At a Public Hearing ofthe Nantucket Zoning Board of Appeals, held at 1 :00 P.M.,
Friday, January 7,2005, in the Conference Room, Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, on the Application of LA WRENCE D. MCATEE,
TRUSTEE, MCATEE NOMINEE TRUST, 164 Ashley Lane, Middleborough, MA
02346, Board of Appeals File No. 002-05, the Board made the following Decision:
1. Applicant is APPEALING a decision of the Zoning Enforcement Officer (ZEO),
in a letter dated November 8, 2004, that denied a change of use from a retail
establishment (a permitted use without necessity for a special permit) to a use that would
contain a retail establishment and post boxes, described as a "UPS Store" on the building
permit application. Applicant states that no relief is necessary to change the use of the
commercial space and the parking and loading zone plan submitted with the original
building permit application in 1988 was approved and no relief was required of the
property owner at that time by the Building Department. Subsequently, a Change of Use
Permit was granted in 1991 to convert the retail space to retail/day care use without
requiring any further relief from the Board of Appeals as to parking or loading spaces.
Applicant states that no further relief should be required for the proposed use and no new
parking/loading zone requirements should be imposed on the Applicant. Applicant is
asking the Board of Appeals to overturn the decision of the ZEO and order the sign off on
the building permit application. In the alternative and/or to the extent necessary,
Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Sections 139-18 (parking) and 139-20 (loading zone) to waive any additional parking
requirements, including aisle width, and to waive the loading zone requirement, validate
a truncated space or validate provision of a dimensionally conforming space that would
not have sufficient aisle width. While the Applicant argues that the use is retail, should
the Board determine that any of the proposed uses, including but not limited to a "UPS
Store" with mailboxes, constitute a neighborhood service establishment, the Applicant is
seeking reliefby SPECIAL PERMIT under Nantucket Zoning By-law Section 139-8B.
The structure also contains a second floor apartment. The Lot is conforming in all other
respects. The Premises is located at 2 WINDY WAY, Assessor's Map 67, Parcel 118.5,
Plan Book 20, Page 66, Lot 9. The property is zoned Residential-Commercial-2.
2. The Decision is based upon the Application and the materials submitted with it
and the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation. There was one abutter present at the Hearing who expressed support of
the Applicant's appeal. There were no letters on file for or against the Appeal. Mike
Boylan, the owner ofthe business in the subject structure was present at the Hearing and
offered clarification as to the nature of the business.

3. Included in the file were two letters from the Zoning Enforcement Officer
("ZEO"), Marcus Silverstein, dated November 8, 2004 and November 17, 2004. The first
stated that questioned the appropriateness ofthe site plan submitted in 1988 to obtain the
Building Permit and that further reliefwas necessary from this Board. The second cited
an article in the local paper, the ''Nantucket Independent" that mentioned the opening
date of the store and the fact that they had not building permit to make changes to the
structure. He again stated that the Applicant had to submit a new parking and loading
zone plan in order to change the use and do the work required.
4. Applicant, through personal testimony from the Lessee and through counsel,
stated that he was appealing from the ZEO's opinion that the use ofa portion of the frrst
floor was being changed from retail to a new use that would require a change of use
permit and further site plan review from the Building Department and thus a new parking
and loading zone plan. Applicant stated that he may have mistakenly applied for a new
building permit to renovate the interior of the structure to "remove interior non-load
bearing partitions, add new lighting, install new cabinets, paint interior, install new
carpeting" for a "UPS Store" when no building permit may have been necessary. No
structural or exterior changes were proposed. Applicant argued that none of the above
should have triggered a change in use and the plan was simply to upgrade the existing
commercial space on the frrst floor. The Lessee stated that he had entered into a contract
with UPS that stated specifically that this business was a "retail shipping and packaging"
enterprise which also included the 300 post office boxes as all part of one business, so
they could be considered separately. The business also sold office supplies and cards, and
provided document finishing and copying services.
The parking requirement for the building in 1988 was ten spaces and the
requirement continued to be ten with the change in retail business to the UPS Store from
a kitchenlbathlappliance shop. The structure also contained two second-floor apartments.
The Lessee stated that no split axel trucks would be making any deliveries to the site and
only the smaller UPS large van type trucks would be making deliveries, which unloaded
directly into the shop space after backing into the lot. In the intervening years, the
commercial space had also been used as a furniture showroom and in 2001 the Applicant
filed for an amendment to the use at the Building Department to include retail and/or
daycare space. No mention had been made at the time that any new parking and loading
plan was required as a result. Applicant is asking the Board to overturn the ZEO and fmd
that relief is not necessary. In the alternative, should the Board deem relief necessary then
such relief has been asked for to validate the parking plan and change of use as proposed.
The property is conforming in all other respects to the requirements of the Zoning
By-law and no exterior changes are planned at this time. The property is located in a
heavily commercially developed area, with several commercial establishments proximate
the locus. Applicant stated that maintaining the current situation, whether by the Board's
overturning ofthe ZEO's decision or by a grant ofreliefto validate the current parking
and loading zone situation, would have little impact on the neighborhood as it has been
operating as a commercial business for 17 years without incident.

5. Based upon the foregoing presentation, the Board of Appeals finds that there are
sufficient grounds to overturn the Zoning Enforcement Officer's ruling that the UPS
Store uses were not considered retail and thus required a change of use and a new parking
and loading zone plan submitted with proper relief needed to be granted by this Board.
The Board finds that the uses as stated by the Applicant, are retail uses, including the
"Mail Boxes Etc." type aspect ofthe business, and as the use of the structure was
permitted by the Building Department in 1988 as retail, a use permitted as a matter or
right without relief from this Board in this zoning district, no relief from this Board is
necessary. In addition, the Board fmds that the site plan submitted and accepted by the
Building Department in 1988 should continue to be deemed sufficient by the Building
Department as there has been no increase in parking or loading requirements beyond
what was originally approved that would trigger the submission of a new site plan and
issuance of further relief from this Board.
6. Accordingly, upon a motion duly made and seconded to grant the appeal and
overturn the Zoning Enforcement Officer under Nantucket Zoning By-law Section 139-
31 there were five votes in favor (Sevrens, Waine, O'Mara, Loftin, Toole) and no votes
opposed; thus the ZEO decision is OVERTURNED and the APPEAL GRANTED.

