At a public hearing of the Nantucket Zoning Board of Appeals on Friday, May 9, 2008 at 1:00 P.M., in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts 02554, the Board made the following decision on the application of CHRISTOPHER H. BRIEN and DEBORAH M, BRIEN, of PO Box 7523, Siasconset, MA 02564, Board of Appeals File No. 025-08: 2. The Applicants are seeking a VARIANCE from the requirements of Nantucket Zoning By-law Section 139-33(E)(2)(b)(maximum ground cover for non-conforming lots) to validate existing shed on the property. The property is nonconforming as to lot size, containing 33,750 square feet ofland in a district that requires at least 120,000 square feet ofland for a buildable lot. The property is improved with a pre-existing single family dwelling covering approximately 1276 square feet, to which a 214 square foot addition was added in 1986 pursuant to Building Permit No. 4901-86 and Certificate of Occupancy 4901-87 and an accessory shed structure with ground cover of about 150 square feet, which was constructed without a building permit sometime prior to 1998. There total ground coverage on the property is 1640 square feet, which exceeds maximum of 1500 square feet of ground coverage that is allowed the property. The Premises are located at 9 LYONS LANE, Assessor's Map 76, Parcels 25 and 26, Lot 548 on LCPL No. 5004-17 and Lot 650 on Land Court Plan No. 5004-29. The property is zoned Limited General Use - 3. 3. Our decision is based upon the application and accompanying materials, and representations, photographs, and testimony received at our public hearing. The Planning Board made no recommendation as this matter was found not to be of planning concern. Other than the presentation by Applicants' representative, there was no comment at the public hearing. 4. The Applicants through counsel represented that the Applicants purchased this property in 2002 from a seller, whose family had owned the property since 1969. A 2002 plot plan of the property showed that the existing dwelling and shed with a total of 1640 square feet of ground coverage, which exceeded the allowable ground coverage of 1500 square feet. At closing, the seller provided an affidavit dated December 10, 2002 from stating that all the structures on property had existed since 1992 and that shed on the property was constructed prior to 1975. However, when Applicants applied for a building permit to renovate the dwelling, the Zoning Enforcement Officer informed them that in 1986, the seller constructed an addition to the dwelling under Building Permits No. 4901-86 and Certificate of Occupancy to the dwelling based on January 23, 1986 plan that did not show a shed on the property. The Zoning Enforcement Officer encouraged the Applicants to get a variance to validate the shed on property before proceeding with any building permit applications. 5. Therefore, the Board finds that due to the ground coverage, the plan and permit history of the existing shed on the property, which is a unique circumstance relating to shape and topography of this structure that specifically affects this property, but does not generally affect the zoning district, literal enforcement of the ground coverage limitation set forth in Zoning By- law to the existing shed would cause a substantial hardship to the Applicants and that requested relief from the ground coverage limitation may be granted without substantial detriment to public good and without nullifying or substantially derogating from the intent or purpose of the Zoning By-law 6. For the reasons set forth herein, the Board by unanimous vote hereby GRANTS a V ARIANCE from the provisions of Zoning By-law Section 139-33(E) for the existing shed on the property under the following condition: a. Said relief shall be valid for only so long as the shed remains without change in configuration.
