The additional beds would increase the number of rental beds from 48 to a total of 50. Applicants also seek relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-18 (parking Regulations) waiving two (2) additional required parking spaces engendered by the additional two (2) beds. The Lot contains two (2) structmes that are used for hostel guests, one (1) separate dwelling unit for the manager, a small garbage bin and the subject coal shed. The Premises is located at 31 Western Avenue, Assessor's Map 87, Parcel 94, Plan Book 7, Page 5. The property is zoned Residential-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation, as the matter was not of planning concern. There were two (2) letters in the file against the granting of the requested relief. 3. The Applicants, through counsel, represented that Board had previously granted the requested relief in Board of Appeals Decision No. 067-00, but that the Applicants were not able to obtain all the necessary approvals, secure the services of a licensed contractor and acquire a building permit before that Special Permit Relief expired after two years. In that previous hearing, the Board found that the use ofthe Premises as a Youth Hostel was a pre-existing, non-conforming use, predating the 1972 enactment of the Zoning By-law and that the coal shed, the subject ofthis Application, had probably been used for residential purposes for many years. Applicants further represented that Certificate of Appropriateness No. 34,350 had been issued for the alteration of the coal shed by the Historic District Commission. The Applicants request to increase the height ofthe coal shed by about three (3) feet, in order to bring the structure into compliance with the applicable Building Codes specifications required for human habitation. Applicants are seeking the same relief as in the prior Application, in which the requested relief was granted. 4. Therefore, the Board finds that the alteration and expansion ofthe coal shed by increasing its height from about 12 feet to about 15 feet as proposed, would increase the non-conforming nature of the structure as the massing would be increased within the required ten-foot side yard setback area without coming any closer to the westerly side yard lot line. However, the Board finds that said increase would not be substantially more detrimental to the neighborhood than the existing non-conformity. The Applicants request to formalize the use ofthe coal shed for residential purposes in order to regularize the existing and historic use of the structure. Therefore, the Board further finds that the change in use to allow human habitation, without a kitchen or bathroom, would not cause any additional burden to the neighborhood, and that the change of the use of the shed to a residential use would be de minimis and would not be substantially more detrimental to the neighborhood than the existing non- conforming use. The Applicants were allowed to withdrew without prejudice their request for a parking waiver as they can provide the two (2) conforming parking spaces on their property that are required by the addition of two (2) rental beds. The historical representations and findings of fact in the Decision in BOA File No. 067-00 are incorporated herein by reference. 5. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested SPECIAL PERMIT relief under Nantucket Zoning By-law ~139-33A to legitimize the use ofthe coal shed for residential purposes and to allow the increase in its ridge height to a maximum of about 15 feet, upon the following conditions: a. Applicant shall provide two (2) conforming parking spaces on the property off Western Avenue; b. Alterations to the coal shed structure shall be done substantially in compliance with Certificate of Appropriateness No. 34,350, as may be amended, or reissued; and. c.
