NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, MAY 13, 2005, IN THE CONFERENCE ROOM,
TOWN ANNEX BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application of the following:

Applicant is seeking relief by VARIANCE under Nantucket Zoning By-law
Section 139-16A (Intensity regulations - ground cover, setbacks), in order to validate the
siting and construction of the single-family dwelling constructed upon the Locus in 1988.
A Certificate of Occupancy has been issued, and altered pursuant to a building permit
issued in 2004. A deck on the northwesterly side of the structure is sited as close as about
0.2 feet from the side yard lot line along Sherburne Turnpike in a district that requires a
minimum side yard setback of five feet and a porch on the southerly side of the structure
is sited as close as about 7.0 feet from the front yard lot line along Hamblin Road in a
district that requires a minimum front yard setback of ten feet. The existing ground cover
is about 1,760 square feet for a ground cover ratio of about 32.8%, in a district that allows
a maximum ground cover of about 1,607 for a ground cover ratio of 30%. An 2004
addition to expand the kitchen on the northeasterly side of the structure put the ground
cover over the maximum allowed. Additions to the existing front and rear decks were
made at the same time. The Locus is conforming as to lot size and frontage. The
Applicant is also seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-l8B (parking requirements), waiving the requirement to provide a
conforming parking space on-site; the existing parking area is partially situated within an
otherwise unconstructed portion of Hamblin Road.
The Premises is located at 12 ~ SHERBURNE TURNPIKE, Assessor's Map
30, Parcel 174.1, Land Court Plan 141 Ol-B, Lot 1. The property is zoned Residential-I.

The applicant requests a Variance from the provisions of Nantucket Zoning By-law
~139-16.A (Intensity Regulations) in order to validate the siting and construction
of the single-family dwelling constructed upon the locus in 1988, for which a
certificate of Occupancy has been issued, and which was altered pursuant to a
building permit issued in 2004. The dwelling is nonconforming as to front yard
setback, having setback of about 7.0 feet from Hamblin Road, with minimum front
yard setback in the Residential-1 zoning district being 10 feet; as to
northwesterly rear/side yard setback, being about 0.2 feet from the lot line, with
minimum setback being 5 feet; and as to ground cover ratio, having ground cover of
1,760 square feet, for a ground cover ratio of about 32.8%, with the maximum in
this district being 30%. The applicant further requests a Special Permit under
Nantucket Zoning By-law ~139-18.B, waiving the requirement to provide a conforming
on-site parking space; the existing parking area serving the dwelling is situated
within an otherwise unconstructed portion of Hamblin Road.
