DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, May 9, 2008, at 1:00 P.M., at 2 Fairgrounds
Road, Nantucket, Massachusetts, the Board made the following
decision on the application of KEVIN C. WERLE AND WENDY E. WERLE,
11 Old Stone Crossing, West Simsbury, Connecticut 06092, File No.
016-08:
2. Applicant is seeking Special Permit relief pursuant to
Zoning Bylaw section 139-33A (pre-existing nonconforming lots),
or in the al ternati ve Variance relief pursuant to Zoning Bylaw
section 139-32 (Variances). Applicant is seeking Variance relief
from Zoning Bylaw section 139-16 (Intensity Regulations) to
reduce the rear yard setback from five (5) feet to three (3) feet
to validate location of the existing structure (single family
dwelling with attached deck with steps, outdoor shower and refuse
bin), to reduce the front yard setback from thirty-five (35) feet
to thirty (30) feet to validate the location of the existing
garden shed, and to increase the ground cover from 1,500 square
feet to 1,803 square feet. In the alternative, the applicant is
seeking Special Permit relief from Zoning Bylaw Section 139-
16(C)2 to validate the unintentional setback intrusion no closer
than four (4) feet to the north lot line and allow Applicant to
modify the outdoor shower and refuse bin siting.
The site is located at 80 Sankaty Road, is shown on
Nantucket Tax Assessor's Map 49 as Parcel 114, is shown in Plan
Book 5, Page 14, and applicant's title deed is recorded at the
Nantucket County Registry of Deeds in Book 1115, Page 82.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There was no opposition or support from the
public presented at the public hearing.
4. As presented by counsel at the public hearing, the
applicant requests to have the intensity benefits of the R-2
zoning district. The applicant noted that in order to re-zone
his property, the appropriate avenue would be through a Town

ZBA decisions, maps) that indicate the locus was incorrectly
classified as R-2.
Part of the applicant's desire to reclassify the property as
R-2 pertains to the nature of this property and the zoning
classification of the abutting properties. The applicant
submitted a GIS image showing the two zoning districts in the
applicant's neighborhood. The first image showed the applicant's
parcel relative to the R-2 zoned parcels to the south and east of
his lot and the LUG-3 zoned parcels above his lot. The
applicant, and those parcels abutting the applicant to the north,
are zoned LUG-3 and are owned by Sankaty Head Golf Club. The
applicant is one of the few residential properties in Siasconset
not to be zoned as R-2. Because of the location of the property,
the applicant contended that owing to the circumstances related
to the conditions of the land and structures, a literal
enforcement of the provisions of Nantucket Zoning Bylaw Section
139-32 would involve substantial hardship and desirable relief
may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the
intent or purpose of said bylaw.

to validate the location of the existing garden shed, with the

owners of the residential property now known and numbered as 80 Sankaty Road, Siasconset,
Massachusetts, (Lots 4 and A, Plan Book 5, Page 14), as evidenced by a deed recorded at the
Nantucket Registry of Deeds on November 29,2007, in Book 1115, Page 82, (hereinafter referred to as
the "Property/Locus"). The Property/Locus is a pre-existing nonconforming "lot of record" and
contains 14,430::!: square feet of land area. The Property/Locus has 80.00 feet of frontage on Sankaty
Road. The Property/Locus is located in the Limited Use General-3 (LUG-3) Zoning District.

