At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1 :00 P.M.,
Friday, January 11, 2002, in the Conference Room, Town Annex Building, 37
Washington Street, Nantucket, MA, on the Application of LAWRENCE C. RAY
with a mailing address of 40 Vesper Lane, Nantucket, MA 02554, Board of
Appeals File No. 0<J1:02, the Board made the following Decision:
1. Applicant is seeking relief by VARIANCE under Nantucket Zoning ByLaw
Section 139-16A (Intensity Regulations-minimum lot size) to validate two (2)
abutting lots as separately marketable and buildable. Applicant proposes to
convey the one (1) vacant lot to his son and retain the other unregistered lot (Lot
1), which contains one (1) single family dwelling and a garage. Lot 1 has a lot
area of about 15,400 square feet and the Land Court vacant lot has a lot area of
about 14,940 square feet, in a district that requires a minimum lot size of 20,000
square feet. In addition, Applicant is seeking further relief by VARIANCE under
Section 139-16A to allow a swap of about 500 square feet of lot area between
the subject lots in order to eliminate the nonconforming setback and
encroachment of the garage on Lot 1 into the Land Court lot. The lot areas
would remain approximately the same.
The Premises are located at 40 Vesper Lane, Assessor's Map 55, Parcel 123,
Lot 1 on Plan Book 15, Page 40, and on Plan Book 14, Page 46 and land shown
on Land Court Plan 39921-A, formerly shown as Lot 2 on Plan Book 14, Page
46.
2. The Decision is based upon the Application and the materials submitted
with it and the testimony and evidence presented at the Hearing. The Planning
Board made no recommendation because they did not sit in time to review the
Application. There were no letters received regarding this matter. There was no
public opposition expressed at the hearing. The Applicant and his son and son's
family were present in favor of the Application.
3. The Applicant, through counsel, represented that he acquired the two (2)
lots now known as 40 Vesper Lane separately from his father by gifts and
purchase between December of 1998 and March of 1999.
4. The Applicant's father, Robert M. Ray, acquired Lot 1, an unregistered
parcel of land that contains about 15,400 square feet of area, that contains the
single-family dwelling and attached garage, on May 19, 1972 jointly with Elinor
M. Ray. In March of 1979, Elinor M. Ray conveyed her interest to Robert M. Ray.
She retained certain rights of first refusal to purchase Lot 1 under a divorce
agreement. Elinor Ray voluntarily terminated the Right of First Refusal when the
Applicant purchased the property from his father. The Dooley family built the
single-family dwelling with the attached garage in the 1950's and the garage
encroaches onto the abutting vacant Land Court property.
The Applicant's father purchased the abutting vacant Land Court property
in November of 1979 from Colleen V. McGrath. This Land Court lot has
approximately 14,910 square feet per the 1954 plan (Plan Book 14, Page 46) on
which it is shown as Lot 2. The 1954 plan shows the land before title was
registered by the Land Court. Mrs. McGrath, the prior owner, did the Land Court
registration process. The June 22, 1978 Land Court Plan 39921-A shows the
encroachment of the Applicant's garage.
The Applicant's father received a separate real estate tax bill for each Lot
until 1994. At that time the two (2) lots were combined for real estate tax
purposes only, based upon a misrepresentation to the owner that it needed to be
done because of the encroachment of the garage.
The Applicant's father believed that the two (2) Lots were grandfathered
under zoning as two (2) separately marketable and buildable lots, having been
acquired separately and from different owners. If Elinor Ray had exercised the
right of first refusal, the Lot 1 with the house may have been transferred
separately from the lot shown on the Land Court plan.
5. The Applicant proposes to convey the vacant lot to his son, Christian so
that Christian and his wife, both of whom are Town employees, may build a
house. Under current zoning, two (2) dwellings would be permitted on the
merged lot without relief from this Board. As proposed by the Applicant,
Variance relief would not create any greater density since the Applicant would
agree to a condition that only one (1) dwelling unit would be permitted on each
Lot, with the resulting aggregate total of dwelling units to be the same as that
currently permitted on the merged Lot.
6. Applicant also seeks Variance relief to allow the exchange of land area
between the two (2) lots of approximately 500 square feet so that the garage
attached to the existing dwelling, which currently encroaches onto the abutting
vacant Land Court property, will conform to the ten-foot zoning setback
requirement.
