DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, June 12, 2008, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of OFFSHORE BEACHSIDE, LP,
30 North Beach Street, Nantucket, Massachusetts 02554, File No.
040-08:
2. Applicant is seeking Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-33A (pre-existing,
nonconforming uses, structures, and lots). Applicant is seeking
to convert a portion of an existing garage/storage area to a
recreational facility/work-out room to be used by guests and
employees. The site is located at 30 North Beach Street, is
shown on Nantucket Tax Assessor's Map 29 as Parcel 130, is shown
on Land Court Plan 6670-D and 10822-B, and is recorded at the
Nantucket County Registry of Deeds as Certificate of Title No.
16597.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. No support or opposition was received at the
hearing, in person or by written communication.
4. At the public hearing, the applicant stated to the Board
that there will be no exterior change to the structure. Rather,
the only change will be converting a storage area into an
exercise room available only for guests and employees of the
Beachside Inn. In turn, this will require no additional parking
as only the guests and employees will have access to this
exercise room and therefore there will be no need to create
parking spaces. As the Zoning Enforcement Officer considers this
to be a change in use that warrants Special Permit relief, the
applicant brought this matter to the Board of Appeals and sought
the required change in use relief pursuant to Nantucket Zoning
Bylaw Section 139-33A. The structure is pre-existing,
nonconforming having been constructed in 1965, except for the
employee housing which was constructed in 2007.

5. Accordingly, the Board of Appeals, by UNANIMOUS vote,
found the requested relief would not be substantially more
detrimental to the neighborhood than the pre-existing
nonconformity, and subsequently granted the requested SPECIAL
PERMIT to convert a portion of an existing storage area into an
exercise room.