HISTORY - ZONING BOARD OF APPEALS
1. (ZBA File No. 105-86) On October 15, 1981, in accordance with the provisions
under Nantucket Zoning By-laws, Section 7-C 1.f., and in consideration for the issuance of a building
permit, a residency Covenant was recorded at the Nantucket Registry of Deeds in Book 186, Page 108,
restricting the use of the single family dwelling proposed to be constructed on the Property/Locus as
follows: (a) owner occupied; (b) used as year-round residence; (c) not offered for seasonal rental; (d) in
full force and effect for a period of not less than five (5) years; and (e) binding upon the future owners
ofthe Property/Locus for the term thereof. On October 9, 1986, the Zoning Board, in File No. 105-86,
issued a Special Permit granting relief and terminating the aforesaid Covenant and recorded the Special
Permit at the Nantucket Registry of Deeds in Book 260, Page 343.
2. (ZBA File No. 037-85) On May 16, 1985, the Zoning Board, in File No. 037-85,
issued a Special Permit, under Nantucket Zoning By-laws Section 5.3 (codified as Section 139-l6C),
granting relief under Section 7F (codified as Section 139-33) by reducing the ten (10') foot north side
lot line setback to five (5') feet and recorded the Special Permit at the Nantucket Registry of Deeds in
Book 230, Page 82.
HISTORY - ZONING CLASSIFICATION
The subject Property/Locus is a "lot of record" and contains 14,430 square feet ofland area.
The Property/Locus was originally located in the Residential-l (R-l) Zoning District which required a
minimum lot area of 5,000 square feet, frontage of 50 feet, front yard setback of 10 feet, rear and side
yard setback of 5 feet, and maximum ground cover ratio of 30%. At the Annual Meeting of the Town
of Nantucket in 1984, the Siasconset area of Nantucket Island where the Property/Locus is located was
re-zoned/up-zoned to Residential-2 (R-2) and Limited Use General-3 (LUG-3) Zoning Districts. The
Property/Locus was considered located in the up-zoned R-2 Zoning District as evidenced by
subsequent applications for building permits, survey plans and Zoning Board of Appeals Decisions.
The Property/Locus, similar to other "lots of record" in the surrounding area, was intended to be
included in the up-zoned R-2 Zoning District and treated accordingly. [See supporting materials
attached to the Application herewith.]
A review of the records at the Nantucket Building Department and Zoning Board of Appeals
shows that the Property/Locus was considered to be located in the R-2 Zoning District. Prior to the
1984 re-zone/up-zone, an application for Building Permit No. 2080-81, dated October 28, 1981
(dwelling), was issued based upon an application and supporting materials which referenced the
Property/Locus as located in the R-l Zoning District. After the 1984 re-zone/up-zone an: (i)
application for Building Permit No. 3946-85, dated February 15, 1985 (addition to dwelling), was
issued based upon an application and supporting materials which referenced the Property/Locus as
located in the R-2 Zoning District; and an (ii) application for Building Permit No. 677-04, dated May
11, 2004 (garden shed), was issued based upon an application and supporting materials which
referenced the Property/Locus as located in the R-2 Zoning District.
Additionally, after the 1984 re-zone/up-zone, the Zoning Board issued Decisions in File No.
037-85 and File No. 105-86, and published Notices for public hearing on the separate applications
submitted in the aforesaid Zoning Board cases, which referenced the Property/Locus as located in the
R-2 Zoning District.
Notwithstanding, there appears to be confusion as to whether the Property/Locus was
inadvertently located, at the time ofthe re-zone/up-zone in 1984, or thereafter, in the LUG-3 Zoning
District and not the R-2 Zoning District. Relevant Town of Nantucket maps (1978 Schofield Brothers,
Inc.; 1986 Barrett & Nicholson; 2004 GIS Map) appear to show the Property/Locus as having been re-
zoned/up-zoned from the R-l Zoning District to the LUG-3 Zoning District.
REQUEST FOR SPECIAL PERMITN AffiANCE RELIEF - ZONING BOARD OF APPEALS
I. Applicant is seeking relief from the Zoning Board requesting the Zoning Board to find
and determine that Applicant's Property/Locus was intended to be included in the R-2 Zoning District
and should be treated as a lot located in the R-2 Zoning District, similar to the other "lots of record" in
the surrounding area, and grant to Applicant the benefit of the zoning requirements provided under the
Nantucket Zoning By-laws, Section 139-16A, as to lots located within the R-2 Zoning District.