ADDENDUM
The Applicant is appealing the decision of the Zoning Enforcement Officer,
Marcus Silverstein, as set forth in a letter dated November 8, 2004, a copy of which is
attached hereto as Exhibit (i). Also see a copy of a letter dated November 17, 2004, a
copy of which is attached hereto as Exhibit (ii).
It is the Applicant's position that he did not file for a change of use in his
Application for a Building Permit dated October 5, 2004. The Building Permit was not
even required for non-structural cosmetic changes to the interior of the structure. See
Exhibit (iii)
Retail use is permitted at 2 Windy Way per the Applicant's original Building
Permit and Certificate of Occupancy issued in 1988. See Exhibits (iv) and (v).
A Parking Plan showing parking spaces and a loading zone was submitted with
to the Building Department in 1988, a copy of which is attached hereto as Exhibit (vi).
Further, the Applicant filed a Change of Use Permit in 1991. The Change of Use
Permit was approved by the Building Department for Retail StorelDay Care. A copy is
attached hereto as Exhibit (vii).
Since there have been no changes to the structure and the permitted and current
use being a retail use, no new parking plans or requirements should be imposed on the
Applicant and the Decision of the Zoning Enforcement Officer dated November 8, 2004
should be overturned.
In the alternative, the Applicant seeks Special Permit relief pursuant to Section
139-18~) to waive any additional parking that may be required on the premises. The
Board may find that compliance with the parking requirements would be physically
impossible for the Applicant to provide, have a significant and adverse effect on the

In addition, the Applicant seeks Special Permit relief pursuant to Section 139-20, W\
Off Street Loading Facilities to allow the existincvt6ading zone as allowed in 1988 or to
waive the Off Street Loan Facilities requiremerrr."" The Board may find that the granting of
such relief is in harmony with the general purpose and intent of the by-law, the
provisions of the off-street loading facilities as required by the by-law is physically
impossible for the Applicant to provide, and the granting of relief would not be contrary to
sound traffic, parking or safety considerations.
In the event the Board determines that any of the proposed uses, including but
not limited to a "UPS Store" with mailboxes, constitute a neighborhood service
establishment pursuant to 139-8.B, special permit relief is hereby requested.

An article in today's Nantucket Independent states that the UPS Package Store, proposed
for your property at 2 Windy Way (Map#67, Parcel# 118.5), is scheduled to open the ftrst
week of December. You are reminded that no building permit has been issued for the
work required to open said store. Work without a permit is a violation of ~139-26 of the
Zoning Code.
A parking plan showing compliance to ~139-18 (parking) and ~139-20 (off-street loading
facilities) of the Zoning Code is required as part of your application. If you are unable to
comply with the parking requirements, Zoning Board of Appeals relief is required.
Failure to comply with the requirements of the zoning bylaw may result in fines of up to

ADDENDUM
The Applicant is appealing the decision of the Zoning Enforcement Officer,
Marcus Silverstein, as set forth in a letter dated November 8, 2004, a copy of which is
attached hereto as Exhibit (i). Also see a copy of a letter dated November 17,2004, a
copy of which is attached hereto as Exhibit (ii).
It is the Applicant's position that he did not file for a change of use in his
Application for a Building Permit dated October 5, 2004. The Building Permit was not
even required for non-structural cosmetic changes to the interior of the structure. See
Exhibit (iii)
Retail use is permitted at 2 Windy Way per the Applicant's original Building
Permit and Certificate of Occupancy issued in 1988. See Exhibits (iv) and (v).
A Parking Plan showing parking spaces and a loading zone was submitted with
to the Building Department in 1988, a copy of which is attached hereto as Exhibit (vi).
Further, the Applicant filed a Change of Use Permit in 1991. The Change of Use
Permit was approved by the Building Department for Retail StorelDay Care. A copy is
attached hereto as Exhibit (vii).
Since there have been no changes to the structure and the permitted and current
use being a retail use, no new parking plans or requirements should be imposed on the
Applicant and the Decision of the Zoning Enforcement Officer dated November 8, 2004
should be overturned.
In the alternative, the Applicant seeks Special Permit relief pursuant to Section
139-18 B (2) to waive any additional parking that may be required on the premises. The
Board may find that compliance with the parking requirements would be physically
impossible for the Applicant to provide, have a significant and adverse effect on the
scenic or historic integrity of the neighborhood and be contrary to sound safety
considerations.
In addition, the Applicant seeks Special Permit relief pursuant to Section 139-20,
Off Street Loading Facilities to allow the existing loading zone as allowed in 1988 or to
waive the Off Street Loan Facilities requirement. The Board may find that the granting of
such relief is in harmony with the general purpose and intent of the by-law, the
provisions of the off-street loading facilities as required by the by-law is physically
impossible for the Applicant to provide, and the granting of relief would not be contrary to
sound traffic, parking or safety considerations.
In the event the Board determines that any of the proposed uses, including but
not limited to a "UPS Store" with mailboxes, constitute a neighborhood service
establishment pursuant to 139-8.B, special permit relief is hereby requested.
The property is located at 2 Windy Way, Map 67, Parcel 118.5 and is zoned
Residential-Commercial -2.
