our Decision is based upon the Application and
accompanying materials, and representations and testimony
received at our Public Hearing. There was no Planning Board
recommendation, on the basis that the Application presented no
matter of planning concern. There was support presented in
person by the President of the 'Sconset Casino, Inc., a directly
abutting property owner, at the public hearing; no other support
or opposition was received.
4. As described in the Application and as summarized in
Paragraph 2 of this Decision, and through representations made by
Applicants counsel, the Applicants propose to alter the pre-
existing, dimensionally nonconforming, secondary dwelling, having
a ground cover of about 262 square feet by upward extension
wi thin the existing footprint, with the proposed height of the
existing structure being raised from about 12 feet to about 21
feet above mean grade after alteration. In addition, the existing
nonconformi ties in setbacks would not be changed, but upward
extension would take place within the side and rear setback
areas. A reduced copy of a plot plan showing the existing
conditions upon the Locus, by John J. Shugrue, Inc., dated
February 27, 2002, is attached hereto as Exhibit A.
5. Based upon this presentation, and noting the support
from the directly-abutting property owner which would be affected
by the proposed alteration, the Board of Appeals, by UNANIMOUS
vote, made the finding that the proposed alteration of the
secondary dwelling upon the Locus would not be substantially more
detrimental to the neighborhood than the pre-existing
nonconformities, and GRANTED the requested relief by SPECIAL
PERMIT under Nantucket Zoning By-Law ~139-33.A(5), subject to the
following conditions:
(a) The alterations shall be performed in substantial
conformity with the approval by the Nantucket Historic District
Commission under Certificate of Appropriateness No. 36106 as may
be amended; and
(b) The height of the secondary dwelling, as altered
pursuant to the Special Permit granted by this Decision, shall
not exceed 21 feet above mean grade, and be done without change
in the ground cover of about 262 square feet of the secondary
dwelling.

structure/use), and to the extent necessary, a MODIFICATION of the Decision in BOA
File No. 063-95. Applicants propose to alter and expand an existing single-story
secondary single-family dwelling, without changing the ground cover. The structure is
situated as close as about 3.30 feet from the westerly side yard lot line and as close as
about 4.55 feet from the southerly rear yard lot line, in a district that requires a minimum
side and rear yard setback of five (5) feet. The existing height of the structure would be

to side and rear yard setback, having westerly side yard setback of
3.30 feet at the closest point and southerly rear yard setback of
4.55 feet at the closest point; minimum rear and side yard setback in
this district is five feet. The principal dwelling, which is not
proposed to be altered in any respect, is also nonconforming as to
setbacks; the locus is also nonconforming in that it has no street
frontage, being served by easement access. The locus is conforming
as to ground cover ratio and contains the required two parking
spaces. The applicants therefore apply for relief by Special Permit
under Nantucket Zoning By-law 5139-33.A(5), for the upward extension
of the secondary dwelling within the required setback areas, with the

peals, on Friday, November 3, 1995, at 1:00 P.M., in the Select-
men's Meeting Room, in the Town and County Building, Broad
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of TRACY W. ROOT and M. SUSAN ROOT,
c/o Reade & Alger Professional Corporation, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 063-95:
2. The applicants are requesting a FINDING pursuant to
M.G.L., c. 40A, ~6 and Nantucket Zoning By-law ~l39-33.A(4) (a),
or in the alternative a SPECIAL PERMIT under Nantucket Zoning By-
law ~l39-33.A (alteration or extension of a pre-existing noncon-
forming structure or use). The applicants propose to construct a
second floor addition to an existing principal single-family
dwelling, a portion of which will be over a part of the structure
that is sited within the side and rear yard setback areas, with-
out coming any closer to the lot line. The structure in noncon-
forming as to rear yard setback, being sited less than one (1)
foot from the westerly lot line at its closest point in a dis-
trict that requires a minimum side and rear yard setback of five
(5) feet, The lot is also nonconforming as to minimum lot size,
having lot area of 3,645 square feet in a district that requires
minimum lot area of 5,000 square feet. The subject property (the

plan recorded with Nantucket Deeds in Plan Book 24, Page 71. The
property is zoned Residential-1.
3. Our decision is based upon the application and accompa-

der M.G.L., c. 40A, ~6 and Nantucket Zoning By-law ~139-33.A, the
issue before the Board of Appeals is that of whether the proposed
alterations will intensify the existing nonconformities, and if
so whether the proposed changes will be substantially more detri-
mental to the neighborhood than the existing nonconformities.
5. By UNANIMOUS vote, the Board found that the proposed
changes, involving construction and upward alteration within the
required five-foot rear yard setback, without increasing the in-
trusion into the setback area, would constitute an intensifica-
tion of the nonconformities upon the Locus.
6. By a vote of four members (O'Mara, Williams, Waine and
Angelastro) in favor, and one (Sevrens) opposed, the Board fur-
ther made the finding under M.G.L., c. 40A, ~6 and Nantucket Zon-
ing By-law ~139-33.A, that the proposed alterations, including
upward alteration and extension within the five-foot required
rear yard setback area, would not be substantially more detrimen-
tal to the neighborhood than the existing nonconformities, sub-
ject to the condition that the work shall be performed in sub-
stantial conformity with the plans approved by the Nantucket His-
toric District Commission under Certificate of Appropriateness
No. 27832.
