MEETING MAY 26, 1987
The meeting was opened at 4:33 p.m. by Chairman Charles Mayhew
with the following Commissioners present: Alexander Craig,
Ronald Santos, and E. Foley Vaughan.
It was suggested that the Airport review its insurance coverage
and obtain competitive bids on our needs. The Manager will

Tower Building renovation plans to make the building water. tight
were discussed. The Commission was informed on the government's
cost sharing process and the areas included in our plans.
The purpose of the meeting was to hold an open hearing to review
counter and office assignments in the Tower Building of lessee
Robert Walsh and Around Nantucket Car Rental/Budget.
Mr. Robert Walsh stated to the Commission that he is presently
only conducting aeronautically related businesses: a flying club
and a whale watching charter business. He also stated that he
has two aircraft,with which he will be doing flight training.
The Commission felt that this space would better serve an air
taxi business. Commissioner Craig felt that the name Nantucket
Flying Club is in name only and not really a business, and that
the Commission should proceed with the termination of Mr.
Walsh's lease. The Commission interrogated Ray Slocum from
Tri-Air as to his needs for office and counter space for their
freight and on-demand charter service. It was M/S/P to proceed
with the termination of Mr. Walsh's space, send him a
termination notice, termination to be effective June 30, 1987.
Around Nantucket Car Rental/Budget's lease space in the Tower
Building was discussed next. Mark Perry attended the meeting
representing his father. After some discussion regarding their
requirements, it was M/S/P to terminate the Around Nantucket Car
Rental/Budget office space in the Tower Building. Commissioner
Vaughan abstained from voting.
It was advised by Commissioner Vaughan that the check for Express
Air's back rent not be deposited without first check with Town
Counsel.

Tri Air was requested to submit a letter to the Commission
requesting which counter and office space he would like to occupy
from those that are now available, effective July 1, 1987.
At 5:57 p.m. it was M/S/P to enter into Executive Session to
discuss leases and value of real property. Roll call votes were
as follows:

EXECUTIVE SESSION
Town Counsel, Paul DeRensis, informed the Commission that a
standard form for general leases will be provided so that legal
expenses not be incurred each time a lease is prepared.
The McGrath Aviation lease was brought up for discussion as to
what the Commission would have to provide another FBO if we allow
Bill McGrath a 3D-year lease on the maintenance hangar.
At this point, Commissioner Vaughan left the meeting.
Town Counsel reiterated the illegality of creating a exclusivity.
He suggested that limited resources can be put out to bid. He
recommended that in order to satisfy federal law that we
encourage a second FBO.
It was suggested that the present maintenance hangar be used for
another purpose and have the FBO put up his own building. Town
Counsel suggested two scenarios: (1) set aside two pieces of
land and put them out for bid, the lessee to build the structure.
(2) Lease the land with a building put up by the Airport
Commission. He also felt that the rent, which is now being paid,
is a reasonable rent and that leases contain a mechanism to
compute the rent to make it fair in the future. He suggested
competitive bidding with the right of the present lessee to match
the highest bid. He suggested being up front with subsidizing a
business so that competitive businesses know what they are
entitled to.
At 7:55 p.m., it was unanimously voted to return to regular
session.
