At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, March 13, 2008, at 12:00 noon, in the Garage Area, 2 Fairgrounds Road, Nantucket, Massachusetts, 02554, the Board made the following decision on the application of ROBERT J. DEUBERRY and LORI A. DEUBERRY, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 006-08: 2. The applicants request a modification of the Special Permit issued by the Board of Appeals in File No. 024-05, as to condition (c), which required that the northerly portion of the new dwelling upon the locus not exceed 24 feet in elevation above mean grade, and that the rear portion not exceed 21 feet in elevation above mean grade. As constructed, because of the topography of the locus, this height limitation is exceeded. The applicants accordingly request that condition (c) be amended to provide that the northerly elevation not exceed 25 feet above mean grade. The locus is situated at 4 CHARTER STREET, Assessor's Map 42.3.2, Parcel 167, is shown upon plan recorded with Nantucket Deeds as Plan 02-39, and is in the Residential-Old Historic zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matter of planning concern was presented. An abutter wrote a letter in support; otherwise, there was no support nor opposition at the public hearing except for the presentation by the applicants' representatives. 4. As presented by the applicants, and as shown upon the "Topographic Building Location Plan" by Charles W. Hart and Associates, Inc., dated January 8, 2008, a copy of which is attached hereto as Exhibit A, the average mean grade of the subject structure is 55.2 feet, and the ridge of the roof at the front of the dwelling is 25.0 feet above mean grade. The 1 limitation height of 24 feet above mean grade, as expressed in the Decision in Case No. 024-05, evolved from the concern of an abutter as to the height of the structure. That abutter has now written a letter in support of the requested modification, after now having viewed the structure as built. 5. On the basis of this presentation, a maj ority of four members of the panel hearing this application, with one (Toole) opposed, voted to make the finding that the modification to the Special Permit would be in harmony with the purpose and intent of the Zoning By-law, and by the same vote of four members in favor and one (Toole) opposed, GRANTED the requested modification of the Special Permit, by amending condition (c) to provide that the northerly portion of the dwelling not exceed 25 feet above mean grade subject to the following condition: (a) The modification will be in substantial compliance with the plan entitled "Topographic Building Location Plan of Land in Nantucket, Mass." prepared by Charles W.
