THOMAS BROME, of 500 Knollwood, Ridgewoor, NJ 07450-7302, Board of Appeals
File No. 002-02, the Board made the following Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning
Bylaw Section 139-33A (aheration/expansion of a pre-existing nonconforming
structure/use). Applicants propose to alter a said to be pre-existing nonconforming garage
structure by constructing an about 128 square-foot conforming single-story addition onto
the rear northerly portion of the structure, which is sited as close as about 1.1 feet from
the easterly side yard lot line, in a district that requires a minimum of five (5) feet. In
addition, The Locus is nonconforming as to front yard setback with the front stoop ofthe
dwelling extending over the southerly lot line.
The Premises is located at 13A VESTAL STREET, Assessor's Map 42.3.3,
Parcel 136, Plan Book 22, Page 83. The property is zoned Residential-OId-Historic.
2. The Decision is based upon the Application and materials submitted with it and
the testimony and evidence presented at the hearings. The Planning Board made no
. recommendation as the matter was not of planning concern. There were no letters on file
in favor or opposed. One (1) abutter spoke in favor of the Application.
3. Applicants represented that they wished to expand the garage structure by
constructing a single-story rear addition, which is proposed to contain emergency back-
up generators. The garage use would be maintained in the existing portion of the
structure. All dimensional requirements would be met and the resulting total ground
cover would be substantially less than the maximum allowed of 500/0 for this about
15,920 square-foot lot.
4. Therefore, based upon the foregoing, the Board finds that the construction of the
addition would not constitute an increase in the nonconforming nature of the structure
and would not be substantially more detrimental to the neighborhood than the existing
nonconforming situation, especially as the addition would be constructed in conformance
with setback requirements and located to the rear of the structure with very little impact
on the neighborhood.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
SPECIAL PERMIT relief under Nantucket Zoning Bylaw Section 1 39-33A to allow the
construction of an about 128 square-foot addition onto the garage structure that would
meet all dimensional zoning requirements upon the following conditions:
a. The addition shall be done in substantial conformance with the site plan,
done by Nantucket Surveyors, Inc., dated July 23,2001, as marked up, marked as Exhibit
A, with a reduced copy attached hereto; and
b. There shall be soundproofing of the 2' x 6' walls of the addition should
the addition be used for emergency generators.
