TOWN OF NANTUCKET ZONING BOARD OF APPEALS 2 FAIRGROUNDS ROAD NANTUCKET, MA 02554 Assessor's Map: 49 Parcel: 26.1 SR-2 71 Baxter Road Land Court Plan 17825-A, Plan Book 4, Page 46 Deed Reference: Book 162, Page 83 At a Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS held at 1 :00 p.m., Friday, April 11, 2008, in the Garage Area, 2 Fairgrounds Road, Nantucket, Massachusetts 02554 on the Application of John Merson and Carol Bunevich, of71 Baxter Road, PO Box 445, Siasconset, Massachusetts 02564, Board of Appeals File No. 017-08, the Board made the following decision: 1. Applicant is seeking Variance relief pursuant to Zoning Bylaw section 139-32 (Variances) from Zoning Bylaw section 139-16 (Intensity Regulations) in order to re-site the dwelling away from the eroding coastal bluff. The Applicant is proposing to remove the garage/cottage and place the main dwelling on the site of the removed garage/cottage. The structure will be sited no closer than ten (10) feet from the layout of Baxter Road. The site is located at 71 Baxter Road is shown on Nantucket Tax Assessor's Map 49 as Parcel 26.1, is shown on Land Court Plan 17825-A, and is recorded at the Nantucket County Registry of Deeds in Book 162, Page 83. 2. The Decision is based upon the Application and the material submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation, as the matter was not of planning concern. There were no letters on file in favor of or in opposition to the Application. No opposition was expressed at the Hearing. 3. Locus is a pre-existing nonconforming lot of record having a total ground cover ratio of 24.4% in a zoning district that requires 12.5%. The structures predate zoning as they were constructed in 1940. By removing the existing garage/cottage and relocating the primary dwelling, the Applicant will be reducing his ground cover to 10.1 % and conforming to the ground cover ratio required in the SR-2 Zoning District. Additionally, the locus is nonconforming as to the front yard setback. Presently, the garage/cottage is sited 2.5 feet from the front yard lot line. The Zoning District requires a 30 foot front yard setback. Upon removal of the garage/cottage and re-siting of the primary dwelling, the primary dwelling will be sited no closer than ten (10) feet from the front yard lot line. The existing locations of the house and garage on the site, as well as the proposed relocation of the house, are shown on the attached Site Plan prepared by Nantucket Surveyors, LLC, dated March 6, 2008, a copy of which is attached hereto as Exhibit "A". 4. Therefore, the Board specifically finds that due to the topography of the lot and the proximity of said eroding coastal bank, and especially affecting this Property and not generally the zoning district in which the Locus is situated, that a literal enforcement of the provisions of Section 139-16A of the Nantucket Zoning Bylaw would involve substantial hardship, financial and otherwise, to the Applicant and that relief would be in harmony with the general purpose of the Zoning Bylaw and may be granted without substantially derogating from the intent of the Bylaw and, as such, there are sufficient grounds upon which to base a grant of variance. 8. Accordingly, by a UNANIMOUS VOTE, the Board grants the V ARIANCE under Nantucket Zoning Bylaw Section 139-32 from the intensity regulations in Nantucket Zoning Bylaw Section 139-16(C)(1) to alter the pre-existing, nonconforming structures on the locus and to reduce the westerly front yard setback distance from thirty (30) feet to ten (10) feet to allow the relocation of the single-family dwelling as proposed upon the following conditions: (a) The relocation shall be done in substantial conformance with Exhibit "A"; and (b) No construction will take place between June 1 and September 15.
