II He stated that his White Elephant operation acquired the site some years ago and had used it con- tinously as an annex to the W:'1i te Elephant and had used it two years ago to house employees of the hotel. " Mr. Beinicke stated the new buj ldin::~ was approved by the Planning Board and by HDC. The area of t~e now building is less than the area I; of the old Breakers b-lildin:; and the hei.sht of the present structure is less than the old building. ,i Mr. Beinicke stated he believ~d this tract qualifies as a non- conformin~ use but that he is proceeding in this manner because he wishes to recognize the integrity of the Zoning By-Law and to have the necespary authorities approve what he is doin~. 11 The lot under consideration cannot maintain a parking area sufficient in size for t~e necessary hotel operation. Mr. Beinicke proposes to provide the necessary parking area across the street and on Willard Street. He owns two lots that have been used for pari<:ing for 7 and 10 years respectively and will improve these lots to accomodate the required parkin-s- spaces. In lieu of on premises parking, Mr. Beinicke will cause the front yard area to be attractively landscaped and submitted a plan of landscaping for the area. He states t'Je area and neighborhood was one of fine homes and well- cared for lots and he wanted to continue to observe that practice. The front lot of this parcel could be po. ved if required but he hoped this would not be necessary since it wi~l be injurious to the neighborhood. Mr. Beinicke stated that he will commit the use of t}~ Wil12rd Street parcels to continued operation of the annex as parking areas if the Board II so requires. Mr. Beinicke concluded by pr8sent~ng a pictorial record of the use of the parcel as liThe Breakers" and "lOW as the annex to the White Elephant. He ;1 also presented plans for the improvement of the proposed parkin~ areas. Mr. Beinicke stated that he has a substantial six figure investment in the project and that he int2nds to protect that investment. There being no speakers and n0 rebuttal, the Chairman then declared the hearing closed. " After due deliberation and consideration, it was moved by Mr. Greene and seconded by Mr. TaJlor, that the petition be granted subject to the following conditions: That the tract on which the ~nnex is located be landscaped according to the plan presented by Mr. Beinicke and that su~h landscaping be done on or before August 1, 1973. That the area to be used for parking be screened by suitable plantings. That the area to be used for rarkin~ be restricted against any other use or purpose so long as the Breakers is in use as hotel or motel property. That no lighting or signing be placed in or on such parking lot areas until the same have been a~prov~d by this Board. The Board found the grant~ng of this conditional variance and the granting of the extension of the ncn-conformins use was generally in accord iI :1 wi th the intent of the by-l.aw and was in the best interests of the general neighborhood and would serve to rrotect and enhance the appearance of the II area and would not deteriorate from or be in derogation of the by-law. Nantucket, Mass. IN RE: On the Petition of Island Service Company 011-73. For the Petitioner appeared Mr. Walter lleinicke: Mr. Beinicke reviewed f()r the Board the history of the tract involved and recited the prior use and occupancy of the parcel as "The Breakers". He stated thaG his White Elephant operation acquired the site some years ago and had used it continously as an annex to the White Elephant and had used it two years ago to house employees of the hotel. Mr. Beinicke stated the new building was approved by the Planning Board and by HDC. The are2 of the new building is less than the area of the old Breakers buildinG and the height of the present structure is less than the old building. Mr. Beinicke stated he believed this tract qualifies as a non- conforming use but that he is proceeding in this manner because he wishes to recognize the integrity of the Zoning By-Law and to have the necessary authorities approve what he is doing. Also speaking for the Petitioner were: Mr. Alexander Crajg who stated that he was the owner of four houses in the neighborhood and believ0d the variance should be granted. He stated that the installation of a parking area on Easton street will devalue property, cause traf;ic problems and be generally harmful. He supported the idea of pla~ing parking in the off-street area. Mrs. Kent King who stated she was an abutter and did not want the noise and confusion of a parking lot under her windows. ~... j~......' . , '4 , I I' I In opposition 'appeared: Mr. Ed. Pollard who stated h~ abutted the area on Willard St. where one of the alternate parking areas was to be located. He stated that he did not want this type of use next to his property since he felt this would decrease his rental value. ;i :1 There being no further c,;Jposition and no rebuttal, the Chairman then read communications favoring tIle petition from Mr. and Mrs. George Jones, abutters, David II. Murray, 1.b,ltter, Mrs. Kent King, abutter, and from the Nan- tucket Planning I3oard. The Chairman read letters opposing the petition from Hr. and Mrs. Alfred Sanford dnd from Mr. and Hrs. Beinicke and that such landscaping be done on or before August l, 197.3. That the area to be userZ for parking be screened by sui table plant- ings and that a plan of the landscaping of each area be submitted to the Board on or before June 14, 1973, for approval by the Board. That the area to be used for parking be restricted against any other use or purpose so long as the Breakers is in use as hotel or motel property.
