DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Friday,
April 8, 2005, originally noticed for February 11,2005 and continued without opening,
at 1 :00 P.M., in the Town Annex Building, 37 Washington Street, Nantucket,
Massachusetts, the Board made the following Decision on the Application of ALEX
FAMILY NOMINEE TRUST, EDWARD J. ALEX, SR. AND SUSAN C. ALEX,
TRUSTEES, OWNERS OF UNIT B-7 OF THE MASSASOIT VILLAGE
CONDOMINIUM-I, 32 South Cambridge Street, Nantucket, Massachusetts 02554, File
No. 009-05:
2. Applicants (Alex) are seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-33A (alteration/expansion of the pre-existing
nonconforming structure/use). Applicants are asking the Board to validate a conforming
one-story about 332 square-foot rear addition that was constructed in 2004 onto the
easterly side of their single-family dwelling, which is conforming in all respects to zoning
requirements except that it is one of seven separate dwelling units on one lot. In addition,
Applicants are asking for relief under the same section to construct a separate conforming
about 395 square-foot addition onto the northerly side of the structure. Both additions are
to increase interior living space. The ground cover ratio would be increased from about
4.31 % to about 4.79% in a district that allows up to 12.5% for this conforming about
150,504 square-foot lot. The Locus is nonconforming as to number of dwelling units on
one lot with the Lot containing seven dwelling units when a maximum of two are allowed
on one lot in this district; and as to frontage with one dwelling sited as close as about
24.68 feet to the lot line along South Cambridge Street in a district that requires a
minimum front yard setback of 30 feet.
The Premises is located at 32 SOUTH CAMBRIDGE, MADAKET,
Assessor's Map 59.3, Parcels 270.6 (part of270 and 41, and Map 59.4, Parcel 22), Land
Court Plan No. 3092-55-1, Lot 616A. The property is zoned Residential-2.
3. Our Decision is based upon the Application and accompanying materials,
and representation and testimony received at our public hearing. There was no Planning
Board recommendation, on the basis that no matter of planning concern was presented.
The owners of the other six condominium units submitted letters to the Applicant in the
spring of 2004 stating that they had no objection to the proposed construction of the now
constructed about 332 square-foot addition and new chimney and which were made part
of the record. The president of the Association was present at the public hearing and
stated that the other owners were in support of the grant of relief to validate the existing
addition and had entered into an agreement with the Applicants in which they would
submit the plans for the addition and chimney to their own architectural review board for
approval after the Board of Appeals hearing. A copy of the unsigned agreement was
submitted into the record. There was no further comment from the public and there were
no other letters in the file. There was no opposition presented at the public hearing.
4. Applicants represented that they had constructed a conforming addition
onto their single-family dwelling without realizing that special permit relief had to be
obtained prior to construction. The property contained seven separate single-family
dwellings, held in condominium ownership, with the Zoning By-law only allowing a
maximum of two on one lot in this zoning district. Any alterations had to be made after
the proper relief had been obtained from this Board. The Applicants represented that the
dwellings had been constructed in the 1960's, prior to the enactment of the Nantucket
Zoning By-law and were thus validly grandfathered. In 2004 the Applicants had
constructed an about 332 square-foot one-story addition onto the easterly rear portion of
their house to increase the interior living space. The ground cover ratio was increased
from about 4.31 % to about 4.53% in a district that allowed up to 12.5% for the
conforming, oversized about 150,504 square-foot lot. Applicants stated that they had
received Certificate of Appropriateness No. 43,813 (chimney) and 44,751 (addition)
from the Nantucket Historic District Commission for the new chimney and new addition,
respectively. Applicants stated that they had acted as their own general contractor and
had applied for a building permit themselves. Substantial time elapsed without the permit
having been issued and Applicants represented that their builder went ahead with
construction in anticipation ofthe issuance of the building permit and to finish the project
prior to the advancing cold weather. Applicants were subsequently informed that their
building permit request had been denied by the Zoning Enforcement Officer due to the
necessity of obtaining special permit relief for alterations or expansions of their house.
The Applicants then stopped work and made application to the Zoning Board of Appeals
to correct the situation. Applicants stated that they operated in good faith and the addition
had no impact upon the neighborhood or the property as a whole. Applicants withdrew
that portion of the request for relief that related to a separate proposed new addition.
5. Therefore, based upon the foregoing facts, the Board fmds that validating
the conforming addition on the single-family dwelling would not be substantially more
detrimental to the neighborhood than the existing nonconformity. There would be no
expansion of the use of the property as there are seven dwelling units on the Lot and that
would remain unchanged.
6. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A, to
validate the addition to the Applicants' single-family dwelling. Relief is hereby
conditioned upon the following:
(a) The addition shall be as substantially as shown upon the "Plot
Plan", done by John J. Shugrue, dated January 12,2005, a reduced
copy of which is attached hereto and marked as Exhibit A;
(b) Said work shall be performed in substantial conformance with the
Certificate of Appropriateness No. 43,813 (chimney) and 44,751
(addition) as may be amended from time to time; and

The maximum ground cover allowed for this structure shall be
about 1,723 square feet without further relief from this Board;

conforming about 150,504 square-foot lot. The Locus is nonconforming as to number of
dwelling units on one lot with the Lot containing seven dwelling units when a maximum
of two are allowed on one lot in this district; and as to frontage with one dwelling sited as
close as about 24.68 feet to the lot line along South Cambridge Street in a district that
requires a minimum front yard setback of30 feet.
Applicants constructed the first easterly side addition under approval from the HDC but
without any approval from the Board of Appeals as the owner thought that there was no
relief necessary with the addition being conforming and all other owners approving it at
the time. Mr. Alex acted as his own general contractor. The addition already built is
conforming in all respects and would have been allowed as a matter or right if there had
not been seven cottages on the lot that date from the 1960's and were built by Lindsey
Perry when the rest of Tristram's Landing was being built. Applicants also intend to
enlarge the structure further in the near future. All parking is provided on site and the
additions would be kept to one story with a maximum ridge height of 18 feet. The HDC
has approved the first addition. The other condo owners are aware of the project and have
agreed to it.

Linda - Hello - I hope you are doing well.
Ed Alex asked me to send you an email stating that we had a conference call in April 2004 regarding his planned
addition and fireplace to his house at 32 S. Cambridge Street. My husband Jamey and I were on the phone with
Ed in our house in Madaket, and Paul Keating was the other person on the phone from New Hampshire. Ed told
us about his plans and presented copies of emails from other owners expressing their support of the project. We
supported his plan conceptually and asked just to see the final drawn up plans when he had them in order to
provide some feedback if we had any. We discussed how the Town HOC, Zoning Board, etc. would certainly be
better resources for approving designs, etc. than we would be and deferred to the Town process. We were
concerned with how this affected the other homeowners in Massasoit Village and determined that it was positive
for all of us if Ed successfully went through the Town's process for approvals. We knew the Association had more
than enough ground cover to handle his addition and any other's homeowner's future projects. We told Ed that we
supported his efforts to move forward with his projects and looked forward to being kept infonned of where things
stood, looking at his formal plans when he had them, etc.
Please note that we subsequently sold our house in May 2004. The new owner was aware during the purchase
process that a neighbor was in the early stages of putting on an addition.
