At a Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS held at
12:00 p.m., Friday, August 8, 2008, in the Garage Area, 2 Fairgrounds Road, Nantucket,
Massachusetts 02554 on the Application of Kenneth S. Lindsay and Karyn S. Lindsay, of PO
Box 987, Nantucket, Massachusetts, 02554, Board of Appeals File No. 051-08, the Board made
the following decision:
1. Applicants are seeking Special Permit relief pursuant to Nantucket Zoning By-law
Sections 139-33A (pre-existing, nonconforming lots) and 139-33A (8) (reconfiguring pre-
existing, nonconforming lots) to reconfigure their lot lines in order to merge abutting parcels of
land creating one separate merged nonconforming buildable lot having all the benefits of a lot of
record and a total area of 18,000 +/- square feet in the Residential-2 Zoning District where the
minimum lot size is 20,000 square feet.
The site is located at Utah Avenue, is shown on Nantucket Tax Assessor's Map 59.4 as
Parcels 168, 169,225,231,232,233, is shown on Land Court Plan 3092-D as Lots 22-25 and
38-42, Block 140, and is recorded at the Nantucket County Registry of Deeds as Certificate of
Title No. 21855.
2. The Decision is based upon the Application and the material submitted with it and the
testimony and evidence presented at the Hearing. The Planning Board made no
recommendation, as the matter was not of planning concern. There were no letters on file in
favor of or in opposition to the Application.
3. The property is located in the Residential-2 zoning district. In this zoning district, the
minimum lot size is 20,000 square feet. The applicants have proposed to reconfigure their lot
lines in order to merge the abutting parcels of land. By doing this, the applicant is proposing to
make nonconforming lots less nonconforming by merging six lots into one 18,000 square foot
lot.
Pursuant to Nantucket Zoning Bylaw section 139-33A(8) (pre-existing, nonconforming
lots may be changed), the lots may be changed so long as the no change in size, shape,
boundaries or frontage of any preexisting, nonconforming lot shall be done in any manner except
only pursuant to the issuance of a special permit, provided that no such special permit shall be
granted which creates any new nonconformity or increases any existing nonconformity.
Applicant requests a finding that the proposed reconfiguration would not be substantially
more detrimental to the neighborhood than the existing nonconforming lots and a Special Permit
pursuant to Nantucket Zoning Bylaw Section 139-33A(8) to allow the reconfiguration of the lots
lines as proposed to create one merged lot with a lot size of about 18,000 square feet in order to
move a dwelling that is in danger of coastal erosion.. The purpose for this lot merger is to
relocate a house in danger of coastal erosion onto the locus. As the coast is eroding at an
alarming rate, the need to relocate dwellings is dire and relocating the dwelling on a
nonconforming lot is an acceptable measure.
4. The Board specifically finds that the merging of the lots and giving the newly created lot
the benefit of a lot of record in the Residential-2 zoning district is not substantially more
detrimental than the existing non-conforming lots to the neighborhood because no new
nonconformity is granted and this merger does not increase any existing nonconformity.
Therefore, the Board finds sufficient grounds upon which to base a grant of special permit.
8. Accordingly, by a UNANIMOUS VOTE, the Board grants the requested SPECIAL
PERMIT under Nantucket Zoning By-Law Section 139-33A(8) and to validate merged
nonconforming lots as a single buildable lot with all the benefits of a lot of record in the
Residential-2 zoning district and eligible for the issuance of a building permit upon the following
conditions:
(a) The construction shall be done in substantial compliance with the plot plan
labeled Proposed Site Plan, Sheet 1 of 5, drawn by D. Neil Parent, dated 07.18.08
and attached as "Exhibit A".
