Applicant (Sweetwater RT) is seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-33A (alteration/expansion of a pre-existing
nonconforming structure/use). Applicant proposes to demolish or remove a cottage from
the Premises and replace the cottage with a new conforming dwelling, recognizing that
the Premises has already been converted to a condominium based upon the existence of
the two existing pre-1972 dwellings. The existing structures currently comply with all
dimensional zoning requirements. The Lot is nonconforming as to frontage, having about
20 feet of frontage on a "way" in a district that requires a minimum frontage of 100 feet.
The lot is conforming in all other respects to the zoning requirements.
The Premises is located at 73 SQUAM ROAD, Assessor's Map 13, Parcelll,
Land Court Plan 14902-J, Lot 6, Unit 2 ofSquam Head Condominium, Plan File 4-06.

ADDENDUM TO APPLICATION
Anthony G. Perry, Trustee of Sweetwater Realty Trust

Applicant is seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning
By-law Section 139-33A (4) (alteration of a pre-existing, nonconforming structure/use)
to allow the demolition or removal of the pre-1972 cottage on the Premises and
replacement of the cottage with a new dwelling, recognizing the Premises has been
converted to a condominium based upon the existence of two pre-1972 dwellings.
The master deed and by-laws that created and govern the condominium
contemplate the removal and replacement of the cottage on Unit 2; the condominium
by-laws impose restrictions on the size of the new dwelling on Unit 2 that are more
restrictive than the maximum ground cover and height requirements of the Nantucket
Zoning By-law.
The Premises is located in the LUG-l zoning district. The lot is pre-existing,
nonconforming as to frontage, having 20 feet of frontage at the end of a way, and
complies with all other dimensional requirements of the Nantucket Zoning By-law. The
existing structures on the Premises comply with all dimensional and use requirements
of the Nantucket Zoning By-law. The proposed new structure on the Premises will
comply with all dimensional requirements of the By-law.
Attached is the letter of permission to file from Kevin F. Dale, as attorney for the
owners of Units 1 and 2 of the Squam Head Condominium.

The Board of Managers shall also obtain and maintain, to, the extent available, master
policies of insurance with respect to the common areas and facilities for the benefit and
protection of the Unit Owners, for (a) comprehensive public liability, (b) workmen's
compensation and employee liability with respect to any manager, agent or employee of the
Condominium Association, but excluding any independent agent or manager, and (c) such other
risks as the :Board of Managers shall in their discretion deem appropriate.
The cost of all such insurance obtained and maintained pursuant to provisions of this
Article shall be a common expense as referred to in Article IV.
Rules and Regulations
Section 5.24. The Board of Managers may adopt and amend from time to time, Rules
and Regulations governing the details of the operation and use of the common areas and facilities
of the Condominium. Said Rules and Regulations, and any amendments thereto, shall be
adopted at either an Annual Meeting or a Special Meeting by a majority vote of the Board of
Managers.

AND HEIGHT LIMITATIONS
Section 5.25. Statement of Purpose. Thomas W. Hall, Jr. and Helen Marshall Hall
Brown, as third generation owners of the improved real estate upon which the Condominium is
located (hereinafter the "Land"), wish to preserve and maintain the rural setting unique to this
area of the Island of Nantucket. It is, therefore, the purpose of this Article to identify agreements
between future owners and ensure that development and conduct of activity on the Land will:
A. Preserve the natural and scenic features of the Land and its environment
for the benefit of present and future Owners;

B. Preserve the integrity of the quality and design of architectural
improvements of the Land that maintain a harmony with one another and with the surroundings;
C. Provide for the privacy, tranquility, and enjoyment of each home on the
Land.
Section 5.26. Restrictions and Covenants. The Land shall be subject to the following
deed restri<;tions, covenants and easements:
A. Architectural Restrictions. The following restrictions upon all
improvements on the Land are hereby imposed:

1. Plans: Specifications. Before any construction, improvement, addition,
change, or alteration to either Unit 1 or Unit 2, or any landscaping on the Land -shall be
commenced, three (3) full sets of plans and specifications (on a scale of 1'4 inch equals one (1)
foot) and .a plot plan of the Land in question shall be submitted to the Board of Managers. Such
plans and specifications shall show the front, rear, and all side exterior elevations, floor ,plans,
profiles and materials, including, but not limited to, the color, texture and materials for the roof,
exteri,or walls, trim, windows, and doors of each building or addition or exterior alteration. The
plot plan shall- show the building location and set back from the property lines, dimensions of the
proposed structure, improvement, addition, change, alteration, or landscaping and all other
structures upon the Land, the location of water supply, sewage facilities, driveway, storm water
drainage ~ystem, intended landscaping, screening, and land area. Any additional information
requested by the Board of Managers shall be promptly furnished by the Owner of the Unit in
question. In addition to the foregoing, the Ovmer(s) shall submit to the Board of Managers for
purposes of written approval, three (3) copies of all applications and plans prior to submission to
the Nantucket Historic District Commission ("HDC"). No changes in design from the plans

submitted to the Board of Managers shall be permitted without the prior written consent of the
Board of Managers, notwithstanding any decision of the HDC. The Board of Managers shall
review all proposed structures, recreational facilities, outdoor mechanical installations,
landscaping plans, driveways and other exterior improvements, including expansion or
renovation affecting the exterior of existing structures. No improvement shall be placed upon
the Land until the design, size, plans, specification, location and landscaping treatment thereof
shall have been approved in writing or this restriction waived in writing by the Board of
Managers. In its review, the Board of Managers shall require observance of the design standards
provided below and shall respond to any submission within fourteen (14) days of receipt of said
submission.
2. Standards for Review. In determining whether or not to approve an
application hereunder, the Board of Managers shall consider the provisions of this Declaration
and of the purposes set forth herein, particularly as to the harmony of exterior design and
location of a proposed structure in relation to the Unit which is the subject of the application and
the surrounding Unit. Emphasis is to be placed upon the preservation of the Land and its natural
environment to the greatest extent possible, with specific regard to the height of the proposed
improvements. Approval of a plan may be withheld by the Board of Managers on any basis,
including purely aesthetic reasons. The following design standards shall be observed:
a. Exterior Materials. All exterior walls shall be constructed of white
cedar or Alaskan yellow cedar shingles and shall be the natural color.
Roofing may be either Architectural asphalt shingles or Alaskan
yellow or red cedar shingles.
b. Trim and Sash. All exterior trim and window sashes shall be stained
or painted a color approved by the HDe.

c. Height Restrictions. Unless otherwise set forth herein, structures upon
the Land shall be limited to a maximum roof ridge height of twenty
eight (28) feet, measured from the foot of the foundation.
3. Certificate of Approval. The Board 'of Managers, upon request, shall
furnish a certificate of approval, in recordable form, relating to any application approved by it (or
deemed hereby to have been so approved) and shall also furnish a Certificate of Approval
relating to. any completed improvements which are built in conformity with the application for
their approval.
4. Conformity with Plans and Guidelines. All construction upon the Land
must be performed in conformity with the approval of the Board of Managers and the plans
submitted in connection therewith, both as to design and location.
B. Restrictions Upon Use. The following restrictions upon uses of Units 1
an<,l 2 are hereby imposed:
1. Unit 1. Unit 1, as identified on the Site Plan and the Floor Plan of Sq1,lam
Head Condominium, dated October 8, 2003 and drawn by Boucher & Heureux, Inc., is limited to
one (l) single family residence. No additions, alterations or changes in the design or
construction to Unit 1 shall be permitted wi~o":lt the written approval and consent of the Owner
of Unit 2.
2. Unit 2. Any new construction, alteration or change in the design of Unit
2, is limited to ground cover of 1600 square feet. Any new construction on Unit 2 shall be
limited to residential use only with no more than four (4) bedrooms being permitted in Unit 2.
Any new construction on Unit 2 shall have a roof ridge height limit of twenty-eight (28) feet,
with north elevation (toward Unit 1) being limited to a.roofridge height of twenty-two (22) feet.

9. No Electric Bug-Zappers. No electric bug zappers shall be allowed on or
in Units 1 or 2.
