Franco and Kim D. Franco, of 10610 Barons Court, Vero Beach, FL 32963, Board of Appeals File No. 022-08, the Board made the following decision: 1. Applicants are seeking a modification of the Board of Appeals Decision No. 083-07, or in the alternative, Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33A (alteration/expansion of pre-existing nonconforming structure) or, in the alternative, relief by Variance pursuant to Nantucket Zoning Bylaw Section 139-16A (intensity regulations - side yard setback) to allow the location of the HV AC unit and a propane tank to be located in the easterly setback. The site is located at 10 Still Dock, is shown on Nantucket Tax Assessor's Map 42.3.1 as Parcel 83, and is registered at the Nantucket County Registry of Deeds as Certificate of Title No. 22663. 2. The Decision is based upon the Application and the material submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation, as the matter was not of planning concern. There were no letters on file in favor of or in opposition to the Application. No opposition was expressed at the Hearing. 3. The lot, as currently constituted, was in existence prior to July 27, 1972. The Applicants removed the structure in order to construct a new foundation. There was no increase in ground cover of the structure. Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 33A(9) to allow the structure to be removed and reconstructed on the lot was granted in the prior decision (083-07). The structure, which had previously encroached onto Still Dock by approximately .4' +/- is located completely within the boundary lines. The Applicants relocated the structure by sliding it in a westerly direction on the lot. After the relocation, the structure complies with the zoning setbacks. However, by relocating the structure, the propane tank and HV AC system were pushed into the easterly setback as shown on the Plot Plan by Blackwell & Associates, Inc. dated July 25,2006, revised April 2, 2008. 4. At the hearing, the Board noted that the location of the propane tank is moot as Warrant Article 63 was passed at Annual Town Meeting that exempted 120 gallon propane tanks from the definition of structure. However, as the article still needs to be approved by the Attorney General, the applicant is seeking a more expeditious relief by coming in front of the Board of Appeals. Nonetheless, the Board asked the applicant why, after receiving relief only a year ago, the applicant had to come back to the Board to ask for further relief for the siting of the HV AC unit in the setback. The Board continued to question why this HV AC unit had to be sited in the easterly setback when there is adequate space to site the unit along the westerly side ofthe dwelling without the unit encroaching into the setback. 5. Accordingly, at the hearing on April 11, 2008, a motion to grant the requested Special Permit to allow for the siting ofthe HV AC unit in the easterly setback was made based on the finding that granting the requested extension of the pre-existing, non-conforming structure on the Locus will not be substantially more detrimental than the existing non-conforming structure to the neighborhood and, therefore, there are sufficient grounds upon which to base a grant of special permit. Upon a motion duly made and seconded to grant the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33A(1) from the regulations in Zoning Bylaw Section 139-16(C)(1), there was one (1) vote in favor and four votes in opposition (Wiley, Koseatac, Toole, Tupper). Therefore, Special Permit relief is hereby DENIED. Additionally, a motion to approve the requested relief and grant the requested Variance to allow for the HV AC unit to be sited in the easterly setback was made based on the finding that owing to circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the applicant, and the granted relief would not cause substantial detriment to the public good and would not substantially derogate from the intent of the bylaw. Upon a motion duly made and seconded to grant the requested relief by VARIANCE under Nantucket Zoning Bylaw Section 139-32 from the regulations in Zoning Bylaw Section 139-16(C)(1), there was one (1) vote in favor and four votes in opposition (Wiley, Koseatac, Toole, Tupper). Franco and Kim D. Franco with a mailing address of 10610 Barons Court, Vero Beach, Florida 32963, Board of Appeals File No. 083-07, the Board made the following Decision: 1. The Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law Section l39-33A (alteration/expansion of a pre-existing nonconforming structure/use), specifically Section 139-33A (5) and Section 139-33A (9). In addition Applicants are seeking relief by VARIANCE pursuant to Nantucket Zoning By-law Section 139-32 from the requirements of Section 139-16A (Intensity regulations _ setback). Applicants propose to renovate the existing structure in order to comply with flood plain regulations by constructing a new foundation. The structure would be removed from the property and replaced on the new foundation. There is no increase in ground cover proposed. The structure would also be relocated on the lot by moving it in an easterly direction. The nonconforming westerly side yard setback intrusion would be corrected and the building relocated so as to meet both the westerly and easterly five-foot side yard setback requirements. The front of the structure currently encroaches into the layout of Still Dock. and the structure would be moved so as to be entirely contained within the boundary lines of the lot. The structure would be sited as close as about 3.4 feet from the rear yard lot line and is currently sited as close as about 3.8 feet in a district that requires a minimum rear yard setback of five feet. The locus is also nonconforming as to lot size with the lot containing about 1,531 square feet oflot area in a district that requires a minimum lot size of 5,000 feet; as to frontage with the lot having about 33 feet of frontage along Still Dock in a district that requires a minimum frontage of 40 feet; as to ground cover ratio with the lot containing about 48.4% in a district that allows a maximum of 30% for undersized lots; and as to parking with no parking having been provided on site and none is planned. To the extent necessary, the Applicants are therefore seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law Section 139-18 to waive the required parking space for the structure. The Premises are located at 10 STILL DOCK, Assessor's Map 42.3.1, Parcel 83, and are shown upon Land Court Plan 10223-C as Lot 6 and are located in the Residential- Commercial zoning district. