Applicant is the contract purchaser of property that is a conforming lot in the R-10 zoning district, having approximately 11,100 square feet of area and 100 feet of frontage on Sparks Avenue. There are two single family dwellings on the property; both structures are conforming as to front yard, side yard and rear setbacks, except for a small step located about 5 feet from Milestone Lane, and conforms to ground cover. Applicant proposes to convert one of the dwellings of approximately 982 square feet to a beauty salon. The beauty salon will be owned by Applicant's daughter and will have no more than two additional employees. The proposed use of the property as a beauty salon with up to three employees requires six parking spaces, with two parking spaces required for the other dwelling on the property. The property is currently improved with a parking lot with five parking spaces that back into Milestone Lane and pre- existing parking for two cars, stacked, on Gold Star Drive. Applicant requests a waiver of one parking space required for the proposed uses, a waiver for the stacked parking for the dwelling use, a waiver of the dimensional requirements of the parking spaces if necessary, and a waiver to allow backing into Milestone Lane, pursuant to Section 139-18(B). Applicant requests a waiver of the requirement to provide an off-street loading facility for the beauty salon. Applicant also requests relief by Special Permit to reduce the side yard setback from 10 feet to 5 feet pursuant to Section 139-16(C) to validate the small step within the side yard setback on Milestone Lane that has existed in that location for more than ten years. NANTUCKET ZONING BOARD OF APPEALS Two Fairgrounds Road Nantucket, Massachusetts 02554 4 Sparks Avenue, Nantucket Assessor's Map 55, Parcel 191 Residential-IO Lot I on Plan Book 15, Page 27 Deed Book 1144, Page 94 At a public hearing of the Nantucket Zoning Board of Appeals on Friday, August 8, 2008, at 12:00 P.M., in the Garage Area at Two Fairgrounds Road, Nantucket, Massachusetts, on the Application of CYNTHIA THOMAS and MELINDA RODRIGUES, of 4 Sparks Avenue, Nantucket, Massachusetts 02554, BOA File No. 044- 08 in connection with property located at 4 Sparks A venue, Nantucket, Massachusetts the Board made the following DECISION: 1. Applicants are seeking Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-8(B)(2) to create a neighborhood service establishment/beauty salon. Applicants are also seeking Special Permits pursuant to Nantucket Zoning Bylaw Section 139-18 (parking requirements) to waive a portion of the required parking spaces, to allow for stacked parking for the residential use, to allow for backing onto the street, and to the extent necessary, to waive the dimensional requirements of the parking spaces. Applicants are also requesting a waiver of the loading zone requirements pursuant to Nantucket Zoning Bylaw Section 139-20 (off street loading facilities). Applicants also request Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16(C) (intensity regulations) to validate the location of the steps in the side yard setback. In the alternative, Applicants are seeking Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (Variances) to validate the location of the steps in the setback. The Premises are located at 4 Sparks A venue, shown on Nantucket Tax Assessor's Map 55 as Parcel 191, on Plan Book 15, Page 27, and recorded at the Nantucket Registry of Deeds in Book 1144, Page 94. The Premises are located in the Residential-IO zoning district. 2. Our Decision is based upon the application and accompanying materials, representations and testimony received at our public hearing. The Planning Board found the application to be of planning concern and recommended that the Board of Appeals review the conditions of the driveway on Goldstar Drive. No one spoke in favor or against the application at the hearing. There was one letter in opposition from an abutter in the file. 3. Applicants, through counsel, represented that the Premises are located in the Residential-l0 zoning district and are conforming as to lot area, having adequate area and frontage in the zoning district. There are two single family dwellings on the Premises; the structures conform to ground cover and all setback requirements, except for a small step to an exterior door located about 6.8~ feet from Milestone Lane in a zoning district that requires a ten (10) foot side yard setback. The dwellings are served by two parking areas; a parking area of about 20 feet by 39 feet off Milestone Lane and two stacked parking spaces of 9 feet by 20 feet on a grass driveway off Goldstar Drive. Applicants presented an Affidavit from the prior owner, attesting that the structures, parking and their configurations have existed in the current locations since 1980, attached hereto as Exhibit B. 4. Applicants propose to convert the front cottage of about 982 square feet to a beauty salon, which is neighborhood service establishment permitted in the R-10 zoning district by Special Permit. The hair salon would have no more than 3 employees at peak shift. The secondary dwelling on the Premises would remain a single family dwelling. Pursuant to Nantucket Zoning Bylaw Section 139-16, the change of use to a beauty salon requires six (6) parking spaces and the secondary dwelling requires two (2) parking spaces. Applicants propose to mark four (4) parking spaces for the beauty salon use within the existing parking area off Milestone Lane, consisting of one (1) handicapped space that is 16 feet wide, two (2) spaces that are each 8 feet wide, and one (1) space that is 7 feet wide as permitted under Nantucket Zoning Bylaw Section 139-16. Applicants would assign the two (2) conforming stacked spaces off Goldstar Drive for the secondary dwelling unit. 5. Regarding issues of the condition of the driveway off Goldstar Drive raised by the Planning Board, in addition to the attached Affidavit, Applicants presented an aerial photograph of the Premises from 1998 that shows the existing mature hedges creating the driveway space separate from the yard with a car parked in the driveway. Applicants also presented an aerial photograph from 2003 showing the conditions unchanged, including a car parked in the driveway. Based on the foregoing, the Board finds that the second driveway off Goldstar Drive is a pre-existing nonconforming second curb cut and legal parking area for the Premises. The Board also finds that no relief is necessary for the stacked parking or backing onto the streets, both conditions being legal and/ or grandfathered under the Zoning Bylaw. 6. Applicants through counsel presented testimony that the Premises face Sparks A venue, which is a primarily commercial street, with commercial business across Sparks Avenue and Milestone Lane. Applicants further argued that the existing parking on the Premises would be sufficient for the proposed change of use. 2 7. Based on the foregoing, the Board finds that the conversion of the dwelling unit into a beauty salon would not be contrary to the Zoning Bylaw, not substantially more detrimental to the neighborhood, and would be in harmony with the general purpose and intent of the Bylaw. The Board also finds that the parking provided on site would be adequate for the proposed uses and will have little negative impact on the neighborhood under conditions set forth in this Decision. 8. Accordingly, by a UNANIMOUS vote, the Board of Appeals GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw section 138-8(B) (2) to allow the project as proposed by the Applicants, including a waiver of two (2) parking spaces, reducing the width of two (2) parking spaces from nine (9) feet to eight (8) feet, and waiving the off street loading space requirement, on the following conditions: (1) that parking for the proposed salon and dwelling unit shall be substantially as shown on the plan submitted by Applicant labeled "Sketch Plan of Proposed Salon and Parking #4 Sparks Avenue" drawn by Nantucket Surveyors, LLC, dated July 11, 2008, attached hereto as Exhibit A; and (2) the hours of operation of the beauty salon shall be limited to 9:00 a.m. to 6:00 p.m., Monday through Saturday. 9. By a UNANIMOUS vote, the Board also approves the site plan attached as Exhibit A under Zoning Bylaw Section 139-23. 10. By a UNANIMOUS vote, the Board grants a SPECIAL PERMIT pursuant to Section 139-16(C), reducing the side yard setback from ten (10) feet to five (5) feet in this zoning district, for the limited purpose to validate the location of the existing step in the side yard setback on Milestone Lane, and provided that Applicants come no closer to the side yard lot line than the existing step without further relief from this Board.
