NANTUCKET ZONING BOARD OF APPEALS TWO FAIRGROUNDS ROAD NANTUCKET, MASSACHUSETTS 02554 Assessor's Map 42.4.3 Parcels 67 and 64 Residential Old Historic 61 Centre Street Nantucket, MA-Bk. 567, Pg. 285 8 Chester Street Nantucket, MA-Bk. 566, Page 37 At a public hearing of the Nantucket Zoning Board of Appeals on Friday, April 11, 2008, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 013-08 of MARTIN'S GUEST HOUSE NOMINEE TRUST, KIM GLOWACKI AS TRUSTEE, AND CENTERBOARD GUEST HOUSE NOMINEE TRUST, KIM GLOWACKI AS TRUSTEE, 61 Centre Street and 8 Chester Street, Nantucket, Massachusetts 02554. 1. Applicant is seeking Variance relief pursuant to Nantucket Zoning By-Law Section 139-32 (Variances) from the regulations in Zoning By-Law section 139-16 (Intensity Regulations) in order to validate two abutting properties as separate marketable and buildable lots. In the alternative, Applicant is seeking a finding that the subject lots have not merged thus no relief from the Zoning Board of Appeals is necessary. The properties are located at 61 Centre Street and 8 Chester Street, are shown on Nantucket Tax Assessor's Map 42.4.3 as Parcels 67 and 64, respectively, in Plan Book 3, Page 29 and Plan Book 74, Page 241, respectively, and are recorded at the Nantucket County Registry of Deeds in Book 567, Page 285 and Book 566, Page 37 respectively. 2. This Decision is based upon the Application, accompanying materials, representations and testimony received at the public hearing. The Planning Board did not make a recommendation as the Application did not present any issues of planning concern. There were numerous letters from abutters submitted in favor of the application. 3. Prior to the hearing, the Zoning Enforcement Officer made an unofficial determination that the two lots had merged as a result of two documents that were recorded on April 12, 2004 at Book 882, Page 299 and Book 882, Page 332 stating that the sole beneficiary of each Trust holding title to the two subject properties is one and the same, and the Trustee of the each Trust is one and the same. Since one of the two properties is an undersized, non-conforming lot, the Zoning Enforcement officer opined that because of the common ownership, there was a merger of the two properties. At the hearing, the Zoning Enforcement Officer advised the Zoning Board of Appeals that he had reconsidered his opinion about the merger based on additional research and a consultation. with Mark Bobrowski, a Professor of Law at the New England School of Law and author of "Handbook of Massachusetts Land Use and Planning Law". The Zoning Enforcement Officer retracted his earlier determination, and supported the Applicant's contention that the lots have not merged thus requiring no relief from the Board. Further, Applicants explained to the Board that they researched the history of both properties, and that both properties were initially dwellings prior to the enactment of the Nantucket Zoning By-Law. Therefore, under the definition of "lot" in the By-Law, the two properties have not merged, and are separate marketable lots. The Board notes that the lots are divided by a fence, and the appearance of the structures is different. There are no common elements indicating that they were not each built as a single property. Historically, the lots have been owned and operated separately, and it is only recently that the issue of a potential merger has been raised. 4. Accordingly, by UNANIMOUS vote, the Board made the finding that no relief was necessary based on the material submitted by the applicant, the testimony of the applicant, and the testimony of the Zoning Enforcement Officer. Additionally, the Board found that Variance relief pursuant to Zoning Bylaw Section 139-32 was not necessary and that no merger had occurred; thus, the properties remain separately marketable and buildable.