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation, as the matter was not of planning concern. There were no letters received regarding this matter. There were no area residents present who spoke in favor of or in opposition to the Application. 3. Based upon the foregoing, the Board finds that the moving of the structure off the lot to allow the construction of a new foundation in compliance with flood plain regulations and moving of the structure in an easterly direction, but in compliance with the easterly side yard set back of five (5') feet and removing the existing intrusion into the westerly setback and creating compliance with the westerly side yard set back of five (5) feet is not substantially more detrimental to the neighborhood thari the existing nonconforming structure. 4. Based upon the foregoing, the Board finds that the structure which currently encroaches onto Still Dock by approximately .4'+/- will be relocated on the lot completely within the property boundary lines. Due to the size and shape of the lot and structure, the relocation of the structure will push the structure to the rear or northerly portion of the lot, creating a more non-conforming set back of approximately .4' +/_ in a zone which requires a five (5') foot set back. The Board finds that there are circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located: to wit, the property is subject to flood plain regulations, is a pre-existing undersized lot with a pre-existing structure which exceeds current permitted ground cover, and the structure encroaches onto Still Dock. A literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the Applicant and the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such bylaw. If Variance relief is not granted the Applicant would be forced to construct a new foundation encroaching into the way. The northerly set back relief is deminimus and cannot be avoided if the structure is moved back within the lot lines and has no detrimental impact. 5.Accordingly, by UNANIMOUS vote in favor (O'Mara, Waine, Toole, Wiley, and Botticelli the Board GRANTS the requested relief by V ARIANCE may be granted pursuant to Nantucket By-law Section 139-32 from the requirements Section 139-16A (Intensity regulation - setback), to allow the s~cture to be located approximately 3.4+/- feet from the northerly lot line substantially as shown on a "Plot Plan to Accompany Board of Appeal Application" dated July 25, 2007 by Blackwell & Associates, Inc.; relief by SPECIAL PERMIT may be granted pursuant to Nantucket Zoning By-law Section 139-33A (alteration/expansion ofa preexisting nonconforming structure/use), specifically Subsection (9); , and relief by SPECIAL PERMIT may be granted pursuant to Nantucket By-law Section 139-18, the Board finding that by waiving the required parking space for the structure is in hannony with the general intent and purpose and intent of the Zoning By-law and is not substantially more detrimental to the neighborhood, but a nonconforming on-site parking space along the westerly property line is not hereby prohibited. The above relief is granted upon the following conditions 1. The structure shall be sited in substantial conformance with the "Plot Plan to Accompany Board of Appeal Application" dated July 25, 2007 by Blackwell & Associates, Inc., a copy of which is attflched hereto as Exhibit A; 2. Any exterior work that relates to this proposed project should be done between October] 5 and May 15 of any given year; 3. Construction shall be performed using all reasonable methods to protect the integrity of the abutting properties and Still Dock; 4. If the Structure is moved off the site onto Still Dock during construction' of the foundation, it shall be located so as not to impede traffic on Still Dock and shall not remain on Still Dock for more than thirty (30) days; and 5. The property is located at 10 Still Dock, Nantucket, Map 42.3.1, Parcel 83 and is zoned Residential Commercial. The lot as currently constituted was in existence prior to July 27, 1972. The structure has been relocated and renovated in accordance with the prior Board of Appeals Decision No. 83-07 in order to comply with flood plain regulations. The Applicants removed the structure during construction of the foundation and replace the structure on the new foundation. There was no increase in ground cover of the structure. Special Permit relief pursuant to Section 139 - 33A (9) to allow the structure to be removed and reconstructed on the lot was granted in the prior Decision. The structure which previously encroached onto Still Dock by approximately .4'+/- is located completely within the property boundary lines. The Applicants relocated the structure on the lot by sliding it in a westerly direction on the lot. After the relocation, the structure complies with the zoning set back on the easterly side and continues to conform to the westerly set back requirement of 5', however with such relocation, the propane tank and HVAC