At a Public Hearing on the NANTUCKET ZONING BOARD OF APPEALS held at 1 :00
p.m. on Friday, April 8, 2005, in the Conference Room, Town Building Annex, 37 Washington
Street, Nantucket, Massachusetts on the Application of DOUGLAS C. GRIP and KAREN E.
GRIP of 39 Arrowhead Trail, New Canaan, Connecticut, 06840, Board of Appeals File No. 026-
05, the BOARD made the following DECISION:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
Law Section 139-33A(8). Applicants propose to increase the size of their lot about 62,217 square
feet, shown as 74 Pocomo Road and containing a single-family dwelling, by acquiring an
abutting parcel of vacant land that has an area of about 43,560 square feet, shown as a portion of
82 Pocomo Road. The aggregate area of both parcels would be about 105,777 square feet. The
LUG-3 zoning district requires a minimum lot size of 120,000 square feet. No new
nonconformities are said to result from the merger and the lot would be conforming in all other
respects to the Zoning By-law.
The Premises are located at 74 POCOMO ROAD and 82 POCOMO ROAD,
Assessor's Map 15, Parcels 34, 25 and 36, Land Court Plan No. 16220-L, Lot 38 and Land Court
Plan No. 22667-4, Lot 105. The property is zoned Limited Use General-3.
2. The Decision is based upon the Application and materials submitted with it, and
the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation, as there were no issues of planning concern. There was no opposition to the
Application at the Hearing and no letters on file. An abutter, represented by counsel at the
hearing, expressed support for the Application.
3. Applicants, through counsel, represented that they owned the improved real estate
at 74 Pocomo Road. Applicants' real estate was a pre-existing, nonconforming lot-of-record that
had an area of approximately 62,217 square feet. The lot was located in the Limited-Use-
General-3 zoning district, with a minimum lot size requirement of 120,000 square feet.
Applicants proposed to acquire an abutting parcel of vacant land that was currently part of a
larger conforming parcel located at 82 Pocomo Road, from the 82 Pocomo Nominee Trust. This
abutting parcel of land had an area of approximately 43,560 square feet. The reconfigured lot,
when the two parcels were merged, would have an area of approximately 105,777 square feet,
which would be less nonconforming than the existing lot. The remaining lot at 82 Pocomo Road
would remain conforming in every respect as to zoning requirements. Applicants stated that the
"merger" of both parcels of land would create no new zoning nonconformities. In fact, the
combination of the two parcels would create a single lot that would be more conforming as to lot
size and frontage.

5. Therefore, based upon the foregoing, the Board finds that the merger of both
parcels as proposed would not be substantially more detrimental to the neighborhood than the
existing nonconforming lot at 74 Pocomo Road, and that no new nonconformities would be
created nor existing ones increased. The Board also finds that the lot area and frontage
nonconformities would be reduced providing a benefit to the neighborhood
4. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested
SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A(8) in order to allow the
merger of the two parcels as proposed, located at 74 Pocomo Road and a portion of 82 Pocomo
Road, into one building lot with an area of approximately 105,777 square feet, based upon the
following conditions:
a. The merger shall be done substantially as shown on the "Lot Merger Plan"
as reconfigured by the Applicant, originally marked "Plan of Land", done
by Charles W. Hart, dated November 17,2004, a reduced copy of which is
attached hereto as Exhibit A; and
b. The two parcels shall be merged for zoning purposes.

ADDENDUM "A"
Applicants Douglas C. Grip and Karen E. Grip ("Grip") own the improved real estate
located at 74 Pocomo Road, Nantucket, Massachusetts, 02554 ("Grip Lot"). The Grip Lot is a
pre-existing non-conforming lot of record with an area of 62,217i:.. square feet. The Grip Lot is
located in the Limited Use General-3 ("LUG-3") Zoning District. The maximum lot size in the
LUG-3 Zoning District is 120,000 square feet.
Grip wishes to acquire an abutting parcel of vacant land from Eighty Two Pocomo
Nominee Trust ("Trust Land"). The Trust Land has an area of 43,560i:.. square feet. The
aggregate area of the Grip Lot and the Trust Land is 105,777i:.. square feet, less than the 120,00
square foot minimum for lots in the LUG-3 Zoning District.
Grip asks the Board of Appeals to grant them a Special Permit pursuant to Section 139-
33A(8) of the By-Law to permit the combination ofthe Grip Lot and the Trust Land into a single
lot with an area of 105,777i:.. square feet. This increase in lot area will not be substantially more
detrimental to the neighborhood than the existing lot non-conformity because the new Grip Lot
will be more conforming in area. Further, this increase in lot area will not create any new zoning
non-conformity nor increase any existing zoning non-conformity.
