1. At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1 :00 p.m.,
Friday, April 11, 2008, at 2 Fairgrounds Road, Nantucket, Massachusetts, on the Application of
DIETER BAEUCHLE of 7 Enterprise Circle, Nantucket, Massachusetts 02554, Board of
Appeals File No. 012-08, the Board made the following Decision:
2. Applicant is seeking Special Permit relief pursuant to Zoning Bylaw section 139-
30A(1) (Special Permits), or in the alternative Zoning Bylaw 139-32 section (Variances) from
the regulations in Zoning Bylaw section 139-16 (Intensity Regulations). The applicant is
proposing to add a second dwelling to his locus and is requesting to increase his ground cover to
13.3% in a district that allows 12.5%.
3. The Applicant is seeking relief from the Zoning Board of Appeals to allow for an
increase in ground cover for his lot. The site currently contains a single family dwelling unit and
the applicant has obtained Planning Board approval for a second dwelling unit and a second
driveway access. The site is located in the R-20 zoning district and currently has a ground cover
of 7.46%. Construction of the second dwelling as proposed would increase the ground cover of
the site to 13.4% in a zoning district that allows 12.5%.
4. At the April 11, 2008 meeting, the Applicant explained to the Board that the reason
for his request was that, in his opinion, a second dwelling unit that would have to conform to the
ground cover ratio in the R-20 zoning district would be too small. Staff noted that the footprint
of the proposed second dwelling unit is approximately 1220 square feet. If the applicant reduced
the footprint of the proposed second dwelling unit by approximately 186 square feet, special
permit relief would not be necessary. Staff recommended denying the Application as there was
no basis for relief because the requested Special Permit would not be in harmony with the
general purpose and intent of the Zoning Bylaw. Staff also recommended the requested
Variance relief should be denied because the circumstances relating to the soil conditions, shape
or topography of such land or structures, a literal enforcement of the provisions of this chapter
would not involve substantial hardship, financial or otherwise, to the applicant, and the granted
relief would cause substantial detriment to the public good and would substantially derogate
from the intent of the bylaw. Staffwas of the opinion that because the Applicant is willfully
choosing to construct a structure that will increases the allowable ground cover ratio for the sole
reason that he would like a larger second dwelling, the Applicant is creating a self-imposed
hardship and does not meet the criteria set forth in the bylaw.
5. Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning Board made no
recommendation as the matter did not present any issues of planning concern. There were no
letters of support, nor any of opposition, from the neighbors. Accordingly, at the hearing on
April 11, 2008, a motion to grant the requested Special Permit relief to allow for an increase in
ground cover was made based on the finding that granting the requested Special Permit would be
in harmony with the general purpose and intent of the zoning bylaw. Upon a motion duly made
and seconded to grant the requested relief by SPECIAL PERMIT under Nantucket Zoning
Bylaw Section 139-30A(I) from the regulations in Zoning Bylaw Section 139-16(C)(I), there
were no votes in favor and five votes in opposition (Wiley, Koseatac, O'Mara, Toole, Botticelli).
Therefore, Special Permit relief is hereby DENIED.
Additionally, a motion to grant the requested Variance to allow for an increase in ground
cover was made based on the finding that owing to circumstances relating to the soil conditions,
shape or topography of such land or structures and especially affecting such land or structures
but not affecting generally the zoning district in which it is located, a literal enforcement of the
provisions of this chapter would involve substantial hardship, financial or otherwise, to the
applicant, and the granted relief would not cause substantial detriment to the public good and
would not substantially derogate from the intent of the bylaw. Upon a motion duly made and
seconded to grant the requested relief by V ARIANCE under Nantucket Zoning Bylaw Section
139-32 from the regulations in Zoning Bylaw Section 139-16(C)(I), there were no votes in favor
and five votes in opposition (Wiley, Koseatac, O'Mara, Toole, Botticelli). Therefore, Variance
relief is hereby DENIED.
