ZONING BOARD OF APPEALS 1 EAST CHESTNUT STREET NANTUCKET, MASSACHUSETTS 02554 Assessor's Map 11, Parcel 17 Assessor's Map 12, Parcels 46 and 47 Residential-l 115 and 120 Wauwinet Road Certificate of Title No. 12,553 Lot B on Land Court Plan No. 15598 -A Lot 32 on Land Court Plan No. 15961-D Lot 56 on Land Court Plan No. 15961-K DECISION: The Board of Appeals at a Public Hearing held on Friday, February 11, 2005, at 1:00 p.m. in the Town and County Building at 37 Washington Street, Nantucket, Massachusetts, made the following Decision on the application (013-05) of W A UWINET INN, LLC, of 115 and 120 Wauwinet Road, Nantucket, Massachusetts 02554. 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A (alteration/ expansion of the pre-existing nonconforming structure/use), and to the extent necessary, MODIFICATION of previous relief listed below. Applicant proposes to alter and extend the cottage known as" Anchorage" on the property that is operated as the W auwinet Inn. The property has been established to be grand fathered as to use, among other aspects, in previous decisions rendered by this Board. Applicant proposes to remove the "Maintenance Shed", "Shed" and "Walk- In Cooler", as shown on a plan in 1998 and consolidate the uses into a single building that would be attached to the rear of Anchorage. The footprint utilized for these ancillary functions would not be increased, although the renovation would increase the ground cover by less than about 150 square feet. The walk-in cooler would be relocated to the existing deck on the north side of the building. See also the Decisions in BOA File Nos. 095-86,012-87, 54-88, 026-95 and 048-98. The premises is located at 115 and 120 WAUWINET ROAD, Assessor's Map 11, Parcel 17, Map 12, Parcels 46 and 47; Land Court Plan No. 15598-A, Lot B; Land Court Plan No. 15961-D, Lot 32; and Land Court Plan No. 15961-K, Lot 56. The property is zoned Residential-I. 2. The Board's decision is based upon the application and materials submitted with it, photographs and plans, and representations and testimony received at the hearing. One abutter was represented by counsel at the hearing and expressed concern about noise from the relocated cooler unit. The Planning Board made no recommendation, finding that the requested relief did not involve planning issues. 3. Applicant, through counsel, represented that the Premises, known as "The Wauwinet", was used as a hotel, with ancillary rental cottages, and with all of the customary ancillary activities and uses of a resort. The Applicant's commercial use of the Premises in the Residential-l zone was a pre-existing non-conforming use, continuous since a time prior to 1972 as had been established previously. The lot and structures on the Premises conformed to all of the dimensional requirements of the Residential-l zoning district. The Applicant represented that it had to date not met or exceeded any of the Major Commercial Development thresholds set forth in section 139-11(B) of the Nantucket Zoning By-law, nor would the small increase in ground cover meet or exceed those thresholds as a result of this project. 4. Applicant represented that it proposed to clean up an area behind the building known as " Anchorage" by consolidating the two existing sheds into a single structure that would be attached to the easterly rear of Anchorage and relocating the walk-in cooler onto the deck area to the north of the existing sheds. The uses of the new building would be the same as the existing uses of the sheds - maintenance activity and storage associated with the hotel and restaurant facilities. At the hearing, concern was expressed regarding increased noise being generated by the cooler if it is no longer buffered by its current location between the sheds. The Applicant assured the Board that the cooler's immediate proximity to the bedroom windows in Anchorage created a great incentive to the Applicant to make the unit as quiet as possible since the Applicant's guests would be more affected than any neighbor. However, the Board felt that only the enclosing of the cooler within an extension of the proposed building or by enclosing of the deck space would satisfactorily address the noise issue. The Applicant therefore offered to extend the new building to the area now occupied by the deck. The result would be an increase in ground cover of about 314 square feet over the total ground cover of the existing three structures, i.e. maintenance shed of a about 292 square feet, shed of about 120 square feet and cooler of about 84 square feet for a total of about 810 square feet for the new addition. Applicant represented that the removal of the sheds and construction of a new conforming addition would be a benefit to the neighborhood by removing such structures. 5. Therefore, the Board finds that the alterations/ expansion of the existing sheds into a consolidated new addition to Anchorage and the enclosing of the cooler without any change in the use of this area for ancillary hotel and restaurant support, consisting primarily of maintenance activities and storage, would not be substantially more detrimental to the neighborhood than the existing uses and would improve an existing situation. The Board also finds that modification of the previous decisions, specifically in File No. 048-98, would not be substantially more detrimental. This Board in said decision approved the existing sheds, and it shall be so modified as to be consistent with this decision and the plan attached hereto as Exhibit A. 6. Accordingly, by a UNANIMOUS vote, the Board hereby GRANTS the requested SPECIAL PERMIT relief pursuant to Section 139-33A and, to the extent necessary, a MODIFICATION of prior decisions of this Board, to permit the renovation or reconstruction of the existing sheds and conversion into a single structure attached to the easterly side of Anchorage, having the footprint shown on the attached plan. The relief is hereby conditioned upon the following: a. Any walk-in cooler associated with this storage area shall be fully enclosed within the new building; and b. The siting of the addition shall be substantially as shown upon the "Plot Plan to accompany Board of Appeals Application", dated February 15, 2005, done by Blackwell and Associates, Inc., a reduced copy of which is attached hereto as Exhibit A. 7. In separate action, the Board, by a UNANIMOUS vote, waives the site plan review that is required under Nan cket Zoning By- a Section 139-23.
