DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, April 11, 2008, at 1:00 P.M., in the
Conference Room at 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following decision on the application of Fish
Stix, LLC, Josh Harde, Manager c/o Sarah F. Alger, Attorney, 2
South Water Street, Nantucket, Massachusetts 02554, File No. 021-
08:
2. Applicant is seeking Special Permit relief pursuant to
Zoning By-law ~139-9B(2) (i) (food processing, manufacturing and
packaging) and Zoning By-law ~139-9B(2) (0) (take out food
establishment) to create a gourmet food store with pre-packaged
foods and goods for take out sales. Applicant is also seeking a
Special Permit to waive the requirements of the following Zoning
By-law Sections: ~139-18B (2) (Off-street parking requirements)
and ~139-20 (off-street loading facilities).
The Premises is located at 3 Salem Street, shown as Tax
Assessor's Map 42.3.1, Parcel 183, and is shown as Lot C on Land
Court Plan No. 8580-A. The locus is located in the RCDT zoning
district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board indicated
that this matter was not of planning concern. There were no
letters in the file and no opposition presented at the public
hearing.
4. Applicant has leased the Premises and intends to operate
a gourmet take-out food store featuring pre-packaged food and
goods made with ingredients primarily from regional and local
producers such as Bartlett's and Moors End farms. The meals will
be processed and packaged at the Premises. Under By-law ~~139-
9B(2) (i) and 9B(2) (0) these uses are allowed provided the Board
finds that they are not substantially more detrimental to the
neighborhood and that they are not injurious, offensive,
obnoxious, dangerous or a nuisance to the neighborhood as a
result of noise, odors, fumes or other objectionable feature
detrimental to the neighborhood health, safety, convenience
morals or welfare. Since the Applicant does not intend to have
and hoods of fans blowing out in to the street, he does not
anticipate creating noise or odors that could be a nuisance to
his neighbors. Furthermore, as the Applicant will be servicing
the boat basin and the downtown district with a need not
previously existing in those areas, he is serving a need in the
communi ty. A gourmet food store is consistent with the other
uses in an intensely commercial neighborhood that includes the
Grand Union Supermarket, numerous retail stores as well as the
current NRTA bus transfer area and, as a result, could not be
considered more detrimental than those other commercial uses. A
grant of Special Permit relief for take-out sales is consistent
with the commercial character of the downtown area and other
permits granted by the Board.
5. Under By-law ~139-18, five spaces would be required for
the one take-out station proposed for the Premises, one space
would be required for the 280 feet of storage on the second floor
and one space would be required for the four employees at any
peak time. Since 1976, the Premises has been operated as Barry
Thurston's Tackle Shop. Under the Zoning By-law in effect in
1976, this retail use required three parking spaces: one for the
720 square feet of retail space (one per 500 square feet was
required); one for the employees (assuming 3 or fewer employees
at a peak shift), one for the storage of 280 square feet and one
for the vehicle customarily used in the operation of the business
(assuming only one car would be required for the owner). Since
the proposed use would require seven parking spaces and the
Premises is grand fathered for four spaces, the Applicant is
seeking a waiver of three spaces. Under the 1976 Zoning By-law,
one loading zone was required. The Premises has never had a
loading zone, therefore, it is grandfathered for the lack of
loading. The Board finds that the Premises cannot accommodate
off-street parking and loading. These requirements are
tradi tionally waived for businesses in the downtown area. A
grant of relief would not be contrary to sound traffic and safety
considerations and the waiver of parking and loading would be in
harmony with the general purpose and intent of the Zoning By-law.
6. Accordingly, for the reasons stated above, by UNANIMOUS
vote, the Board GRANTS the requested relief by SPECIAL PERMIT
under Nantucket Zoning By-law ~139-9B (2) (i) (food processing,
manufacturing and packaging) under By-law ~139-9B (2) (0) (take out
food establishment)and to waive two parking spaces under By-law
~139-18B(2) (Off-street parking requirements) and the loading
requirement under By-law ~139-20 (off-street loading facilities),
under the condition that the Premises may be open to the public
only during the hours of 7:00 A.M. to 10:00 P.M.

intentions fbr three salem street. I. am interested in doing a gourmet food store with home
made and pre packaged foods and goodslbr take out sales. 1 hope to use Bartlett and

COMMERClM, MANAGEMENT AGREEMENT
This AGREEMENT is dated as of the 1st day of July, 2005, by and between AP-WEM
NANTUCKET OF, LLC a Delaware Limited Liability Company C"Owner") and Wintbrop
Management, LP, a Delaware limited partnership ("Manager").
WITNESSETH:
WHEREAS, Owner is the owner of that certain real property and improvements located
at 3, 5, 7 and 9 Salem Street and the location known as the Tank Fann all located in Nantucket,
Massachusetts (such property, together with all improvements now or hereafter located thereon
and all personal property necessary for the use and enjoyment of such improvements, being
hereu1after refelTed to collectively as the "Property");
WHEREAS, Manager is an experienced and qualified manager ofreal estate; and
\VHEREAS, Owner desires to engage Manager to lease, manage and operate the
Property.
NOW, THE.R.:EFORE, in consideration oflhe premises the parties agree as follows:
ARTICLE L COMMENCEMENT AND TERMlNATION DATES
The term of this Agreement shall commence as of the date hereof and shall continue in
full force and effect until the first anniversary of the date hereof and shall be automatically
extended for successive one (I) year periods thereafter.
ARTICLE 2. MANAGER'S RESPONSmn..rrIES
2.1 Mana~ement. Owner hereby appoints Manager as the sole and exclusive agent for
the management of the Property as Owner reasonably may deem advisable and on the lerms and
conditions set forth herein. Manager shall perform its responsibilities in an efficient and
satisfactory manner and shall arrange the performance of any and all services required to be
performed for the benefit of the tenants of the Property, subject to: (a) the budgets, policies and
limitations imposed by the Owner, ~d (b)' applicable law and rulings and orders of governmental
authorities having jurisdiction. All seIVices shall be performed in a diligent and professional
manner in accordance with recognized standards of the property management industry. Manager
shall act in a fiduciary capacity with respect to Lhe proper protection of and accounting for
Owner's assets.
2.2 EmI:!lovees. Manager shall employ at all times a sufficient number of experienced
and qualified employees to enable Manager to perfonn its duties as set forth herein. In addition,
Manager shall be pem1itted to retain such third-party consultants as it deems advisable in
connection with the performance of its duties hereunder; provided, however, except as otherwise
provided herein, in no event shall Owner be liable for any amounts owing to such third party and
Manager shall indemnify Owner and hold Owner harmless from any and such fees. All matters

A PUBUC HEARING of the NANTUCKET ZONING BOARD OF APPEALS is scheduled for
1:00 PM April 11, 2008 in the Conference Room at 2 Fairgrounds Road, Nantucket, MA, 02554.

Fairgrounds Road, Nantucket, MA 02554 between the hours of 8:30 AM. and 4:30 P.M., Monday
