At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 1:00 p.m. on Friday, November 18, 2005, in the
Conference Room, Town Building Annex, 37 Washington Street,
Nantucket, Massachusetts on the Application of ADLUMIA S. AND
BENJAMIN GANNETT, of 14 Smith's Point Road, Manchester,
Massachusetts 01944, Board of Appeals File No. 086-05, the Board
made the following DECISION:
1. Applicants are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-33A(8) (alteration of a pre-
existing lot). Applicant is seeking validation of a 1977
subdivision that involved an equal exchange of about 143 square
feet of land between the Locus and the immediately abutting lot
to the east (the subject of BOA File No. 079-05 at the Nov. 18,
2005 meeting), altering the configuration of the lot lines. The
nonconforming frontage was made less nonconforming though not
conforming with the frontage increasing from about 39.25 to
about 45.25 feet along York Street. The easterly side yard
setback nonconformity of the single-family dwelling was
corrected with the cross conveyance. The nonconforming front
yard setback was unchanged. In addition, the Applicant is also
seeking relief by SPECIAL PERMIT under Section 139-33A
(alteration/expansion of a pre-existing nonconforming
structure/use). Applicant proposes to construct a second floor
addition onto the single-family dwelling within the same
footprint but raising the ridge height within the required 10-
foot front yard setback area without coming any closer to that
lot line. The ridge height is being increased from about 16.3
feet to about 22 feet, and only being raised over a portion of
the front part of the structure and not the entire structure.
Parking would continue to be provided on site.
The Locus is also nonconforming as to frontage with the lot
having about 45.25 feet of frontage along York Street in a
district that requires a minimum frontage of 50 feet; and as to
front yard setback with the house being sited as close as about
6.7 feet from the front yard lot line in a district that
requires a minimum front yard setback of ten feet. The Lot is
conforming in all other respects to the dimensional requirements
of the Zoning By-law.
The Premises is located at 44 YORK STREET, Assessor's Map
55.4.1, Parcel 53.1 and 53.2, Plan Book 19, Page 125. The
property is zoned Residential-I.
2. The Decision is based upon the Application and materials
submitted with it, and the testimony and evidence presented at
the hearing. The Planning Board made no recommendation, as
there were no issues of planning concern. There was no
opposition to the Application at the hearing and no letters on
file other than one from the Applicants' representative
verifying that the oil tank that was sited within the required
five-foot easterly side setback area had been removed and the
structure conformed as to that side yard setback requirement.
3. Applicants, through their representative, stated that the
locus was improved by a one and one-half story wood frame
primary dwelling, conforming in all respects except as to the
ten-foot front yard setback requirement, and a small accessory
building located to the rear of the property, conforming in all
respects. Based on the plan prepared by Josiah Barrett (the
"Barrett Plan") dated May 14, 1977 and approved by the Planning
Board on July 18, 1977, a reduced copy of which is attached
hereto as Exhibit A, the dwelling had existed in its current
location since at least 1977, and it was visible on the 1957
aerial photograph in the Town records and submitted into the
file, and was therefore validly grandfathered as to siting. A
more recent survey plan done by Robert A. Emack, dated December
4, 2002 and updated December 1, 2005, a reduced copy of which is
attached hereto as Exhibit B, was submitted indicating the
current status of the lot. The Applicants proposed to construct
a second floor addition primarily over the front portion of the
dwelling within the required front yard setback area but within
the existing footprint and coming no closer to the front yard
lot line than the existing structure. The addition had been
approved by the Historic District Commission in Certificate of
Appropriateness No. 47,052.
4. Applicants represented that they were also seeking relief
by special permit in order to validate a reconfiguration of the
lot lines that was the result of a 1977 cross-conveyance of
equal parcels that contained about 143 square feet of area with
the immediate abutter to the east and approved by the Planning
Board as shown upon Exhibit A. The respective parcels were
combined with each lot with the result that the easterly side
yard setback intrusion of the dwelling was cured and the
westerly side yard setback intrusion of the dwelling upon the
abutting lot were cured. No new nonconformities were created and
no existing nonconformities were increased. Such reconfiguration
of lot lines were allowed by special permit under the Zoning By-
law. The abutter to the east received similar relief from this
Board in the Decision in BOA File No. 079-05.
5. Therefore, based upon the foregoing, the Board finds that
allowing the Applicants to construct the addition as proposed to
the dwelling within the required ten-foot front yard setback
area would be an increase in the nonconformity. However, said
increase would not be substantially more detrimental to the
neighborhood than the existing nonconforming structure,
especially as the addition would be conforming in all other
respects, sited no closer than the existing structure to the
front yard lot line and with work done within the existing
footprint. In addition, the Board finds that the 1977
reconfiguration of the lot lines did not create a situation that
was substantially more detrimental to the neighborhood than the
existing nonconformity as it did not create any new
nonconformity nor did it increase the existing nonconformity.
6. Accordingly, by a UNANIMOUS vote, the Board GRANTS the
requested SPECIAL PERMIT under Nantucket Zoning By-law Section
139-33A allowing the construction of a second floor addition to
the dwelling as proposed; and GRANTS a SPRECIAL PERMIT under
Section 139-33A(S) to validate the 1977 reconfiguration of the
lot lines based upon the following conditions:
1. The new addition shall not come any closer to the
front yard lot line than the existing structure and
there shall be no expansion of the structure within
the required ten-foot front yard setback area without
further relief from this Board;
2. The addition shall be done in substantial conformance
with the plans approved by the Historic District
Commission in the Certificate of Appropriateness No.
47,052, as may be amended from time to time; and
3. The air handling unit that was indicated on Exhibit B
to be sited within the required five-foot easterly
side yard area is required to be relocated to a
conforming location on t t.
