At a Public Hearing of the ZONING BOARD OF APPEALS held at 1 :00 P.M.,
Friday, April 11 , 2008, in the garage area at the Town Building Annex, 2 Fairgrounds Road,
Nantucket, Massachusetts, on the Application of RICHARD J. GLIDDEN, TRUSTEE OF
NANTUCKET-MONOMOY HEIGHTS REALTY TRUST, Nantucket, MA 02554, Board of
Appeals File No. 008-08 the Board made the following Decision:
1. Applicant is seeking a Special Permit relief pursuant to Zoning Bylaw section 139-18
(Off-Street Parking) to allow the two (2) required parking spaces to be provided off-site on
the adjacent property at 38 Monomoy Road via easement. The site is located at 36 Monomoy
Road, is shown on Nantucket Tax Assessor's Map 54 as Parcel 244, is shown on Land Court
Plan 14974-E, and is registered at the Nantucket County Registry of Deeds as Certificate of
Title No. 22746.
2. The Decision is based upon the Application and materials submitted therewith, and the
testimony and evidence introduced at the hearing. There was no recommendation from the
Planning Board as the Board determined that the matter was not a planning concern. There
were no letters on file.
3. Applicant's attorney presented the case for the Applicant. He explained that the house
sits on an undersized lot which contains 4,149 square feet of lot area in a zoning district that
requires 40,000 square feet of lot area. The Applicant is renovating the house, but is not
changing the footprint because the pre-existing footprint is grandfathered. The previous
owner had parking spaces on the side of the house abutting Berkeley Avenue and those spaces
were located partly in the lay-out of Berkeley Avenue. Applicant could create two (2)
parking spaces in the front of the house, but it would require backing out onto Monomoy
Road which is not the safest arrangement. Applicant has secured an agreement from the
owner of adjacent property at 38 Monomoy Road to grant an easement in recordable form to
allow the parking of two (2) cars at 38 Monomoy Road. The adjacent property has a large
turnaround with ample parking for both properties which will allow safe and convenient
access to Monomoy Road.
4. Based upon the forgoing the Board finds that the Applicant's request is in harmony
with the spirit and intent of the Zoning Bylaw in that it will provide safe and convenient
vehicular access to Monomoy Road for the owner of the property at 36 Monomoy Road. The
Board also finds that the pre-existing undersized nature ofthe lot of record has resulted in
practical difficulties in providing safe and convenient parking on-site.
5. Accordingly by UNANIMOUS VOTE, the Board grants a SPECIAL PERMIT
pursuant to Nantucket Zoning Bylaw Section 139-18B(1) to allow the required parking for 36
Monomoy Road to be provided via easement on the adjacent property at 38 Monomoy Road.
Said Special Permit is subject to the following conditions:
a) An easement substantially in form attached hereto as Exhibit "A" shall be
recorded at the Nantucket Registry of Deeds and a copy of which shall be provided to
the ZBA after it is recorded.
