DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, November 18, 2005, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of SANKATY HEAD GOLF CLUB, c/o Reade,
Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 083-05:
2. The Applicant is seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law ~139-7.D(4) (employer dormitory) and
~139-33.A (alteration or expansion of a pre-existing
nonconforming structure or use), and to the extent necessary
MODIFICATION of the Special Permits and Variances granted in the
Decisions in Board of Appeals Files Nos. 020-03 (which modified
previous relief), 064-94 (which granted relief under ~139-7.D(4)
for an employer dormitory, and to the extent necessary under
~139-33.A for the further alteration and expansion of the
dormitory use); 061-89 (which allowed construction of a new
dormitory) and 022-83 (which granted original Variance relief for
the dormitory use, but since has been superseded by Special
Permi t relief). A separate Special Permit was granted in the
Decision in Board of Appeals File No. 066-97 to expand Fleming
Hall, another dormitory. The Applicant now seeks to construct a
new dormitory, with ground cover of about 3,989 square feet, to
house up to ten employees. All of the dormitories upon this site
are used in connection with the Sankaty Head Golf Club, a private
club, to house its own employees. All dimensional zoning
requirements would be met, and all of the required parking would
be provided on-site. The locus is situated at 100 SANKATY ROAD,
Assessor's Map 49, Parcel 2, is shown upon Land Court Plan 9548-C
as Lot 2A, and is situated within as Limited Use General-3 zoning
district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable stating that provision of staff
housing was to be supported. There was no opposition presented
at the public hearing. An attorney, present for a separate case,
stated that he was a member of the Club and anything that could
be done to accommodate staff housing was a benefit.

4. Applicant, through counsel, represented that Sankaty
Head Golf Club has over the years expanded its dormitory housing
upon the site where its clubhouse and a large portion of its golf
facilities are located, to house its employees (including kitchen
staff and other workers at the clubhouse, as well as golf staff).
At the public hearing, the representatives of the Club explained
that changing circumstances require that employees be provided
wi th more living space wi thin their dormitory housing. As an
example, increasing availability of women as golf professionals
requires different living arrangements from the former condition
in which virtually all of the golf staff were male. In
responding to these changing needs, the Club determined that the
construction of a new dormitory space, designed for up to ten
employees, would be advisable. As indicated by the long history
of applications before the Board of Appeals, the Club has a
tradition of making adequate provision for the housing of its
seasonal employees. The presence of the clubhouse and Club
management in close proximity to the dormitory facilities makes
adequate provision for management of activities within the
dormitories. The new dormitory would meet all zoning requirements
and all parking would be provided on site.
5. Accordingly, by UNANIMOUS vote, the Board of Appeals
made the finding that the proposed new dormitory would be in
harmony with the general purpose and intent of the Zoning By-law,
and that none of the conditions of the existing relief affecting
the employer dormitories upon the locus would be substantially
affected by the proposed new dormitory. The Board also finds that
the new dormitory would not be substantially more detrimental to
the neighborhood that the existing nonconformities. Therefore, by
the same UNANIMOUS vote, the Board of Appeals GRANTED the
requested relief by SPECIAL PERMIT under Nantucket Zoning By-law
~139-7.D(4), and MODIFICATION of each of the existing Board of
Appeals Decisions, to allow construction and use the new employer
dormitory as proposed, subject to the following conditions:
a. The structure shall be constructed in substantial
conformity with the plans as approved by the
Nantucket Historic District Commission in
Certificate of Appropriateness No. 47,085, as may
be amended from time to time; and
b. The siting of the dormitory shall be done in
substantial conformity with the "Site Plan", done
by Charles W. Hart and Associates, Inc., dated
October 4, 2005, are reduced copy of which is
attached hereto as Exhibit A.
