DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, May 9, 2008, at 1:00 P.M., at 2 Fairgrounds
Road, Nantucket, Massachusetts, the Board made the following
decision on the application of 43 INDIA LLC, c/o Reade,
Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 030-08:
2. The applicant requests a Special Permit under Nantucket
Zoning By-law ~139-33.A(6), to change the boundaries if a pre-
existing, nonconforming lot without creating any new
nonconformities or adding any new non conformities, The locus at
present is nonconforming as to lot area and frontage, containing
about 2,447 square feet with 5,000 square feet being the minimum
lot area in this zoning district, and having frontage of 47.95
feet on India Street, with minimum frontage in this district
being fifty (50) feet. The applicant proposes to exchange land
with an abutter with the parcels being exchanged having exactly
the same area; the parcel being conveyed to the abutter will
increase the frontage of the locus so that it will exceed the
minimum of fifty (50) feet. The abutter's lot is and will remain
conforming as to area and frontage. No nonconformities of the
structures upon either lot will be affected by the change. All
of these changes, as presented by the applicant at the public
hearing, are shown upon a plan by Blackwell & Associates, Inc.,
dated April 23, 2008, a copy of which is attached hereto as
Exhibit A.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. Except for the joint presentation by the
applicant and the abutter, there was no support nor opposition
presented at the public hearing.
4. As presented by counsel at the public hearing, the
abutter's fence extends into the locus, as shown by a survey
obtained by the applicant, by about twenty-two (22) square feet.
Although the abutter originally claimed title to the area
enclosed by the fence through adverse possession, the applicant

and the abutter have agreed to exchange strips of land, so that
the applicant will convey to the abutter all of the applicant's
interest in the land enclosed by the fence in exchange for a deed
from the abutter of a parcel of equal size which will render the
locus conforming as to frontage and will also facilitate the
placement of a parking area upon the locus. Until now, no off-
street parking space has been provided for the dwelling upon the
locus. The land to be conveyed by the applicant to the abutter
is shown as Lot B upon the Exhibit A plan, and the land to be
conveyed by the abutter to the applicant is shown as Lot C.
After the conveyance, the applicant will combine Lot C with its
Lot D, and the abutter will combine Lot B with its Lot A.
5. Based upon the fact that the proposed boundary line
adjustment will create no new nonconformities, will not increase
any existing nonconformity, and will eliminate the frontage
nonconformity of the locus, the Board of Appeals made the
finding, by unanimous vote, that the proposed lot line
reconfiguration would not be more detrimental to the neighborhood
than the existing nonconformities, and by the same unanimous vote
GRANTED the requested Special Permit under ~139-33.A(8) to allow
the reconfiguration of the locus as shown upon the Exhibit A
plan.

DECISION:

2. The applicant requests a Special Permit under Nantucket
Zoning By-law ~139-33.A(6), to change the boundaries if a pre-
existing, nonconforming lot without creating any new
nonconformities or adding any new non conformities, The locus at
present is nonconforming as to lot area and frontage, containing
about 2,447 square feet with 5,000 square feet being the minimum
lot area in this zoning district, and having frontage of 47.95
feet on India Street, with minimum frontage in this district
being fifty (50) feet. The applicant proposes to exchange land
with an abutter with the parcels being exchanged having exactly
the same area; the parcel being conveyed to the abutter will
increase the frontage of the locus so that it will exceed the
minimum of fifty (50) feet. The abutter's lot is and will remain
conforming as to area and frontage. No nonconformities of the
structures upon either lot will be affected by the change. All
of these changes, as presented by the applicant at the public
hearing, are shown upon a plan by Blackwell & Associates, Inc.,
dated April 23, 2008, a copy of which is attached hereto as
Exhibit A.
3. Our decision is based upon the application and

The applicant requests a Special Permit under Nantucket Zoning By-law ~139-33.A(8), to
change the boundaries of a pre-existing, nonconforming lot without creating any new
nonconformity or adding any new nonconformity. The locus at present is nonconforming
as to lot area and frontage, having area of about 2,447 square feet, with 5,000 square feet
being the minimum area in this Residential-Old Historic zoning district, and frontage of
47.95 feet on India Street, with 50 feet being the minimum frontage in this district. The
applicant proposes to exchange land with an abutter, with 21 square feet being conveyed to
the abutter and 21 square feet being conveyed by the abutter in exchange. The result will be
that the lot area of the locus will remain at the present 2,447 square feet, while frontage will
be increased by 3.19 feet to 51.14 feet, thus rendering the locus conforming as to frontage.
The abutter's land is and will remain conforming as to area and frontage. No
non conformities of the structures upon either lot will be affected by the change. See the
attached plan by Blackwell & Associates, Inc., dated March 26, 2006. At present, the
applicant owns Lots B and D. The abutter owns Lots A and C. The abutter will convey Lot
C to the applicant in exchange for Lot B.