7. Therefore, the Board finds that Variance relief can be granted to validate
Lot 1 as a separately marketable and buildable lot containing a pre-existing
nonconforming single family dwelling with an attached garage for uses permitted
under the Zoning By-Law. Said structure would no longer be nonconforming as
to side yard setback with the grant of Variance relief to exchange the land area
between the two (2) lots. After the land area exchange each lot would be left
with approximately the same land area that each had before the exchange, thus
having no greater impact upon the neighborhood. The Board further finds, that
Variance relief can be granted to validate the vacant lot shown on Land Court
Plan 39921-A, formerly shown as Lot 2 on Plan Book 14, Page 46, as a
separately marketable and buildable lot for uses permitted under the Zoning By-
Law. The Board finds that the Lots have been consistently treated as separate
lots with separate title and tax histories. The Board also finds that the Applicant's
father, the Applicant and his family also acted in good faith and always treated
the two (2) lots as separate lots and always intended to hold them in separate
ownership because of their separate title history and usage. Variance relief is
consistent with relief that the Board of Appeals has repeatedly granted in the past
for similar circumstances.
The Board further finds that the configuration of each Lot, which is smaller
than the current zoning requirement of 20,000 square feet, does not generally
affect other lots in this zoning district. The Locus is proximate to the Residential-
10, 10,000 square-foot zoning district, which affects other properties across the
street on Cato Lane. The Ray Lots would be of a consistent size with other
nonconforming properties in their same proximity. If the property were treated as
one (1) lot, the Applicant would be allowed to construct a total of two (2) single-
family dwellings under current zoning. With a proposed condition there would be
a total of two (2) dwelling units permitted, one (1) on each Lot, and the property
would have the same density as already allowed under zoning. The Board also
finds that the exchange of land area between the two (2) lots would eliminate a
nonconforming side yard setback violation and is therefore beneficial to the
publiC good and the Lots would still retain approximately the same lot area as
they did before the land exchange between them, and a literal enforcement of the
provisions of the Zoning By-Law would involve substantial hardship to the
Applicant and his family and the desirable relief may be granted without nullifying
or substantially derogating from the general purpose or intent of the By-Law.
8. Accordingly, by UNANIMOUS VOTE, this Board GRANTS the VARIANCE
RELIEF requested under Nantucket Zoning By-Law Section 139-16A (Intensity
Regulations) to validate Lot 1, with the single family dwelling and attached
garage, and the vacant lot shown on Land Court Plan 39921-A, each as
separately marketable and buildable from each other, for uses permitted under
the Zoning By-Law and further allows the reconfiguration of the lots per Exhibit A.
The grant of relief is conditioned upon the following:
a. Each lot may contain no more than one (1) single-family dwelling unit;
and
b. The reconfiguration of the lots shall be done in substantial
conformance with the plan by Charles W. Hart & Associates, Inc., dated
December 10, 2001, revised January 11, 2002, entitled "Sketch for Boundary
Line Adjustment to correct garage encroachment", a reduced copy of which is
attached hereto as Exhibit A.

The Applicant seeks Variance relief pursuant to Section 139-16A to validate
property at 40 Vesper Lane, as two separate building lots, being shown as Lot 1, Plan
Book 15, Page 40, also Plan Book 14, Page 46 and Land Court Plan 39921-A.
The Applicant acquired the above property as partial gifts and a purchase from
his father between December of 1998 and March of 1999.
The Applicant's father, Robert M. Ray, acquired the unregistered parcel being Lot
1 on May 19, 1972 jointly with Elinor M. Ray. In March of 1979, Elinor M. Ray conveyed
her interest to Robert M. Ray. She retained certain rights of first refusal to purchase Lot
1 under a divorce agreement. The Right of First Refusal was voluntarily terminated
when the property was purchased by the Applicant from his father. Lot 1 has
approximately 15,400 square feet per the 1954 Plan recorded at Plan Book 14, Page 46.
Lot 1 was built upon prior to zoning and the garage encroaches onto the abutting
property.
The Applicant acquired the abutting registered land in November of 1979. The
registered lot has approximately 14,910 square feet per the 1954 plan showing the land
before title was registered by the Land Court. The garage on Lot 1 encroached slightly
onto the registered land.
