Plan 5004-Y/5004-G, Lots 2 -9, 84 - 92, 487 - 489 COT 2101/9198 At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1 :00 P.M., Friday, March 8, 2002, in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the Application of PAUL T. AND ELAINE B. RUSSELL, of2 Fairfield Street, Nantucket, MA 02554, Board of Appeals File No. 022- 02, the Board made the following Decision: 1. Applicants are seeking relief by V ARIANCE under Nantucket Zoning By-Law Section 139-16A (Intensity Regulations - ground cover). Applicants are asking the Board to validate a ground cover of about 3.6%, when a maximum ground cover of 1,500 square feet or 3% is allowed for a subminimum lot of record. Applicants are also seeking further V ARIANCE relief under the same section to construct an about 49 square-foot enclosed entryway that would increase the ground cover to about 3.7%. There would be no further alteration of the footprint and all parking would continue to be provided on the site, which contains a garage apartment and a separate single-family dwelling. All setback requirements would continue to be met. The Premises is located at 2 FAIRFIELD STREET, TOM NEVERS, Assessor's Map 76.1.4, Parcels 7 - 15, and Map 76.4.1, Parcels 447 - 458, Land Court Plan 5004-Y and 5004-G, Lots 2 - 9, 84 - 92 and 487 - 489. The property is zoned Limited- Use- General-3. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearings. The Planning Board made no recommendation as the matter was not of planning concern. An interested member of the public was present in the audience and expressed support for the Application. 3. Applicants represented that they had bought the vacant lot of record in 1985. They built the secondary garage apartment first in 1986 then built the primary dwelling in 1988. They obtained a Certificate of Occupancy for the garage apartment during a time when the Building Department did not require an as-built survey. They had set the batter boards themselves and thought that the garage had a ground cover of about 676 square feet. Based upon the figure, Applicants obtained a new Building Permit to construct the primary home which indicated a ground cover of about 822 square feet, again setting the batter boards themselves, which was the custom during those years to save money. When an as-built survey was done in 1996, Applicants found out that they had a problem with ground cover. They surmised that the difference was due to the fact that they had -- measured the ground cover to the foundation and not the finished wall as required by the By-Law. They are allowed a ground cover of either 3% or 1500 square feet, whichever is greater. The existing ground cover is about 1532 square feet or about 3.6%. Applicants are asking the Board to validate the existing ground cover ratio of about 3.6%. Applicants are also seeking further Variance relief under the same section to construct an about 49 square-foot enclosed entryway onto the primary dwelling that would increase the ground cover to about 3.7%. Applicants wish to add an enclosed entryway to the primary dwelling to allow reconfiguration of the interior entry foyer that is problematic. It would allow the moving out of the main exterior door to allow the other interior doors to work more properly and allow for safe exit from the dwelling in case of an emergency. All setback and parking requirements would continue to be met. 4. Therefore, based upon the foregoing, the Board finds that the grant of relief to validate the existing ground cover ratio would be in harmony with the general purpose and intent of the Zoning By-Law. The Board further finds that a grant of relief by Variance is appropriate in this case and that owing to circumstances relating to the topography of the structures, constructed in good faith at a time when as-built site plans were not required and many measured the ground cover to the foundation wall rather than the finished walls, and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provision of this Zoning By-Law would involve substantial hardship, financial or otherwise, to the Applicants, and a grant of relief would not cause substantial detriment to the public good, and have little impact upon the neighborhood, and the desirable relief may be granted without nullifying or substantially derogating from the intent or purpose of the By-Law. The Board further finds that the existing improvements would have no impact upon the neighborhood as they have existed in their present configuration for about 15 years and are arguably protected from any enforcement action under the curative provisions in MGL Chapter 40~ Section 7. However, the Board further finds that are insufficient grounds upon which to base a grant of Variance reliefto allow the increase in the ground cover ratio to about 3.7% to allow construction of an about 49 square-foot exterior entryway. Upon a request made by the Applicants to withdraw without prejudice that portion of the requested relief: the Board voted unanimously to allow said withdrawal. 5. Accordingly, by a 1)Jl~nimous vote, the Board GRANTS the requested relief by VARIANCE under Nantucket Zoning By-Law Section 139-16A to validate the existing ground cover of the two dwelling units upon the Locus, with a maximum ground cover of about 1532 square feet, or about 3.6%. Relief is conditioned upon the following: a. The structures are constructed in substantial conformance with the "Building Location Plan", done by Charles W. Hart & Associates, Inc., dated April 8, 1996, a reduced copy of which is attached hereto as Exhibit A.
