NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, JUNE 10, 2005, IN THE CONFERENCE ROOM,
TOWN ANNEX BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application of the following:
ROBERT F. AND KELLY L. PATERSON
BOARD OF APPEALS FILE NO. 041-05
Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A (alteration/expansion of the pre-existing nonconforming
structure/use). Applicants propose to demolish their existing single-family dwelling,
constructed in 1972, and relocate an existing single-family dwelling from a lot
immediately adjacent to the Applicants' lot to the east. Applicants' current home is
nonconforming as to setback with the structure being sited as close as about 4.1 feet from
the northwesterly side yard lot line in a district that requires a minimum side and rear
yard setback of five feet. Said setback nonconformity would be eliminated with the
demolition ofthe structure. However, as the new house has a larger footprint than the
existing structure, a small comer of the new house would be sited as close as about 2.8
feet from the southeasterly side yard lot line, with a majority of the structure outside the
setback area, and would be conforming as to all other setback requirements. There is an
existing shed on the property that is also sited as close as about 1.8 feet from the
southeasterly side yard lot line. In the alternative, the Applicants are asking for relief by
VARIAN CE under Section 139-16A to allow the placement of the structure on the Lot.
Ground cover would be increased from about 29% to about 39.4%, below the maximum
of 50% allowed for this conforming (as to size) about 6,511 square-foot lot. All parking
would continue to be provided on site. In addition, the Lot is nonconforming as to
frontage with the Lot having no frontage and accessed by a permanent easement from
Union Street.
The Premises is located at 70 UNION STREET, Assessor's Map 55.1.4, Parcel
69, Plan 331, Page 115, Lot 2. The property is zoned Residential-Commercial.
