Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A (alteration/expansion of the pre-existing nonconforming
structure/use). Applicant proposes to alter and extend a said to be pre-existing
nonconforming dormitory use by increasing the current number housed on the Lot from
12 employees by constructing a separate structure that would have an additional
occupancy of up to 18 employees. Accordingly, there would be up to 30 employees of the
Applicant residing on site at any given time. In the alternative, a SPECIAL PERMIT
under the Neighborhood Employee Housing Overlay District regulations is sought under
Section 139-12C for the proposed use. The Lot is conforming as to all dimensional
requirements of the Zoning By-law and the new construction would also comply.
However, the existing structure is noncomplying as to side yard setback with the structure
being sited as close as about 7.9 feet from the northerly side yard lot line in a district that
requires a minimum side yard setback often feet. There would be no change to that
setback. The required on site parking spaces would be provided.
The Premises is located at 25 ROBERTS LANE, Assessor's Map 56, Parcel 98,
Land Court Plan 37610-B, Lot 2. The property is zoned Residential-2.

Zoning Board of Appeals Application for
Nantucket Island Resorts LLC
25 Roberts Lane
The Applicant seeks relief under Section 139-33A to alter and extend the validly
pre-existing non-conforming use of the property at 25 Roberts Lane for
dormitory purposes. The existing building on the property currently provides
housing to 12 of the Applicant's employees. The Applicant proposes to construct
an additional building on the site, substantially as shown on the attached site
plan, which new building will have and 18 person capacity. Accordingly a total
of 30 employees would be housed in the two structures. The lot complies with
current dimensional requirements as would the new construction. The existing
building's footprint, which does not comply with current side yard setback
requirements being 7.9 feet from Roberts Lane instead of the 10 feet required,
would not change. As shown on the attached site plan, a parking area would be
constructed on the site to provide the required number of parking spaces.
Alternatively, a special permit under the Neighborhood Employee Housing
Overlay District regulations (Section 139-12C) for the proposed use is requested.