II. Applicant is seeking further relief from the Zoning Board as follows:
1. Dwelling: Variance relief under Nantucket Zoning By-law Sections 139-33
and 139-32A, to reduce the rear yard setback distance from 5.0 feet to 3.0 feet and
validate the existing dwelling with attached deck with steps, outdoor shower and refuse
bin.
In the alternative, grant Special Permit relief under Nantucket
Zoning By-law Section 139-16C(2) to validate the unintentional setback intrusion
(deck with steps) no closer than 4.0 feet to the Property/Locus rear (north side) lot line
and allow Applicant to modify the outdoor shower and refuse bin siting such structures
no closer than 4.0 feet from the Property/Locus rear lot line.
2. Garden Shed: Variance relief under Nantucket Zoning By-law Sections 139-33
and 139-32A to reduce the front yard setback distance from 35 feet to 30 feet (front
yard setback for R-2 Zoning District) and validate the siting of the existing garden shed
constructed on the Property/Locus.
[*NOTE: No Variance relief is required for the garden shed in the event the Zoning
Board grants the Applicant's request for the Zoning Board to find and determine that
the Property/Locus should be included and treated as a lot situated in the R-2 Zoning
District, for purposes of zoning requirements, under Section 139-16A.]
3. Ground Cover Ratio: Variance relief under Nantucket Zoning By-law Sections
139-33 and 139-32A, increasing the ground cover ratio from 1,500 square feet (lot of
record containing at least 5,000 square feet) to 12.5% ofthe area of the Property/Locus
(ground cover ratio for R-2 Zoning District) equal to 1,803 square feet.
[*NOTE: No Variance relief is required for the ground cover ratio in the event the
Zoning Board grants the Applicant's request for the Zoning Board to find and
determine that the Property/Locus should be included and treated as a lot situated in the
R-2 Zoning District, for purposes of zoning requirements, under Section 139-16A.]
Applicant states that the Town of Nantucket unintentionally and inadvertently re-zoned/up-
zoned the subject Property/Locus to the LUG-3 Zoning District. The Property/Locus, by all
indications and historical records, was intended to be included and considered up-zoned to the R-2
Zoning District and prior survey plans were drawn, building permits were issued and Zoning Board
relief was granted in acknowledgment and reliance upon the Property/Locus found to be located in and
treated as a lot within the R-2 Zoning District.
Taking into consideration the shape and size of the Property/Locus, the Applicant's rights and
enjoyment in the use of the Property/Locus, and any desired improvements thereto, are adversely
impacted by the inadvertent zoning classification of LUG-3. Applicant suffers an unfair and
inequitable disparity in treatment from the other surrounding/abutting "lots of record" in the R-2
Zoning District and would require Applicant to re-site the existing garden shed and significantly limit
the ground cover available under Section 139-16A.
Applicant believes that granting the relief requested in the Application before the Zoning Board
would be in harmony with the zoning requirements for the other improved residential "lots of record"
in the surrounding area which were re-zoned/up-zoned to the R-2 Zoning District in 1984. Moreover,
Applicant maintains that an enforcement of the LUG-3 zoning requirements in which the
Property/Locus is located would cause substantial hardship to the Applicant, financial and otherwise;
whereas, the granting of such relief by the Zoning Board would not be a substantial detriment to the
neighborhood and public good as provided under Sections 139-32A and 139-33.
For the foregoing reasons, the Applicant respectfully requests the Zoning Board to grant the
relief requested herein, which determination and decision would be in keeping with the intent and
belief of the Town of Nantucket departments that previously included and considered the
Property/Locus to be located in the R-2 Zoning District by the prior issuance of building permits and
granting of zoning relief

Registry of Deeds on November 29,2007, in Book 1115, Page 82 (hereinafter referred to as the
"Property") .

at 1:30 p~m. in the Town and County Building, Nantucket, rendered the
followin~ decision in the Application of JAMES G. TYLER (037-851 whose
address is Sankaty Avenue, Siasconset, MA.

1. This is an Application for a SPECIAL PERMIT under Zoning By-Lnw
SECTION 5.3 ( side lot setback rPoQuction by Special Permit-codified as
Section 139-16C). If granted, A~plicant would be allowed to complete con-
struction ~f an addition to his Single-family dwelling despite eocr08chment .
on the normally-required ten-foot side lot line setback. The premises are
located 00 SANKATY AVENUE, SIASCONSET, Plan 12-F, bounded by Isobel's Way
00 the south and west sides and the Sankaty Head Golf Cours. on the nOrth
side. the side adjacent the addition. The zoning district is RESIOENTIAl-2.
2. Based upon the App1icd t~on and a plan, representations and test-
imony submitted at the heaFing, ;pplicant commenced construction of an add-
ition to his principal dwelling ;0 accomodate a growing family. The en-
croachl\K!nt VIIS discovered from a r.,"nt.gage plot plan after a survey. Con-
struction was done in 1982 pursua~~ to a 1981 building permit. Exist1ng
roof planes constrained location of the addition proximate the north lot
11ne, about 5 feet or more removed.
3. No opposition to Applicant vas voiced. Nothing in our record in-
dicated construction vas actually extended lnto the setback in disregard
or contravention of the by-Law.
4. The Planning Board made no rec~endatlon due to sparcity of in-
formation before them.

I, Ann-Charlotte Ljung Krantz, hereby depose and say:
1. I am an individual and reside at Bonita Springs,
Florida.

I make this affidavit of my own personal knowledge and
3. My late husband, Robert A. Krantz, and I, purchased the
property at 80 Sankaty Road, being shown as Lot 4 and Lot A on
said plan recorded with Nantucket Deeds in Plan Book 5, Page 14
(the "Premises") on November 3, 1986.
4. There currently exists upon the Premises two
structures, being a single-family dwelling and a garden/shed, as
shown upon the plan attached hereto.
5. With the exception of the outdoor shower, at the time we
purchased the property, the single-family dwelling, including all
decks and steps appended to it, existed in the location shown on
the plan. The outdoor shower was built by my husband at least
fifteen years ago.
6. In June 2004, construction of the garden/shed was
commenced. Construction was completed over the course of the
next several months, but was delayed at times due to my husband's
last illness and subsequent death on December 18, 2004. To the
best of my recollection, the garden/shed was finished and ready
for use in the spring of 2005.
7. At all times during our ownership of the property, the
improvements upon the Premises have been continually used for
residential purposes by myself and my family members.
