BOUSA AND MAUREEN F. BOUSA AS TRUSTEES OF ARLINGTON ROAD REALTY TRUST, 11 Arlington Road, Wellesley, MA 02481, Board of Appeals File No. 071-05, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-33A (alteration/expansion of a pre-existing, non-conforming use/structure). Applicants propose to alter the use of an existing two-bay garage structure, said to have been built in 1975 when the side yard setback requirement was three feet, by converting the second floor space to a fitness studio with bathroom and shower. The work would include exterior changes on the north, west and south to the windows and doors, with the east wall of the structure that is sited within the required ten-foot easterly side yard setback area remaining unchanged. A conforming second floor dormer would be constructed on the westerly side of the structure outside of the required setback area and within the existing footprint of the structure. The first floor garage use would remain and there would be no change in the height of the ridge. There would be no human habitation of the structure. The lot also contains a primary single-family dwelling and an under construction rear secondary dwelling that is conforming in all respects. The lot itself is conforming in all respects as to dimensional zoning requirements, including ground cover. However, the primary dwelling is nonconforming as to front yard setback with the structure being sited as close as about 26.7 feet from the front yard lot line along Cliff Road, with a minimum of 30 feet required; and with the garage being sited as close as about 3.8 feet from the easterly side yard lot line in a district that requires a minimum side yard setback of ten feet. The Premises is located at 102 CLIFF ROAD, Assessor's Map 41, Parcel 13, no plan on record, Deed Ref. 853/161. The property is zoned Residential-2. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation finding that the matter did not present any issues of planning concern. There were no letters on file. 3. The Applicants, through counsel, represented that the Locus was dimensionally conforming in all respects except for the fact that the garage, the subject of this Application, was sited as close as about 3.8 feet from the easterly side yard lot line and the primary dwelling was sited as close as about 26.7 feet from the front yard lot line. The Applicants propose to alter the use of the second floor of the garage and convert from storage to use as a fitness studio with bathroom and shower facilities. All parking would continue to be provided on site. 4. The Applicants represented that the garage was originally sited in its current location in approximately 1975 when the side yard setback requirement was a minimum of there feet. A garage is clearly shown on a 1957 aerial in the Town records. The garage was demolished and the new garage constructed in substantially the same location, with the current required five-foot side yard setback area. The structure therefore was in conformance with the applicable zoning requirements when it was originally constructed and was validly grandfathered. A conforming dormer would be constructed on the westerly side of the garage within the existing footprint but outside of the setback area. The proposed alterations, which also included fenestration changes and a covered entryway outside ofthe required setback area, were approved by the Nantucket Historic District Commission in their Certificate of Appropriateness No. 46,210. 5. Members of the Board raised concerns about the inclusion of the shower facilities within the proposed fitness studio because of experience where studios have been converted to use for human habitation. Applicants represented that studio would not be used for human habitation and agreed that the shower use would only be ancillary to the use of the fitness studio. Applicants also stated that there was a conforming secondary dwelling being constructed to the rear of the property that did not require any zoning relief. Such construction would preclude the conversion of the garage to a separate dwelling unit. 6. Based upon the foregoing, the Board finds that the Zoning By-Law requires that changes to ancillary structures located within a required setback area are not afforded the same protection as dwelling units and Special Permit relief is necessary for a change of use or expansion of such structures. The Board further finds that a grant of the Special Permit relief requested to allow the alteration of the structure as to use, removing the storage use and converting the second floor of the structure to a fitness studio with bathroom and shower facilities, and expanding the structure by construction of a conforming dormer as proposed, would not be substantially more detrimental to the neighborhood than the existing use and nonconforming structure. 7. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A, to allow the alterations and conversion of use as proposed, based upon the following conditions: a. The project shall be done in substantial conformance with the designer's site plan, done by Thomas Beard Architecture, dated June 15, 2005, a reduced copy of which is attached hereto as Exhibit A; based upon the site plan information taken from a "Site Plan" done by Charles W. Hart & Associates, Inc., dated September 14, 2005, a reduced copy of which is attached hereto and marked as Exhibit B; b. The alterations/expansion of the garage structure shall be completed in substantial conformance with the Certificate of Appropriateness No. 46,210 approved by the Nantucket Historic District Commission, as may be amended from time to time; (ZBA 071-05) c. There is to be no human habitation of the garage; d. The sanitary facilities in the studio shall be limitedI~ shower, toilet and sink, specifically no bathing tub, and may only be used as ancillary to the use of the fitness studio and for no other reason. e.
