At a Public Hearing of the Nantucket Zoning Board of Appeals, held at 12:00 noon,
Thursday, March 13,2008, in the Garage Area of the Town Building located at 2 Fairgrounds
Road, Nantucket, Massachusetts, 02554, on the Application ofthe JOHN LAMPE, applicant
(Marilyn J. O'Rourke, owner), Board of Appeals File No. 004-08, the Board made the following
Decision:
1. Applicant is seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning
By-law Section 139-33A for the alteration and extension of a pre-existing nonconforming
structure and to the extent necessary, to modify Zoning Board of Appeals decision 119-92 and
009-93. Applicant proposes to construct an addition to the existing dwelling. The site is located
at 7 Old North Wharf, is shown on Nantucket Tax Assessor's Map 42.3.1 as Parcel 82, and is
shown on Land Court Plan 10223-B as Lot 1.
2. There were no letters in the file and the Planning Board made no
recommendation.
3. Applicant's counsel explained that applicant, JOHN LAMPE, was the contract
purchaser of this property. Mr. Lampe seeks a Special Permit allowing him to construct an
addition of up to 503 square feet of ground cover to the existing single family dwelling. The lot
is non-conforming having 3,615 square feet of area in a 5,000 square foot zone, the existing
building is also non-conforming and has the benefit of previous Board of Appeals relief in File
No. 119-92 and No. 009-93. Applicants proposed addition would comply with all setback
requirements and would bring the total ground cover ratio to 29::1:% in a district where 30% is
allowed for non-conforming Lots of record.
Counsel explained that plans are being reviewed by HDC and, most likely, will be
revised before HDC issues final approval. For this reason it is not possible to reference a
specific set of plans in any approval granted by the board.
Counsel explained that most of the surrounding properties were large residences
and this addition would be in keeping with the character of the neighborhood and the spirit and
intent of the By-law.
4. Based on the foregoing the Board finds that the proposed addition of up to 503
square feet of ground cover, will not be in violation of the spirit or intent of the By-law, will not
be more detrimental to the neighborhood than the existing non-conformity and would be
consistent with the previous two grants of relief by the Board of Appeals.

Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law
Section 139-33A(4) and (5) upon the following conditions:
1. The addition shall not exceed 503 square feet of new ground cover;
2. The addition shall comply with all set-back requirements of the
By-law;
3. There shall be no exterior construction permitted between June 1
and September 30 of any year; and
4. Construction will be in done in substantial compliance with the site
plan entitled "Plot Plan to Accompany Board of Appeals
Application in Nantucket, Mass" prepared by Blackwell and
Associates, Inc. and dated February 29,2008.

EXHIBIT "A"
Applicant is seeking relief by Special Permit under Chapter 139-33A to allow the
alteration and extension of a dwelling which is non-conforming. The existing structure
does not comply with current requirements as to side/rear yard setbacks and is a
residential use on a lot with less than the required area and frontage, the structure extends
0.06:1: feet over the rear lot line, is 1.08::1: feet from the easterly side lot line and is on a lot
which contains 3615 square feet in a zoning district where the minimum lot size is 5000
square feet and rear/side set-backs are five feet. The existing dwelling has total ground
cover of 15.3% (552 square feet) in a district that allows 50% ground cover.
Applicant proposes to construct an addition to the existing dwelling. Said dwelling will
meet all set-back requirements. The proposed addition will have 530::1: feet of ground
cover, bringing the total ground cover of the lot to 1082:1: square feet or 30% oflot area.
