Ref. 704/337 At a Public Hearing of the Nantucket Zoning Board of Appeals, held at 1:00 P.M., Friday, January 7,2005, in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the Application of the SUZANNE TAYLOR, TRUSTEE OF 33 PINE STREET REALTY TRUST, c/o Paul Jensen, PC, PO Box 3097, Nantucket, MA 02584, Board of Appeals File No. 001-05, the Board made the following Decision: 1. Applicant is seeking a MODIFICATION of SPECIAL PERMIT relief granted in the Decision in BOA File No. 058-01, which allowed alteration/expansion of the pre- existing nonconforming duplex structure that included expansion of the existing ground cover from about 41 % to about 43%, and which also waived the two required parking spaces; or in the alternative, a grant of SPECIAL PERMIT relief under Nantucket Zoning By-law Section 139-33A. Applicant is now seeking validation of the siting of a propane tank within the required five-foot southerly side yard setback area. The tank would is located as close as about 3.3 feet and is no closer to said side yard lot line than the existing structure, which is sited as close as about 0.4 feet. In addition to the aforementioned side yard setback intrusion, the Locus is nonconforming as to lot size with the Lot containing about 3,840 square feet of area in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Lot containing about 49.52 feet along Pine Street in a district that requires a minimum frontage of 50 feet; as to ground cover ratio with the Lot containing about 43% in a district that allows a maximum ground cover ratio of 30% for undersized lots; and as to parking with not enough conforming spaces provided on site. The Premises is located at 33 PINE STREET, SIASCONSET, Assessor's Map 55.4.1, Parcel 66, Plan Book 15, Page 116, Lot 2. The property is zoned Residential-Old- Historic. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation. There were no letters on file in favor or in opposition and no comments from the public at the hearing. 3. Applicant, through counse4 represented that the property was benefited by a previous grant of Special Permit relief in the Decision in BOA File Nos. 058-01, which allowed alteration and expansion of a nonconforming duplex structure, that included an increase in ground cover and waiver of two parking spaces. Applicant was now before the Board seeking to modify the previous relief or obtain new relief to validate siting of an above ground propane gas tank that serviced a stove that was sited at about 3.3 feet from the southerly side yard lot line, though no closer to that lot line than the existing structure. During the renovation of the structure a new kitchen was installed and the gas tank placed in the current location next to the house by the gas company and on the outside wall immediately next to the stove. Applicant stated that there were few alternative sites to place the tank as the tank had to be placed where it could be serviced and filled. Applicant also stated that substantial cost would be incurred to relocate the gas line to a point some distance away from the stove itself. 4. Based upon the foregoing, the Board fmds that there are alternatives to the current placement of the gas tank which is sited within the required five-foot side yard setback area and that the grant of relief would cause a detriment to the neighborhood in that safety would be compromised having a tank sited so close to a setback line. The Board also fmds that there are no mitigating circumstances that would prevent the tank from being relocated to a conforming location eliminating the need for a grant of relief. 5. Accordingly, upon a motion duly made and seconded to grant the requested relief by MODIFICATION ofthe previous relief or by a new SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A, there were no votes in favor and five votes in opposition (Sevrens, Waine, O'Mara, Toole, Wiley). Said propane tank is to be located:! 3.3 feet from southern lot line, with the pre-existing nonconforming structure coming as close as:! .04 feet from the southern lot line. In File No. 058-01, the Board granted Special Permit relief allowing an addition to the nonconforming duplex that increased the ground cover ratio from 41 % to about 43% and waiving the two (2) required on-site parking spaces. The Locus is non-conforming as lot size, containing approximately 3840 square feet in a district where the minimum lot size is 5000 square feet, as to side line setback with structure sited as close as .04 feet to southerly lot line, as to use, being located in district where duplexes are not allowed, and has the benefit of BOA 058-01 as set forth above. The extension ofthe non-conforming duplex structure by adding a propane tank within the southerly side line setback, but not closer to southern property line than the nonconforming structure will not be substantially more detrimental to neighborhood than pre-existing structure.
