ADDENDUM "A"
Applicant, Pamela D. Killen ("Killen"), is the owner ofthe commercial property located
at 81 Hinsdale Road, Nantucket, Massachusetts shown as Lots 711, 712 and 713 on Land Court
Plan No. 16514-Y filed with Certificate of Title No. 20987 at the Nantucket Registry District
("Property"). The Property has the benefit of Special Permit No. 010-90, as amended by
Modification of Special Permit No. 057-90, which permits allow the use of the existing two (2)
commercial buildings on the Property for a builder's workshop and for storage of building
materials. Currently, there are three (3) small woodworking shops on the Premises and the two
(2) commercial buildings are connected by a roofed-over storage area.
Killen requests that the Board of Appeals modify further Special Permit Nos. 010-90 and
057-90 to allow for the expansion and renovation ofthe commercial buildings on the Premises as
follows:
1. Enclose the roofed-over storage area connecting the two (2) existing commercial
buildings to create one commercial building.
2. Reconfigure the three (3) existing wood shop uses of the Property into five (5)
wood shop uses.
3. Provide five (5) defined off-street parking spaces on the Property as shown on the
Proposed Site Plan prepared by Nantucket Architecture Group entitled "An Addition for
the Killen Shop, 81 Hinsdale Road, Nantucket, MA 02554, Page 4, dated June 3, 2008.
By way of background, the Property has an area of approximately 23,356 square feet and
is located in the Residential Commercial-2 Zoning District ("RC-2"). The minimum lot size
requirement in the RC-2 District is 5,000 square feet. The existing buildings on the Property
have a ground cover of approximately 2.9222: sq. ft. (12.51 %). The maximum ground cover ratio
allowed in the RC-2 District is 50%. Killen proposes to enclose the existing roof covered area
connecting the two (2) existing commercial buildings thereby increasing the ground cover by
660:t sq. ft. The new, proposed ground cover is 3,65822: square feet (15.333%). In addition,
Killen proposes to reconfigure the three (3) existing wood shops into five (5) wood shops as
shown on the submitted Plan. Currently, there are three (3) wood shops on the Property as shown
on the submitted existing conditions plan. Wood shop #1 has an area of 1,1652: sq. ft, Wood shop
#2 has an area of 4602: sq. ft., and Wood shop #3 has an area of 1,1652: sq. ft. Killen proposes to
keep existing Wood shop #1 intact; convert existing Wood shop #2 into two (2) small wood
shops, each with an area of 5462: sq. ft., and divide existing Wood shop #3 into two (2) smaller
wood shops, each with an area of 5752: sq. ft.
The Property is tied into the Nantucket municipal sewer system and access to the
Property is from Hinsdale Road. Killen proposes to create five (5) defined off-street parking
spaces as shown on the submitted Plan and also to create an additional parking area on the
southern side of the Property. Pursuant to Section 139-18 of the By-Law, four (4) off-street
parking spaces are required (one parking space per 900 sq. ft. of gross floor area).
In summary, Killen seeks further modifications of Special Permit Nos. 0 I 0-90 and 057-
90 pursuant to Section 9B(2)(b) and (c) of the By-Law to allow for the expansion and renovation
of the commercial buildings on the Property as requested herein, and Minor Site Plan Review
Approval pursuant to Section 139-23E(2) ofthe By-Law.
Killen's proposed expansion and renovation ofthe commercial buildings on the Property
will comply with the intent and purpose ofthe Zoning By-Law. Specifically, all proposed wood
shops will be enclosed; the buildings on the Property will be upgraded and improved; and there
will be ample off-street parking. Killen asks the Board of Appeals to grant her the requested
zoning relief.

At a public hearing on Friday, March 9, 1989, at
1:00 p,m. in the Town and County Building, Nantucket, on
the Application (010-90) of PAUL BRUCE KILLEN having an
address at 36-1/2 Cliff Road, Nantucket, MA 02554, the
Nantucket zoning Board of Appeals made the following
DECISION:
1. Applicant seeks a Special Permit under zoning Code
Sections 139-9B(3) (b) and (c) to allow construction and
use of a 2400-SF, single-story building as a builder's
workshop and warehouse for building materials.
