Addendum
The Applicant is seeking modify the special permit relief originally granted under
Board of Appeals Decision 023-02, as modified by Board of Appeals Decision 058-03, as
further modified by Board of Appeals Decision 019-04, by removing all of the conditions
of said grant as so modified. Applicant has successfully operated the cafe for over four
(4) years and has no knowledge of any complaint.
The Premises is located at 5 Chestnut Street, Assessor's Map 42.3.1, Parcel 5, Book
46, Page 485 and 525. The property is zoned Residential Commercial Downtown.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on Friday, May 9,
2008 at 1:00 P.M., in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts 02554,
the Board made the following decision on the application of5 CHESTNUT STREET, LLC, c/o
Paul S. Jensen, PC, PO Box 3097, Nantucket, MA 02584, Board of Appeals File No. 026-08:
2. The Applicant is seeking modify the Special Permit relief originally granted under
Board of Appeals Decision No. 023-02, as modified by Board of Appeals Decision No. 058-03,
as modified by Board of Appeals Decision No. 019-04, by modifying the cafelbar's hours of
operation. The site is located at 5 Chestnut Street, is shown on Nantucket Tax Assessor's Map
42.3.1 as Parcel 5, and is recorded at the Nantucket County Registry of Deeds in Book 729, Page
68.
3. Our decision is based upon the application and accompanying materials, and
representations, photographs, and testimony received at our public hearing. The Planning Board
made no recommendation as this matter was found not to be of planning concern. Other than the
presentation by Applicant's representative, there was no comment at the public hearing.
4. The Applicant, through counsel, explained that the Board of Appeals previously
extended the hours of operation of the cafelbar to 10:30 PM in Board of Appeals Decision No.
058-03; but, that decision was never recorded with the Registry of Deeds and the special permit
was never activated and therefore expired. Thus, the modification has lapsed and the Applicant
is requesting a further modification of Board of Appeals Decision No. 019-04 - a decision that
was recorded but did not address any hours of operation. As the hours of operation were already
modified by the Board of Appeals in Decision No. 058-03, the Applicant is requesting the Board
of Appeals modify Decision No. 019-04 to extend the hours of operation of the cafelbar to 10:30
PM.
5. The Board determined that it was approving what was originally approved in
2003. Therefore, the Board finds that modifying the condition that the cafelbar area shall be
open no later than 10:30 PM would be in harmony with the general purpose and intent of the
Zoning Bylaw and consistent with the larger commercial area.
6. For the reasons set forth herein, the Board by unanimous vote hereby GRANTS
the requested MODIFICATION of the SPECIAL PERMIT to allow the cafelbar area to remain
open, from the previously allowed 9:00 PM, to no later than 10:30 PM, without any further
changes to the uses or structures, based upon the following condition:
a. The cafelbar area shall be open no later than 10:30 PM