The Applicant received a separate real estate tax bill for each Lot until 1994. At
that time the two lots were combined for real estate tax purposes only.
The Applicant believed that the two Lots were grandfathered under zoning as two
separate buildable lots, having been acquired separately and from different owners. If
the right of first refusal had been exercised, the two lots may have been transferred
separately.
The Applicant wants to do a partial gift and sale of the vacant lot to his son,
Christian so that he may build a home with his wife, both of whom are Town employees.
Variance relief would not create any greater density than the two (2) dwellings
that would already be allowed on the Lots if merged.
~ Applicants seeks such other relief as may be necessary to allow the exchange of
area between the two lots so that the existing dwelling, which currently encroaches onto
the abutting property, will conform to the required zoning setback.
Variance relief is requested to validate Lot 1 and the registered parcel as two (2)
separately marketable preexisting nonconforming Lots. Variance relief is consistent
with relief that the Board of Appeals has repeatedly granted in the past for similar
circumstances. The configuration of each lot, which is smaller than the current zoning
requirement of 20,000 square feet, does not generally affect other lots in this zoning
district. The R-1, 10,000 square foot zone, lots is across the street on Cato Lane and
these Ray lots would be of a consistent size with other properties in the neighborhood.
A literal enforcement of the Zoning Bylaw would involve substantial hardship to the
Applicant and the desirable relief may be granted without nullifying or substantially
derogating from the intent or purpose of the Bylaw.
The property is known as 40 Vesper Lane, Map 55, Parcel 123 and is zoned R-2.

Addendum
The Applicant seeks Variance relief pursuant to Section 139-16A to validate
property at 40 Vesper Lane, as two separate building lots, being shown as Lot 1, Plan
Book 15, Page 40, also Plan Book 14, Page 46 and Land Court Plan 39921-A.
The Applicant acquired the above property as partial gifts and a purchase from
his father between December of 1998 and March of 1999.
The Applicant's father, Robert M. Ray, acquired the unregistered parcel being Lot
1 on May 19, 1972 jointly with Elinor M. Ray. In March of 1979, Elinor M. Ray conveyed
her interest to Robert M. Ray. She retained certain rights of first refusal to purchase Lot
1 under a divorce agreement. The Right of First Refusal was voluntarily terminated
when the property was purchased by the Applicant from his father. Lot 1 has
approximately 15,400 square feet per the 1954 Plan recorded at Plan Book 14, Page 46.
Lot 1 was built upon prior to zoning and the garage encroaches onto the abutting
property.
The Applicant acquired the abutting registered land in November of 1979. The
registered lot has approximately 14,910 square feet per the 1954 plan showing the land
before title was registered by the Land Court. The garage on Lot 1 encroached slightly
onto the registered land.
The Applicant received a separate real estate tax bill for each Lot until 1994. At
that time the two lots were combined for real estate tax purposes only.
The Applicant believed that the two Lots were grandfathered under zoning as two
separate buildable lots, having been acquired separately and from different owners. If
the right of first refusal had been exercised, the two lots may have been transferred
separately.
The Applicant wants to do a partial gift and sale of the vacant lot to his son,
Christian so that he may build a home with his wife, both of whom are Town employees.
Variance relief would not create any greater density than the two (2) dwellings
that would already be allowed on the Lots if merged.
Applicants seeks such other relief as may be necessary to allow the exchange of
area between the two lots so that the existing dwelling, which currently encroaches onto
the abutting property, will conform to the required zoning setback.
Variance relief is requested to validate Lot 1 and the registered parcel as two (2)
separately marketable preexisting nonconforming Lots. Variance relief is consistent
with relief that the Board of Appeals has repeatedly granted in the past for similar
circumstances. The configuration of each lot, which is smaller than the current zoning
requirement of 20,000 square feet, does not generally affect other lots in this zoning
district. The R-1, 10,000 square foot zone, lots is across the street on Cato Lane and
these Ray lots would be of a consistent size with other properties in the neighborhood.
A literal enforcement of the Zoning Bylaw would involve substantial hardship to the
Applicant and the desirable relief may be granted without nullifying or substantially
derogating from the intent or purpose of the Bylaw.
The property is known as 40 Vesper Lane, Map 55, Parcel 123 and is zoned R-2.
