I. Call to Order:
Chairman Michael O'Mara called the meeting to order at 1:05 P.M.
II. Approval of the Minutes:

Attorney Jessie Glidden spoke on behalf of the applicants.
Ed Toole expressed his concern that the Land Bank property is going to be used for a
private organization. The public will no longer be able to utilize the property if the Paddle
Tennis courts are built because only members of the Paddle Tennis club will be able to
enjoy the property.
A motion was made (Toole) and duly seconded to continue the application to the March
meeting. The vote was 5-0 in favor.

The applicant represented herself. Applicant explained that due to a contracting and
surveying error, her deck was constructed in the setback.
A motion was made (Waine) and duly seconded to approve the application and allow the
side yard setback to be reduced to 8.4 feet from the required 10 feet. The vote was 5-0 in
favor.

Neil Brosnan spoke on behalf of the applicants. The applicants are proposing to
construct a garage in the side yard setback.
A motion was made (Toole) and duly seconded to approve the application on the
condition that the height of the structure is no more than 14 feet above mean grade. The
vote was 4-1 in favor (Sevrens opposed).

Attorney Steven Cohen spoke on behalf of the applicants.
At the previous meeting, the Board recommended the applicant look into a possible "pull-
off" for taxis and other vehicles to drop off patrons.
The applicants also informed the Board that they have made arrangements for a "Tow-
Zone" and for Harbor Fuel to come once every two (2) weeks, in an effort to alleviate the
congestion on the road.
The abutters informed the Board that no contact had been made with them prior to this
meeting.
Attorney Rhoda Weinman spoke on behalf of some of the abutters and reiterated her
request that there be no weddings or other events held on the premises, the "continental
breakfast" remain available only to guests of the Veranda House, that outdoor lighting
and air conditioning be "at a minimum", and that construction be done between June 1st
and September 15th.
The Board also questioned the extent of the outdoor check-in/greeting service proposed
by the applicants.
The Board indicated the applicants should also consider creating a parking spot and
adequate bike/moped storage on the premises.
A motion was made (Toole) and duly seconded to continue the application to the March
13, 2008 meeting. The vote was 5-0 in favor.

Attorney Steven Cohen spoke on behalf of the applicants.
Attorney Rhoda Weinman spoke against the application and asked the Board to find that
the relief requested will be more detrimental to the neighborhood than what currently
exists.
Attorney Sarah Alger spoke on behalf of some of the abutters. Attorney Alger requested
that the applicants consider limiting the work season from Memorial Day to October 1st,
limiting the hours during the day when construction can take place, making sure there is
adequate parking, making sure there are noise provisions in place so the neighbors are not
disturbed, ensuring that mechanicals are properly placed on the site, and that no steel
sheeting is used.
The Board requested a letter from the engineer and from Toscana Corp. explaining how
the project will be completed without steel sheeting and what they plan to do regarding
the requests of the abutters.
A motion was made (Toole) and duly seconded to continue to the March 13th meeting.
The vote was 5-0 in favor.

Attorney Arthur Reade spoke on behalf of the applicants. The applicant is proposing to
resite his dwelling due to the coastal erosion.
A motion was made (Wain e) and duly seconded to approve the application with the
condition that no exterior work is to be done from June 15th to Labor Day.

V. Other Business
· 2008 Annual Town Meeting Warrant
Leslie Woodson Snell informed the Board of the upcoming warrant articles that affect zoning.
VI. Executive Session:
The members of the Zoning Board of Appeals were polled to go into Executive Session and not
return to Public Session. The poll was unanimous.
VII. Adjournment
A motion was made (Wain e) and duly seconded to adjourn the meeting at 4:45 P.M.
