A Public Hearing of the NJ\NTUCKET WNING BOARD OF APPEALS will be held
at 1:00 P.M., FRIDAY, FEB~QARY 8, 2002, IN THE CONFERENCE ROOM,
TOWN ANNEX BUILDING; 37'WashingtenStreet, Nantucket, Massachusetts, on the
Application of the following:
ANDREW SCHWARTZ AND SHELLY SCHWARTZ, AS TRUSTEES OF THE
ANDREW SCHWARTZ REVOCABLE LIVING TRUST AND OF THE SHELLY
SCHWARTZ REVOCABLE LIVING TRUST

Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning
Bylaw Section 139-16C(2) to validate a said to be unintentional front yard setback
intrusion of about 3.36 feet, not greater than five (5) feet into the required 30-foot front
yard setback area, and not closer than four (4) feet from a lot line, with the siting having
been reasonably based upon a licensed survey. The new principal single-family dwelling
is sited as close as about 26.64 feet from the front yard lot line along Stone Post Way. In
the alternative, Applicants are seeking relief by VARIANCE under Nantucket Zoning
Bylaw Section 139-16A to validate the structure as currently sited. The Locus is
conforming is all other respects.
The Premises is located at 11 STONE POST WAY, Assessor's Map 73.3.2,
Parcel 74, Plan File ll-E, Lot 12. The property is zoned SR-2.

The principal dwelling now under construction upon the subject property (the
"Locus") is sited about 26.64 feet at its closest point from the line of Stone
Post Way, the only street or way which abuts the Locus. The minimum front yard
setback required in the Siasconset Residential-2 zoning district in which the
Locus is situated is 30 feet. The building was sited based upon a survey by a
duly-licensed Professional Land Surveyor, and the encroachment upon the required
setback area was discovered when an as-built survey was performed during the
course of construction. Accordingly, the applicant requests relief by Special
Permit under Nantucket Zoning By-law ~139-16.C(2), to validate this unintentional
setback intrusion of about 3.36 feet into the front yard setback area, not greater
than five feet into the front yard and not closer than four feet from a lot line,
with the siting having been reasonably based upon a licensed survey.
