These minutes of a meeting of the Zoning Board of Appeals held at
8:00 P.M. October 17, 1972, in the Selectmen's Chamber of the Town Hall
of the Town of Nantucket.
IN RE: The petition of Nantucket Cablevision, Inc., Federal Street,
Nantucket, Mass., for a variance to construct and use a tower on land at
the Sanitary Land Fill, off Madaket Road, Nantucket.

Attorney James K. Glidden appeared before the Board on behalf of Nantucket
Cablevision and gave information concerning the diligent search by Nantucket
Cablevision for an alternate site and that the site under consideration is
the only feasible location. Mr. Glidden detailed the construction of the
tower and the precautions to be taken against collapse. He emphasized the
remote nature of the site, the lack of residences near the area, and the
fact that the site would not be ecologically altered.
Mr. John W'elch spoke on behalf of Nantucket Cablevision and reiterated the
long search for another site and that this site was the only available site.
Mr. A. Roggeveen spoke on behalf of the petitioners.
OPPOSITION: In opposition appeared Attorney Robert Mooney who questioned
whether the tower, if it collapsed, would fall on adjoining premises. Mr.
Glidden replied to the question in the negative, and Mr. Mooney withdrew
his objection.
Mrs. Richard Waite appeared and questioned the necessity for lighting the
tower. Mr. Glidden replied to the question and stated the lighting was
fixed by FAA standards. Mrs. Waite discussed other possible sites for the
tower.
No other persons appeared in opposition.
The Chairman read a telegram from Alan S. Atwood opposing the variance
request.
The Board members asked several questions of the petitioners in order to
receive technical information and to determine whether conditions could be
attached in the event a variance is given.
DECISION: On motion by Mr. Greene, seconded by Mr. Taylor, it was unani-
mously voted to grant the requested variance subject to the following
conditions:
1. The variance herewith granted will cease to be effective in the
event the tower is not constructed and in use within two (2) years from the
date hereof.
2. The petitioners will post a bond with the Town of Nantucket in an
amount of $10,000 to cover the cost of removing the tower in the event its
use by the petitioners is discontinued for a period of six months of more.

It was the oplnlon of the Board that the statutory conditions of
hardship had been met and the variance would not be in derogation of the
intent of the Zoning By-Law and that the character of the neighborhood
would not be impaired.