2. The premises are located at 81 Hinsdale Road,
Assessor's Parcel 69-021, Lot 141 of Land Court Plan
16514-Y, and zoned Residential Commercial-2.
3. Our findings are based upon the Application papers
including the site plan included in the drawings upon
.which is based Certificate of Appropriateness 20,070
granted 8/8/89 by the Historic District Commission.
Further basis lies in the representations and testimony
received at our hearing.
4. Applicant's Lot 141 of 0.52 acre includes a trapezoidal
portion extending generally southwardly from Hinsdale Road
and a narrow strip extending from the south lot line
easterly parallel to Hinsdale Road, apparently to provide
a measure of frontage on the improved Nobadeer Farm Road,
Questions of frontage and regularity factor are not raiSed
in these proceedings, so we proceed upon the assumption
that the lot is buildable.
5. To meet the requirements of Section 139-16F, the lot
will be laid out with at least 20% open area. Provision is
made for the requisite 3 off-street parking spaces and the
loading area, as shown on the site plan, While the relief
sought did not specifically address the question of open
storage of materials and goods, we understand from
Applicant that such open storage is foreseen. section
139-9B(3) (b) requires that such storage be properly
screened.
5. South of the parking area will be the proposed 2400-SF
building, elongated north-south, As we understand it, the
building will be insulated, reducing the level of
machinery noises released to the exterior. Applicant
undertakes to remain in compliance with section 139-20,
especially -20A, also with any applicable provisions of
File No. 010-90

Sections 139-14A and B protective of sole-source aquifer
recharge. Applic,ant intends to limit operations to times
usual to this type of business. On this basis, we make the
necessary findin,g that the use will not be in violation of
Section 139-20.
G. To meet neighborhood concerns as to noise, we condition
relief upon Applicant siting the building about 20 feet
north of that shown on the above-referenced site plan,
Le., at the location shown on the new site plan, attached
hereto as Exhibit "A". Otherwise, the proposed building
shall be in substantial conformity with the plans and
elevations of Certificate of Appropriateness 20,070.
7. With the above-noted conditions, we understand that the
Planning Board's recommendation is favorable and
neighborhood concerns are addressed. The relief sought and
here granted is found to be in harmony with the general
purpose and intent of the zoning Bylaw.
8. Accordingly, by unanimous vote, this Board grants to
Applicant the requested Special Permit under Sections
139-9B(3) (b) and (0) to construct and use the proposed
building a.S a builder's workshop and a warehouse for
interior storage of building materials.

Decision:
1. Applicant seeks a MOdification of a 5peci~l Permit granted
under Section 139-9B(3)(b) and (c) to allow use of a building for
storage and warehousing of goods and materials and for fabrication
and assembly of components for off-site construction use. The
proposed buildings wiJ~ be two (2) 1200 SF structures to be used as a
builder's workshop and warehouse for building materials. The existing
Speciai Permit granted under Board of Appeals file 010-90 allows one
building which would be the same size as the two proposed buildings
combined but on a site closer to the front lot line tr.~ the original
structure was proposed.
2. The Board's Decision is based upon the Application and
papers and documents filed therewith, the evidence, oral and
documentary, presented at the hearing, and a favorable recommendation
from the Planning Board. The closest abutter that had expressed
concern about the project at the last hearing, viewed the plans and
had no objection and was further supportive considering the fact that
the two structures would be moved more forward on the lot, away from
his dwelling.
