DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, April 11, 2008, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of SIASCONSET CASINO
ASSOCIATION, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 010-08:
2. The applicant requests a modification of the decision in
File No. 049-05, which modified earlier relief and approved the
alteration of structures and conditions upon the locus, including
construction of a fourth tennis court and reconfiguration of
parking in order to accommodate the additional tennis court. The
applicant has now performed the alterations and reconstruction of
the dwellings upon the locus, but has deferred the construction
of the tennis court for the time being. The Zoning Enforcement
Officer has taken the position that because the tennis court has
not been constructed and the parking has therefore not needed to
be reconfigured, the locus is not in conformity with the
additional relief and accordingly Certificates of Occupancy for
the work cannot be issued. Therefore, the applicant requests a
modification to the decision to affirm that the work that has
been done is in compliance with the decision, and that the
parking need not be reconfigured until and unless the additional
tennis court is constructed pursuant to the decision. The locus
is situated at 11, 13 and 15 NEW STREET, SIASCONSET, Assessor's
Map 73.4.2 as Parcels 67, 68 and 69, consists of lots shown on
plans of record as set forth in the caption above, and is in the
Sconset Residential-1 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern

were presented. There no was support nor opposition presented at
the public hearing.
4. The decision in File No. 049-05 modified earlier
decisions, and authorized the construction of an additional
tennis court upon the locus, with a reconfiguration of the
parking area to accommodate the new tennis court while providing
the required parking. Although the dwellings upon the locus were
taken into consideration in determining the amount of required
parking, no relief was required for them, and so long as their
parking requirements are accommodated by the present
configuration of the parking area, there is no necessity for the
parking to be rearranged as per the decision in File No. 049-05.
5. Accordingly, by UNANIMOUS VOTE, the Board of Appeals
voted to modify and clarify the decision in File No. 049-05, by
setting forth that the parking area upon the locus need not be
reconfigured unless and until the additional tennis court allowed
by that decision is constructed.