system were pushed into the easterly setback as shown on the Plot Plan by Blackwell & Associates, Inc. dated July 25,2006, revised April 2, 2008. The Board may specifically find that owing to circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the Applicant and the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such bylaw. Franco and Kim D. Franco with a mailing address of 10610 Barons Court, Vero Beach, Florida 32963, Board of Appeals File No. 083-07, the Board made the following Decision: 1. The Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law Section 139-33A (alteration/expansion of a pre-existing nonconfonning structure/use), specifically Section 139-33A (5) and Section 139-33A (9). In addition Applicants are seeking relief by VARIANCE pursuant to Nantucket Zoning By-law Section 139-32 from the requirements of Section 139-16A (Intensity regulations _ setback). Applicants propose to renovate the existing structure in order to comply with flood plain regulations by constructing a new foundation. The structure would be removed from the property and replaced on the new foundation. There is no increase in ground cover proposed. The structure would also be relocated on the lot by moving it in an easterly direction. The nonconfonning westerly side yard setback intrusion would be corrected and the building relocated so as to meet both the westerly and easterly five-foot side yard setback requirements. The front of the structure currently encroaches into the layout of Still Dock. and the structure would be moved so as to be entirely contained within the boundary lines of the lot. The structure would be sited as close as about 3.4 feet from the rear yard lot line and is currently sited as close as about 3.8 feet in a district that requires a minimum rear yard setback of five feet. The locus is also nonconfonning as to lot size with the lot containing about 1,531 square feet of lot area in a district that requires a minimum lot size of 5,000 feet; as to frontage with the lot having about 33 feet of frontage along Still Dock in a district that requires a minimum frontage of 40 feet; as to ground cover ratio with the lot containing about 48.4% in a district that allows a maximum of 30% for undersized lots; and as to parking with no parking having been provided on site and none is planned. To the extent necessary, the Applicants are therefore seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law Section 139-18 to waive the required parking space for the structure. The Premises are located at 10 STILL DOCK, Assessor's Map 42.3.1, Parcel 83, and are shown upon Land Court Plan l0223-C as Lot 6 and are located in the Residential- Commercial zoning district. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no 122268 recommendation, as the matter was not of planning concern. There were no letters received regarding this matter. There were no area residents present who spoke in favor of or in opposition to the Application. 3. Based upon the foregoing, the Board fInds that the moving of the structure off the lot to allow the construction of a new foundation in compliance with flood plain regulations and moving of the structure in an easterly direction, but in compliance with the easterly side yard set back of five (5') feet and removing the existing intrusion into the westerly setback and creating compliance with the westerly side yard set back of five (5) feet is not substantially more detrimental to the neighborhood than the existing nonconforming structure. 4. Based upon the foregoing, the Board fInds that the structure which currently encroaches onto Still Dock by approximately .4'+/- will be relocated on the lot completely within the property boundary lines. Due to the size and shape of the lot and structure, the relocation of the structure will push the structure to the rear or northerly portion of the lot, creating a more non-conforming set back of approximately .4' +/_ in a zone which requires a five (5') foot set back. The Board finds that there are circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located: to wit, the property is subject to flood plain regulations, is a pre-existing undersized lot with a pre-existing structure which exceeds current permitted ground cover, and the structure encroaches onto Still Dock. A literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the Applicant and the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such bylaw. If Variance relief is not granted the Applicant would be forced to construct a new foundation encroaching into the way. The northerly set back relief is deminimus and cannot be avoided if the structure is moved back within the lot lines and has no detrimental impact. 5.Accordingly, by UNANIMOUS vote in favor (O'Mara, Waine, Toole, Wiley, and Botticelli the Board GRANTS the requested relief by VARIANCE may be granted pursuant to Nantucket By-law Section 139-32 from the requirements Section 139-16A (Intensity regulation - setback), to allow the structure to be located approximately 3.4+/- feet from the northerly lot line substantially as shown on a "Plot Plan to Accompany Board of Appeal Application" dated July 25,2007 by Blackwell & Associates, Inc.; relief by SPECIAL PERMIT may be granted pursuant to Nantucket Zoning By-law Section I39-33A (alteration/expansion of a preexisting nonconforming structure/use), specifically Subsection (9); , and relief by SPECIAL PERMIT may be granted pursuant to Nantucket By-law Section 139-18, the Board fInding that by waiving the required parking space for the Structure is in harmony with the general intent and purpose and intent of the Zoning 122268 By-law and is not substantially more detrimental to the neighborhood, but a nonconforming on-site parking space along the westerly property line is not hereby prohibited.
