At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, April II, at 1:00 P.M., in the Conference Room, at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of HARRY T. REIN and SUSAN D. REIN, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 018-08: 2. The applicants are requesting that the Special Permit issued by the Board of Appeals in File 116-07 be modified as to condition 5(a), in order to allow the garage addition authorized thereby to be constructed approximately eighteen (18) inches taller in elevation that the existing garage structure. The locus is situated at 1 HENRY STREET, Assessor's Map 29, Parcel 68, is shown upon a plan recorded with Nantucket Deeds in Plan Book 24, Page 3, and is situated in a Residential-1 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matter of planning concern was presented. There was no support nor opposition presented at the public hearing. 4. The decision in File No. 116-07 granted a Special Permit for an addition to the pre-existing, nonconforming garage upon the locus, on the basis that it would not be substantially more detrimental to the neighborhood than the existing nonconformity. This was granted upon the condition that the height of the addition not be higher than the existing building. In fact, the plans for the addition, which have been approved by the Nantucket Historic District Commission ("HDC") under Certificate of Appropriateness No. 51482, show that the addition will be eighteen (18) inches higher than the existing garage structure. Accordingly, the applicants request that the condition limiting the height to the elevation of the existing structure be removed. The elevation above mean high tide datum of 1934 (the standard for measurement of elevation on an absolute basis) of the ridge 1 of the existing garage is, according to the applicant's surveyor, 18.55 feet. 5. In the absence of opposition, and in the light of the small increase in height that is requested by the applicant, the majority of the Board of Appeals considered that the proposed increase would not have a detrimental effect upon the neighborhood, and that this modification would be consistent with the findings made by the Board of Appeals in the original decision. 6. Accordingly, by a vote of four members in favor (Koseatac, Wiley, Tupper and Botticelli) and one opposed (Toole), the Board of Appeals made the finding that the work allowed by the Special Permit, as modified as set forth below, would not be substantially more detrimental to the neighborhood than the pre- existing, nonconforming conditions, and by the same vote of four members in favor and one opposed, GRANTED the requested modification of the decision in File No. 116-07, by striking condi tion (a) in Paragraph 5 of the decision and replacing it with the following: ( a) The addition to the garage shall not elevation of 20.1 feet above the mean datum of 1934. exceed an high tide (b) The addition shall be constructed in substantial compliance with HDC Certificate of Appropriateness No. 51482.