3.- ,The Board finds that the proposed modification of the
existing Special Permit is in harmony with the general purpose and
intent of the Zoning By-Law with the following conditions:
a. instead of the one building specified in the existing
Special Permit of 2400 SF, Applicant may construct two
(2) buildings, each 1200 SF totalling not more than
2400 SF to be sited and constructed in substantial
conformity with the plans submitted with this
Application, marked Exhibit "A";
b. except as to the terms hereby modified, the existing
Special Permit shall remain in full force and effect.

DECISION:
1. At a public hearing of the Nantucket Board of Zoning Appeals on Friday, July 11,
2008, at I :00 P.M. at 2 Fairgrounds Road, Nantucket, Massachusetts, and at the continued public
hearing on Friday, August 8, 2008 at 12:00 P.M., the Board made the following decision on the
application of PAMELA D. KILLEN of63 Vestal Street, Nantucket, Massachusetts, File No.
045-08:
2. Applicant is seeking a modification of the Special Permit granted in File No. 010-
90, previously modified in File No. 057-90, to enclose the roofed-over storage area connecting
the two (2) existing commercial buildings in order to create one (I) commercial building, to
reconfigure the three (3) existing wood shop uses of the property into five (5) wood shop uses,
and to provide five (5) defined off-street parking spaces and an additional parking area on the
southern side of the property. The site is located at 81 HINSDALE ROAD, is shown on
Nantucket Tax Assessor's Map 69 as Parcel 21, is shown on Land Court Plan 16514-58 as Lots
711, 712, and 713, and is recorded at the Nantucket County Registry of Deeds as Certificate of
Title No. 20987.
3. Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning Board made no
recommendation finding that the Application did not present any issues of planning concern. No
abutter comment was received either in favor of or against the Application.
4. The Applicant has a Special Permit permitting the use of the two (2) commercial
buildings on the property for a builder's workshop and for storage of building materials (ZBA
File Nos. 010-90 and 057-90). Currently there are three (3) small woodworking shops on the
premises and the two (2) commercial buildings are connected by a roofed-over storage area.
The applicant is proposing to enclose the roofed-over storage area connecting the two (2)
existing commercial buildings to create one commercial building. Applicant is also proposing to
reconfigure the three (3) existing wood shop uses into five (5) wood shop uses. Finally, the
applicant is proposing to provide five (5) defined off-street parking spaces on the property as
shown on the proposed site plan.
The property and the proposed additions conform to the intensity regulations of the
Zoning Bylaw.
5. At the July meeting, the Board requested the Applicant provide an updated
parking plan in order to accommodate additional vehicles. Accordingly, the Applicant provided
an updated site plan showing six (6) parking spaces.
6. The Board subsequently found that the proposed modification to enclose the
roofed-over storage area connecting the two (2) existing commercial buildings in order to create
one (1) commercial building, to reconfigure the three (3) existing wood shop uses of the property
into five (5) wood shop uses, and to provide six (6) defined off-street parking spaces and an
additional parking area on the southern side ofthe property is not substantially more detrimental
to the neighborhood than the existing uses and is in harmony with the general purpose and intent
of the Zoning Bylaw.
7. Accordingly, by UNANIMOUS VOTE, the Board of Appeals modifies its
Decisions in File Nos. 010-90 and 057-90 to grant the requested relief of enclosing the roofed-
over storage area connecting the two (2) existing commercial buildings in order to create one (1)
commercial building, reconfiguring the three (3) existing wood shop uses of the property into
five (5) wood shop uses, and providing six (6) defined off-street parking spaces and an additional
parking area on the southern side of the property upon the following conditions:
1. Construction shall be done in substantial compliance with the plan entitled "An Addition
for The Killen Shop" dated July 21,2008, prepared by Nantucket Architecture Group;
2. The evergreen screening as shown on the plan entitled "An Addition for The Killen
Shop" dated July 21,2008, prepared by Nantucket Architecture Group shall be
maintained;
3. The commercial buildings shall be limited to a total of five (5) wood shops; and
4. The hours of operation shall be not earlier than 7:30 A.M. or later than 6:30 P.M on
Monday through Saturday, with no such operations on Sundays.
