The minimum front yard setback required in the Siasconset Residential-2 zoning district in which the Locus is situated is 30 feet. The building was sited based upon a survey by a duly-licensed Professional Land Surveyor, and the encroachment upon the required setback area was discovered when an as-built survey was performed during the course of construction. Accordingly, the applicant requests relief by Special Permit under Nantucket Zoning By-law ~139-16.C(2), to validate this unintentional setback intrusion of about 3.36 feet into the front yard setback area, not greater than five feet into the front yard and not closer than four feet from a lot line, with the siting having been reasonably based upon a licensed survey.
