The lot at 22 Appleton Road is 12,181 + /- SF in a district requiring a minimum of 5,000
SF. The lot is improved with a single structure containing 2,660 +/- SF of residential
space (a dwelling and an apartment, both with c.o.s) and a 964 +/- SF garage.
Applicant request a Special Permit to use the garage as a contractors shop via relief
pursuant to Nantucket Zoning By-law 9139-9.B(2)(a),(b) and (c) for light manufacturing;
storage and warehousing of goods, materials and equipment; and fabrication and
assembly of component parts for off-site construction or use, respectively. Applicant
notes that such mixed commercial-residential uses are common in the area and would not
be a detriment or out of character with the neighborhood.
Applicant also noted that the structure currently contains a second story deck that
encroaches into the side-yard setback, but the Applicant is in the process of remedying
this by shortening it and does not seek relief for the encroachment.

At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1 P.M., on
Thursday, June 12, 2008, in the Garage Area at 2 Fairgrounds Road, Nantucket,
Massachusetts, on the Application of Steven L. Cohen, Trustee of the Glenview Realty
Trust, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket,
Massachusetts 02584, Board of Appeals File No. 038-08, the Board made the following
Decision:
1. The Premises is located at 22 Appleton Road, Assessor's Map 66, Parcel 23,
Plan File 55-B, Lot 01. It is in the Residential-Commercial-2 district. The structure
contains two attached dwellings and an attached garage. There is a second story deck
that encroaches into the eastern setback, but the lot and structures otherwise conform to
all other dimensional zoning requirements.
2. The Applicant seeks relief by SPECIAL PERMIT pursuant to Nantucket Zoning
Bylaw Section 139-9B(2) to use the garage portion of the structure, approximately 964
square feet of ground cover, as a contractor shop for light manufacturing, fabrication and
assembly of component parts for off-site construction or use, and storage and
warehousing of goods, materials and equipment. Applicant seeks no relief for the
encroaching deck, as applicant is remedying it as part of several fixes needed to clear up
open Building Permits and Code Enforcement Orders issued against the property under
the prior owner.
3. The Decision is based upon the Application and materials submitted with it and
testimony and evidence presented at the hearing. The Planning Board made no
recommendation as the matter was not of planning concern. Applicant's representative
made a supportive presentation describing the Applicant's intended use of the garage as a
shop for his carpentry business and noted that several other lots in the area are used for
similar mixed commercial/residential purposes. Applicant also noted that his intended
use was lighter than the prior uses on the lot, which were as a dorm (illegally) and a car
detailing facility. One abutter, from across the street, appeared and asked the Board of
Appeals to take steps to make sure the traffic and disturbances associated with a
contractor shop did not grow exponentially beyond that proposed by the Applicant.
The Board expressed concern regarding the number of possible vehicles on the
premises and the noise of the business. The Board indicated that an approval would be
conditional upon the applicant acquiescing to installing air conditioning in the area where
the light manufacturing and carpentry would be taking place.
4. Therefore, based upon the foregoing, the Board finds that a grant of special permit
relief for the proposed contractor shop for storage and warehousing of commercial
materials and equipment, light manufacturing, and fabrication and assembly of
component parts for off-site construction or use, as allowed under Nantucket Zoning
Bylaw Sections 139-9B (2), would be in harmony with the general purpose and intent of
the Zoning Bylaw and consistent with similar commercial uses in the immediate
neighborhood.
5. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested relief by
SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-9B(2) with the
following conditions:
(a) No more than three commercial vehicles shall be parked on the Premises;
(b) The hours of operation for commercial fabrication or manufacturing shall be not
earlier than 7:30 A.M. or later than 6:30 P.M on Monday through Saturday, with
no such operations on Sundays;
(c) There shall be no outside storage of goods and materials; and
(d) When commercial fabrication or manufacturing is being done, all exterior doors
and windows in the shop area shall be closed. The garage shall be equipped with
air conditioning to help facilitate this requirement.
