FAX 508-228':7205 NOTICE A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00 P.M., FRIDAY, JUNE 10, 2005, IN THE CONFERENCE ROOM, TOWN ANNEX BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the Application of the following: WARREN MANNING, FOR HIMSELF AS OWNER, AND FOR SOUTHERN REALTY TRUST, CATHRINE CONTE, TRUSTEE BOARD OF APPEALS FILE NO. 043-05 Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-33A (alteration/expansion ofthe pre-existing nonconforming structure/use) and under Section 139-18 (parking requirements), Section 139-19 (Loading zone requirements), and Section 139-17C(4) (Height restrictions). Applicant (Southern Realty Trust) proposes to combine two nonconforming adjacent lots into one conforming lot; demolish or remove the two nonconforming structures on 17A Washington Street (one containing four dwelling units and one containing one dwelling unit), and demolish or remove the nonconforming single-family dwelling on 17 Washington Street. Applicant proposes to then construct one new conforming structure that would contain four separate dwelling units and a maximum of about 1900 square feet of commercial space for office or retail on the first floor. The proposed structure would exceed 30 feet in height, but would not be more than the allowable (by special permit) in the RCDT of 34 feet at its highest point. The proposed uses would have a parking requirement of 15 spaces. As combined, the new Lot and structure would be conforming in all respects to the dimensional requirements of the Zoning By-law. DECISION DUE BY:_I_I_ Made:_'_'_ Filed wrrown Clerk:_'_'_ Mailed:_'_'_ Addendum A The Applicant seeks a Special Permit to construct a new building on Lots 3 and 4 on Plan Book 16, page 26, at the Nantucket Registry, which combined parcel consists of approximately 5,613 square feet of area with approximately 50 feet of frontage on Washington Street. The property is zoned RCDT, which has a minimum lot size of 3,750 square feet with 35 feet of frontage. Currently the property consists of two undersized lots with inadequate frontage, which will, as a result of this project, be merged into a single lot conforming as to frontage and area. At this time, the combined lots contain 6 dwelling units - 5 are situated on Lot 4 and one on Lot 3. The proposed new structure will contain 4 dwelling units and less than 1900 square feet of first floor commercial space for office or retail use. The existing buildings do not comply with the rear yard set-back; the proposed structure will comply with setback and ground cover requirements. The proposed structure will exceed 30 feet in height, but will not be more than thirty-four feet high at its highest point. There is currently one parking space on the property, where 6 spaces would be required for the existing uses. The proposed uses would require a total of 15 parking spaces - 4 spaces for the dwelling units, 9 spaces for the commercial space based on the square footage, and 2 spaces for a maximum of 7 employees in the commercial space on a peak shift.
