At a Public Hearing of the Nantucket Board of Appeals held at 1:00 p.m., Friday,
August 12,2005, in the Conference Room of the Town of Nantucket Annex Building, 37
Washington Street, Nantucket, Massachusetts, on the Application of SCOTT A. WITT
and DIANE O. WITT, of 8 Seikinnow Place, Nantucket, MA 02554. (Board of Appeals
File No. 060-05) the Board made the following Decision:
1. Applicants are seeking relief by VARIANCE under Nantucket Zoning By-
Law Section 139-24 (rate of development). Applicants constructed a single-family
dwelling under duly issued Building Permit No. 15730-97 in December, 1997. The
Applicants had executed a residency Covenant running with the land in favor of the
Town of Nantucket in order to construct the house. Applicants obtained the Certificate of
Occupancy on December 30, 2004, seven years after the date of construction, with the
By-Law stating that the Covenant is to run for a five-year period from the date that a
Certificate of Occupancy is issued. Applicants proceeded to live in the house for the past
seven years on a year-round basis. Applicants are seeking relief from the Covenant in its
entirety. The Lot is conforming in all respects as to the dimensional requirements of the
Zoning By-law. The Premises is located at 8 SEIKINNOW PLACE, Assessor's Map
67, Parcel 535, Plan File 50-J, Lot 16. The property is zoned Residential-2.
2. This Decision is based upon the Application and materials submitted with
it, along with the testimony and evidence presented at the hearing. The Planning Board
did not make a recommendation as the matter did not present any issues of planning
concern. There was no opposition to this Application presented at the hearing or on file.
3. Applicants, through counsel, represented that they were planning to put
their house on the market, and have been advised that it would be very difficult to sell
with the Covenant in place as any new buyer would have to assume the remainder of the
Covenant and commit to living in it on a year-round basis. Applicants had entered into
the residency Covenant agreement in good faith without the intent of violating the
conditions of the grant of the building permit. The Applicants have not experienced a
change in personal circumstances and are moving off-Island to return to Ohio where their
elderly parents reside, and need their assistance. Applicants state that they have met the
intent and spirit of the By-law requirements by residing in their home on a year-round
basis for almost seven years. Applicants represented that they had difficulty obtaining a
Certificate of Occupancy in a timely fashion for a few reasons, one of which related to
the problems with the plumber who did all the work on their home and then moved off-
island shortly after the home was completed, but prior to final sign-off on the work. It

was difficult obtaining the services of a new plumber who was willing to certify another
tradesman's work. The wiring sign-off only occurred in 2000 as well.
4. Therefore, based upon the foregoing, the Board finds that the proposal to
give Applicants relief from the Covenant would be in harmony with the general purpose
and intent of the Zoning By-Law, and would not be substantially more detrimental to the
neighborhood. Further, the Applicants had met the spirit and intent of the Covenant
conditions by living in the house on a year-round basis for about seven years,
notwithstanding the fact that there was no Certificate of Occupancy issued. In addition, in
past such cases presented before the Board, for which relief has been granted, there has
been substantial testimony about the impact of trying to sell a house with an existing
Covenant in place. In conclusion, the Board also finds that a literal enforcement of the
provisions of the Zoning By-law would involve substantial financial hardship to the
Applicants, and that desirable relief by variance may be granted without substantial
detriment to the public good and without nullifying or substantially derogating from the
intent or purpose of the By-law.
5. Accordingly, by a vote of four in favor (Waine, O'Mara, Sevrens, Toole)
and one opposed (Loftin), the Board hereby GRANTS the requested relief by
VARIANCE under Nantucket Zoning By-law Section 1 -24 (Rate of Development).
