At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, March 13, at 12:00 noon, at 2 Fairgrounds Road, Nantucket, Massachusetts, 02554, the Board made the following decision on the application of WHITNEY A. GIFFORD, as Trustee of 37 LIBERTY STREET NOMINEE TRUST, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 005-08: 2. The applicant proposes to place a new foundation under the pre-existing, nonconforming single-family dwelling upon the locus, which will increase the elevation of the structure above mean grade from about 32.6 feet to about 33.1 feet; maximum elevation above mean grade, as computed under the Nantucket zoning by-law, is 30 feet. The dwelling is also nonconforming as to northerly and easterly side and rear yard setbacks, with a deck sited at about 2.6 feet from the northerly property line and steps sited about 3.7 feet from the easterly property line; minimum side or rear setback in this district is five (5) feet. The applicant proposes to keep the deck and to expand it, with approximately one (1) square foot of the expansion being within the northerly setback, but no closer than the existing portion of the deck. The intrusion of steps into the easterly setback area would be eliminated. The locus is a pre-existing, nonconforming lot of record, containing about 4,700 square feet, in a district where the minimum lot area is 5,000 square feet. Accordingly, the applicant requests relief by Special Permit for the alteration of the pre-existing, nonconforming single-family 1 dwelling without creating any new zoning nonconformity, under Nantucket Zoning By-law ~139-33.A. The locus is situated at 37 LIBERTY STREET, Assessor's Map 42.3.3, Parcel 118, and is in the Residential-Old Historic zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony recei ved at our public hearing. There was no Planning Board recommendation, on the basis that no matter of planning concern was presented. The owners of both of the two abutting lots (which are owned by members of the same family) communicated to the Board of Appeals and to the applicant that they had no obj ection to the proposed work, provided that no exterior work would be performed during the summer. Except for the presentation by the applicant's legal and design representatives, no other support nor opposition was presented at the public hearing. 4. As presented by the applicant's representatives, the applicant proposes to place a new foundation under the existing dwelling, replacing the existing insufficient foundation. The applicant already has a building permit for this work, and work has commenced, but it has been determined that the elevation of the structure above mean grade, as computed under the By-law, will increase by less than one foot, and that the existing dwelling is already above the maximum elevation of 30 feet, being at present approximately 32.6 feet above mean grade. As part of the construction, the existing deck will be retained and rebuilt in its existing location, with an expansion which will (except for a small area) be outside the setback area. A reduced copy of a site plan by Blackwell & Associates, Inc., showing the existing conditions upon the locus, is attached hereto as Exhibit A-1; a reduced copy of a site plan by Blackwell showing the proposed conditions is attached hereto as Exhibit A-2. 5 . The Board of Appeal s , by UNANIMOUS vote " made the findings that the proposed work would intensify the existing nonconformities upon the locus (in that the existing nonconforming elevation above mean grade would be increased, and that the deck would receive a small expansion within the setback area), but that these alterations would not be substantially more detrimental to the neighborhood than the existing nonconformity, and by the same vote, GRANTED the requested relief by SPECIAL PERMIT under By-law ~139-33.A, for the alteration of the dwelling as proposed, subject to the following conditions: (a) No exterior construction shall between June 1 and September 15 in any year; be performed 2 (b) The structure shall be constructed in substantial compliance with site plan entitled "Existing Conditions Plot Plan to Accompany Board of Appeals Application" prepared by Blackwell and Associates, Inc. and dated February 8, 2008; and (c) The elevation of after the completion of the work above mean grade 33.5 feet.
