Norton and Valerie G. B. Norton 4 Tawpoot Road, Nantucket The Applicant requests a Special Permit pursuant to Section 139-33C(2) of the Nantucket Zoning By-law so as to validate an unintentional intrusion into the front yard setback as shown on the enclosed plan. A surveying firm had been involved in staking out the foundation for the new studio/ shop in the northwest corner of the property prior to construction, however, when the as built plan was prepared, the building was found to be situated 31.8 feet from Tawpoot Road at its closest point instead of the required 35 foot setback. This property is located in a rural area at the end of a little-traveled road with ample vegetation to screen the building. Relocating the building would involve significant expense. Because the violation was unintentional and resulted in an intrusion into the setback of less than five feet, special permit relief to validate the siting is available. NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 4 Tawpoot Road, Nantucket Assessor's Map 54, Parcel 112 Book 770, Page 223 Limited Use General - 3 DECISION: 1. At a public hearing of the Nantucket Zoning Board of Appeals on Friday, August 8, 2008, at 12:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 050-08 of Richard E. Norton and Valerie G.B. Norton of 4 Tawpoot Road, Nantucket, MA 02554. 2. The Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16(C)(2) (unintentional setback intrusion) to validate the unintentional setback intrusion into the front yard. The studio/ shop is located 31.8 feet from Tawpoot Road in a zoning district that requires a 35 foot front yard setback. The site is located at 4 Tawpoot Road, is shown on Nantucket Tax Assessor's Map 54 as Parcel 112, and is registered at the Nantucket County Registry of Deeds in Book 770, Page 223. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board made no recommendation finding that the Application did not present any issues of planning concern. No abutter comment was received either in favor of or against the Application. 4. Applicant, through counsel, represented that the studio/shop building in the northwest corner of the lot as shown on the Building Location Plan dated June 13, 2008 prepared by Charles W. Hart & Associates, Inc., was sited 31.8 feet from Tawpoot Road due to a surveying error in staking the location of the foundation. The error was not discovered until the as-built plan was prepared after construction of the building had been completed. The aerial photograph from the Town's GIS website was also submitted to illustrate the heavily vegetated and rural character of the surrounding parcels. Given that the violation was unintentional and resulted in an intrusion into the setback of less than five (5) feet, special permit relief is available to validate the intrusion. 5. The Board finds that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion, and that the intrusion occurred even though the applicant relied on a licensed survey firm. The Board also finds that the issuance of a special permit to validate the siting of the studio/ shop under these circumstances is in harmony with the general purpose and intent of the Zoning By-law. 8. Accordingly, by a UNANIMOUS vote (5-0), the Board of Appeals decided to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(2) to validate the siting of the studio/ shop as shown on the plan attached as Exhibit A, with the following condition: (a) No further alteration to the portion of the structure that is situated within the setback shall take place without further relief from this Board.
